By some means?not accounted for?there w as no provision made for opening the court of common pleas In the Ledger of 14th "Lex" has this to say : "The existence of Section 26 of the Code appears to have been entirely overlooked by the Legislature; and in the repealing clause has the Act which is gen eral and sweeping, this Section 26, which was the only authority for holding the courts of Common Pleas at the summer terms, was overlooked, and not retained. So if this Section 26 of the Code is repealed by the recent Act, there is now no authority for holding the court of Common Pleas at the June term. Such appears to be the obvious construction of the effect of the recent Act.
