I Very Interesting Document. here Is No Difference Between Salary and Compensation in the Acts Creating the Office. )lumbia Slate, 12th. Within the last few weeks the ttorney general's ollice has isjed opinions ou some very imortant Questions. These oninmnw ave been submitted in answer to iquiries from the various deartments of the State governlent. Gen. Billinger yesterday filed n opinion which will be of genral interest, afTecting every aunty in the State. It was sublitted in aiiswer to an inquiry rorn Comptroller General Deram relative to the salaries of the aunty auditors. Following is his letter to Gen. ierham: Dear Sir: In numerous inquiies through your office and diacted to this by county auditors, in opinion is asked upon the allowing: For what is the amount to be aid by the respective counties, ) auditors intended, as supplelen.tary the amount paid by the tate, and constituting in part neir salaries, or is it specifically ppropriated as compensation for ibiniv rnfupnci o ?uni^ i^tui uo auvj liiarwiu^ an sssments only ? A brief review of the history of >gislation, relating to the office f county auditor and its salary nd compensation, will tend to lake clear the opinion which lall be given. This office w?<* created by the igislature of 1894 by act aproved March 19th (page 731). /e find at page 77G in section 13: "The following shall be the smpensation of county auditors Gxing the amounts for each rejectively) to be paid quarterly y warrants on the State treasrer issued by the comptroller sneral; provided, that the compoller general shall not issue to ny county auditor any warrant >r salary until said auditor shall le in the office of the comptrollr general all abstracts and re orts due from or by said auditr." This schedule of salaries retained unchanged until the act pproved March 25th, 187G, page )3, vol. XVI, was passed, wherei it is provided in section 3 "the iunty auditors of the several )unties shall receive the annual ilaries hereinafter mentioned No EM&ht to Ugliness. (Retting forth schedules of salaries); provided, that the comptroller general shall not issue to any county auditor any warrant for salary until the said auditor shall file in the office of the comptroller general all abstracts and reports due from and by the said auditor, and in addition to the salaries of the county auditors, as hereinafter provided, the county auditor shall receive, to defray the expenses of assessment of property, such sums as may be necessarv hut not to exceed the following, to wit (setting sortli compensation for respective auditors) and the county commissioners of the several counties, as aforesaid, shall, upon the application of the county auditors, draw their checks on the county treasurer for the sevoral amounts to which the auditors may be entitled under the provisions of this section and the county treasurer shall pay the said checks from the first collection of county funds for the fiscal year in which the Work fihnll ho norfnrmn^ ? ? ? w ? ? W pvi I V/I uir ( 11 UUW II W such check or order shall be paid by the county treasurer until the auditor shall have filed with the county commissions an itemized statement of the services rendered by his assistants, the number of days each assistant wereemployed and the compensation they were severally to receive, which said statement shall be examined and approved by the said board of county commissioners." Up to this point it seems too clear for argument that the amount to be paid by the State was fixed as to each auditor was an annual salary not in any sense depending upon the amount of work contemplated to be done; and that the amount to be paid by each county was in effect a contingent expense account not to be exceeded in any event but not to be entirely expended except in the payment of assistant auditors employed upon a stated basis of compensation to be previously agreed upon, and in no sence an extra compensation to the county auditor. The amount received from each county, respectively, was intended to be a trust fund in the hands of its auditor to be accounted for in strict compliance with the carefully worded provisions of the act. Since the act just referred t there does not seem to have bee made any change in the law a fecting the counties of the Stat in general. It will be seen tht the act of 1883 made a marke change as to the use to which th fund payable by the county wt to be put. It is an additional con pensation to the auditors as sue and not given to them and dii bursing officers to be paid tothof who under their direction pe formed certain duties. The a?sis ant auditor is nowhere mentioi ed. The purpose for which th fund is appropriated is only stale generally as extra compensatio for the county auditor. That no argument can be base upon the distinction between th meaning of the word salary an that of compensation is shown b the fact that the act of 18"< speaks of tho amount paid by tli State to the county auditors t "compensation,11 and the act < 1877 substitutes the word, ev dently by way of being a syi onym, "salaries'" in place of tl word compensation, when speal ing of the same fund. An enumeration of all the coui ties, being a great majority of tl same, mentioned in the sectioi of the various acts would unne essarily encumber this opinio Hence it must be left to each or interested to refer to the acts t ascertain if any particular count in included in the general list.
