THE NORTH CAROLINA GENERAL ASSEMBLY END: The Railroad Passenqcr Rale Is m 2 1-4 Cents per Mile?Mr. Winston's Good Service. The following summary of the se sion is from the Hiblical Recorde published in Raleigh: This week the general assembly \vi reach an end,?after sixty busy day It is not our purpose now to revie the session, however, as the acts < this week will weigh heavily in tli tinal account. In evidence of the trut ?>i tnis statement is me i;ui iii.u .i> cording t" the governor of North Ca' olina the genera! assembly comes int this final week with only two of ii party's seven specific platform pledgt redeemed. WVe believe they will full! the others, for as we have said hen tofore, there never was in Raleigh general assembly so tree from seltis influences, or more disposed to do tl people's will. And we say this aft* many hours attendance upon its d< liberations. . Last week the railroad passenger ral | ^jill reached a conclusion,?the ne Vite being J'i cents per mile on rai loads that are more than sixty mil* j>ng, the second-class being abolishei ^ f)i course the length of the road ,, <-fe*ek.,i>?S factor. A happens that all roads that are mor than sixty miles long report earning ^ of more than $1,500 per mile per yea We regard this rate as being as loi . as the State could safely order; th one tlii 11 x that saves it from being to low is the abolition of the second-clas car. That the house and the senate wer brought together is due largely to th lieutenant governor, Mr. Winstot That his bold stroke in appointing committee on the senate's part ha br ought down upon him severe criti cism is our reason for here going little out of the way to render him dt served praise. Me understood that th gentleman,?Mr. John \Y. Graham.who was in logical line ior that con fereiice committee, the senate bavin accepted his bill,?would not yield a iota: and he refused therefore to ap point him. We regret, as every on fo inu>t. the apparent -lighting of >o tin a citizen as Mr. Graham; but we at plaud none the less Mr. Winston' determination that the reduction < rates should not be held up by iailui oj the house and senate to agree. M Winston has presided over two senati now. He has made a most admiral) president and he has used his offu noblv in the public service. Firtnnes courtesv. honor, wisdom and the mil lie welfare have characterized his who i course. And for this reason he statu Wore the people of \'<>rth Carolir in larger outline than at any time i his career. lie has been tried an found good. Freight rates and other railroad sul ? jects will conic up this week. We for that little will be done to increase tli safety of travel. We heard the debate on the compu sory education act. It is in the natut r>f a local option act,?that is, it pr< vides machinery for compulsory edi cation wherever the people may vol for it. But it is not a local option a< where the school attendance falls bi low ,t5 per cent, of the enrolhnen When that happens the county boai of education can order compulse) measures. From this feature of tl act, however, forty counties were, \\ regret to say, excepted. We like tl local option idea. That calls for loc; campaigns, local opinion and local ii terest in education. It might seei feasible to set up compulsory educ; tion at once,?but only to the idealis Wc must first build up the minds an hearts of the people. The reformatory bill has passed i a most elementary form. It carries n appropriation. .Some ladies and get ' > tlemefa .most of them about Charlotti I we understand,?will undertak / to maintain the institution. The Stat i / gives the enterprise its in iniprimatui h j and if all goes well, will eventually tak .T charge of it. This is not the sort c \ beginning that we hoped for; but i is a beginning, and it is well that a be * ginning has been made. Violent opposition was manifeste toward the State superintendent's hi to enable counties to levy special taxc to make the school terms four month j long,?the proposition being to utiliz half the State's special $.200,000 apprc priation in supplementing not the re^ \ilar fund, as is now the case, bu special taxes. Seeing that the consti tution requires a four month's schoo we incline to hold thut the State mus appropriate sufficient funds to run th schools four months. And if the would run longer .then let them vot a special tax. it was probably wist ? therefore, to defeat this bill. A number of temperance bills, am also the bill regulating child labor, wil come up this week. So will the anti trust bills. Mr. Sims Gilinore's barn in Jones ville was burned Wednesday. He Jos some feed but no stock. The fire i supposed to be the work of an incen diary. " A ft WE ARE SELLING Dunlap's Elour. ? No better ever came out of a mill; ? every sack guaranteed. Real Estate, Stocks and Eire Insurance it. ORDER. 'State of South Carolina, County of Union. Court of Common Pleas. Joseph Sanders, et. a!., Plaintiffs, against J. Fincher Belue, et. al., Defendants. | ORDER. : The Hoard of County Commissioners of Union county have charge of the Poor House and Farm and power to appoint a superintendent thereof. The term of the old Hoard expired in January, kk>7, and that of the new. or present Hoard, began in that month and now exists. In October, 1906, the old Hoard appointed J. Fineher Heine superintendent of the Poor House, &c., and in January, 1007, the new Hoard appointed S. G. Howell to the same position. Is the superintendent of the Poor House, &c., an officer? If it is a public office, then a preliminary injunction should be denied; that is settled law. A position requiring the discharge of | public duties created and provided for | by law may be a quasi office, though his appointment may be at the pleasure of the Hoard oppointing him. The tenure or duration of this quasi office, Ior appointment, may depend upon statutory law or contract, either expressed or implied. There is no statutory law providing the tenure of a superintendent, and this case there was and is | no express contract. There is evidence ! tending to support a long continued | custom and practice that such appoint- ; tnent of superintendents have been made in the fall by previous Boards of County Commissioners in the Coun[ ty of Union, and that the tenure was for, at least a year. It also appears , that the practice or custom was known to all or the parties to this action. I I do not think that a preliminary in- ] junction, practically deciding the case, j should be issued now, determining in advance the numerous and important questions of law raised and presented 5 by the Return. I Two or the County Commissioners , are plaintiffs herein and one is defendant. They differ upon the material : issues herein, and unless some irre- 1 parable injury will result to the plaint- ? iffs, who arc County Commissioners, , by withholding the preliminary writ of ' injunction, it should not he issued. The record does not show with suf- ( ficient certainty that the said Plaintiffs will sustain such injury; or that the ( plaintiff, Howell, will sustain such injury either, for the Return is that J. Finchcr Belpc is solvent and responsible for a ve.-dict against him. I. therefore, conclude, and so order. , that the Return to the Rule to show | cause herein, is sufficient, and that said Rule be and hereby is discharged.
