Atlanta, May 25.—Judge Candler has signed an order granting John Pend Icy anew Irial for the murder of Policeman Ponder. At the regular term of tiio Fulton criminal court, held m April, Pendley was convicted, mainly hpon his own confession, of the murdo’r of the policeman aud given a life sen- tenco. His attorneys made a motion for a new irial aud after considering the evidence for over two weeks Judge Candler made his decision favoring a now trial. The decision was based on the gronud that the evidence was not sufficient to convict aud that the verdict was not in accordance with the evidence.
