Violent opposition was manifeste toward the State superintendent's hi to enable counties to levy special taxc to make the school terms four month j long,?the proposition being to utiliz half the State's special $.200,000 apprc priation in supplementing not the re^ \ilar fund, as is now the case, bu special taxes. Seeing that the consti tution requires a four month's schoo we incline to hold thut the State mus appropriate sufficient funds to run th schools four months. And if the would run longer .then let them vot a special tax. it was probably wist ? therefore, to defeat this bill. Wedding bells are again ringing in our town. Tomorrow afternoon Mr. S. C. Crosby and Miss Minnie Charles are to be married at the home of Mr. Robert Charles, who lives about four miles oht ip the country. The ceremony will J>e performed by Rev. J. T. Going.' Occasionally there comes a whisper into the ear of your scribe, intimating that quite a number of our young men mean before long to take unto themselves their better half. Mr. J. A. Going is having a nice liveroom dwelling house erected on the spot where his store building stood. The ladies missionary society of the Baptist church are to have their entertainment, consisting of dialogues, recitations, etc., on Saturday night at Morach hall. An infant child of Mr. D. W. Williams has been very sick for the past week from diphtheria. Mr. Johns, father of Mrs. C. M. Freeman, is spending this week here with her. Mrs. J. A. Lowe was called to Columbia on last Sunday to the bedside of a sick nephew. Mr. and Mrs. Lowry Webber, of Yorkvillc, spent last Thursday at the home of Mr. J. C. Mitchcl here. That night a musical entertainment was given them. The music was rendered by .Mr. Jim Carter, of this place. Several i friends attended and all report a pleasI ant time. Fincher Belue, et. al., Defendants. | ORDER. : The Hoard of County Commissioners of Union county have charge of the Poor House and Farm and power to appoint a superintendent thereof. The term of the old Hoard expired in January, kk>7, and that of the new. or present Hoard, began in that month and now exists. In October, 1906, the old Hoard appointed J. Fineher Heine superintendent of the Poor House, &c., and in January, 1007, the new Hoard appointed S. G. Howell to the same position. Is the superintendent of the Poor House, &c., an officer? If it is a public office, then a preliminary injunction should be denied; that is settled law. A position requiring the discharge of | public duties created and provided for | by law may be a quasi office, though his appointment may be at the pleasure of the Hoard oppointing him. The tenure or duration of this quasi office, Ior appointment, may depend upon statutory law or contract, either expressed or implied. There is no statutory law providing the tenure of a superintendent, and this case there was and is | no express contract. There is evidence ! tending to support a long continued | custom and practice that such appoint- ; tnent of superintendents have been made in the fall by previous Boards of County Commissioners in the Coun[ ty of Union, and that the tenure was for, at least a year. It also appears , that the practice or custom was known to all or the parties to this action. I I do not think that a preliminary in- ] junction, practically deciding the case, j should be issued now, determining in advance the numerous and important questions of law raised and presented 5 by the Return. I Two or the County Commissioners , are plaintiffs herein and one is defendant. They differ upon the material : issues herein, and unless some irre- 1 parable injury will result to the plaint- ? iffs, who arc County Commissioners, , by withholding the preliminary writ of ' injunction, it should not he issued. The record does not show with suf- ( ficient certainty that the said Plaintiffs will sustain such injury; or that the ( plaintiff, Howell, will sustain such injury either, for the Return is that J. Finchcr Belpc is solvent and responsible for a ve.-dict against him. I. therefore, conclude, and so order. , that the Return to the Rule to show | cause herein, is sufficient, and that said Rule be and hereby is discharged.
