here Is No Difference Between Salary
and Compensation in the
Acts Creating the Office.

Within the last few weeks the

Gen. Billinger yesterday filed
n opinion which will be of genral
interest, afTecting every
aunty in the State. It was sublitted
in aiiswer to an inquiry

aunty auditors.
Following is his letter to Gen.

A brief review of the history of

March 19th (page 731).

that the comptroller general shall
not issue to any county auditor
any warrant for salary until the
said auditor shall file in the office
of the comptroller general all abstracts
and reports due from and
by the said auditor, and in addition
to the salaries of the county
auditors, as hereinafter provided,
the county auditor shall receive,
to defray the expenses of assessment
of property, such sums as
may be necessarv hut not to exceed
the following, to wit (setting
sortli compensation for respective
auditors) and the county commissioners
of the several counties,
as aforesaid, shall, upon the application
of the county auditors,
draw their checks on the county
treasurer for the sevoral amounts
to which the auditors may be entitled
under the provisions of this
section and the county treasurer
shall pay the said checks from the
first collection of county funds
for the fiscal year in which the

such check or order shall be paid
by the county treasurer until the
auditor shall have filed with the
county commissions an itemized
statement of the services rendered
by his assistants, the number of
days each assistant wereemployed
and the compensation they were
severally to receive, which said
statement shall be examined and
approved by the said board of
county commissioners."
Up to this point it seems too
clear for argument that the
amount to be paid by the State
was fixed as to each auditor was
an annual salary not in any sense
depending upon the amount of
work contemplated to be done;
and that the amount to be paid
by each county was in effect a
contingent expense account not
to be exceeded in any event but
not to be entirely expended except
in the payment of assistant
auditors employed upon a stated
basis of compensation to be previously
agreed upon, and in no
sence an extra compensation to
the county auditor.
The amount received from each
county, respectively, was intended
to be a trust fund in the hands
of its auditor to be accounted for
in strict compliance with the
carefully worded provisions of
the act.
This law, as to the mode of payment
was incorporated in the
general statutes of 1882 and remained
unchanged until 1883

Since the act just referred t
there does not seem to have bee
made any change in the law a
fecting the counties of the Stat
in general. It will be seen tht
the act of 1883 made a marke
change as to the use to which th
fund payable by the county wt
to be put. It is an additional con
pensation to the auditors as sue
and not given to them and dii
bursing officers to be paid tothof
who under their direction pe
formed certain duties. The a?sis
ant auditor is nowhere mentioi
ed. The purpose for which th
fund is appropriated is only stale
generally as extra compensatio
for the county auditor.
That no argument can be base
upon the distinction between th
meaning of the word salary an
that of compensation is shown b
