has forwarded the following dispatch:
“On May 23 Third infantry returning
to Baiinag from San Miguel xrero at
tacked morning, noon and evening by a
large force of enemy, suffering in
curualtics two men killed aud 13
wounded; enemy repulsed, leaving en
field Ifl killed; largo number wounded
and pris<mcrs.
••Yesterday enemy appeared in vicin
ity Han Fernando, aKacked by Kansas
and Montana regiments, which snifered
slight losses. Enemy driven through
rice lields, loaviug 60 dead, 38 wounded
and 28 prisoners; 6J rifles and other
property captured. Their retreat through
swamp land saved them from destruc
tion.

A New Trial For Peftdley.
Atlanta, May 25.—Judge Candler
has signed an order granting John
Pend Icy anew Irial for the murder of
Policeman Ponder. At the regular term
of tiio Fulton criminal court, held m
April, Pendley was convicted, mainly
hpon his own confession, of the murdo’r
of the policeman aud given a life sen-
tenco. His attorneys made a motion
for a new irial aud after considering the
evidence for over two weeks Judge
Candler made his decision favoring a
now trial. The decision was based on
the gronud that the evidence was not
sufficient to convict aud that the verdict
was not in accordance with the evidence.
