PORARY APPOINTMENT OF MAGIS? TRATES, ANT? TO DEFINE THEIR POWERS AND DUTIES. 1. Be il enacted by the Senate and House of Representatives of the State of South Carolina, now met and silting in General Assembly, and hythe autho? rity of the same, Tjntil tho organiza? tion of the Courts contemplated by Seotion 21, 22 and 23, of Article fourth, of tho Constitution, tho Go? vernor is hereby authorized, em? powered and required to appoint n suitable number of ht and discreet persons in eaoh County to act as Magistrates for such Counties, which persons ho shall commission; and the practice in such Magistrate Courts shall conform to tho law as hereto? fore existing, so far as tho same is not inconsistent with this Act, or with the provisions of the Constitu? tion of this State, as ratified in April, 1868. LT. On receiving such commission, i and before entering upon the duties of their offices, such Magistrates shall take and subscribe before the Clerk of tho Court of their respective Coun? ties tho oath required by Section 30, Article 2, of the Constitution, and file the same in his office, unless in Coun? ties where such Clerks may not be qualified according to law; and in such cases tho said oath shall be ad? ministered by any officer authorized to administer oaths iu tho County where such Magistrate may be ap? pointed; and snob oaths so adminis? tered shall be filed in the office of the Secretary of State. And such Magis? trates may immediately enter upon the discharge of their duties. III. Such Magistrates shall have original jurisdiction in cases of bas? tardy, and. in nil matters of contraot and notions for the recovery of fines and forfeitures, whore tho amount claimed does not exceed ninety-nine dollars; and in coses of actions ex delicto, where the damages claimed do not exceed ninety-nine dollars; and prosecutions for assault and battery, and other penal offences less than felony, punishable by fine not ex? ceeding ninety-nine dollars. They may also sit as examining courts, aud commit, discharge or recognize (except in capital cases) persons charged with offences. They shall also have power to bind over to keep the peace, or for good behavior. For the foregoing purposes they shall havo power to issue all necessary pro? cesses. IV. Tho Governor of tho State is hereby authorized and empowered, upon such evidence as may to him be satisfactory, to summarily remove any Magistrate of this State. V. Either party to a snit before a Magistrato shall be entitled to a trial by jury. VL In civil cases tho parties may agree on a jury, but when they do not agree, and also in criminal causes, a jury shall bo selected in tho follow? ing manner: Tho Sheriff, Constable, or officer appointed hy tho Magis? trate, shall write and fold np eighteen ballots, euch oontaining the name of a respectable voter of the vicinity; he shall deliver the ballots to the Magis? trate, who shall put them into a box ajd shako them together, and the officor shall draw out one, aud the person so drawn shall be one of the jury, unless challenged by either party; and the officer shall thus pro? ceed until ho shall have drawn six who sholl not bo challenged; but if tho first twelve shall ho challenged, i and the parties do not agree to a dioico, thu last six shall bu the jury; and when any of the six jurors so j drawn cannot be had, or aro dis-1 qualified by law to aot in such case, ! aud tho purl ins do not supply tho vacancy by agreement, tho officer shall proceed to prepare, in the muu uer bcfovo directed, ballots for three times the number thus deficient, which shall be disposed of and drawn ns above provided. VII. If nuy juror so summoned shall neglect or refuse to appear in obedience to such venire, aud shall not within forty-eight hours rende-: to the Magistrate who icsncd tho venire a sufficient reason for his de? linquency, ho shall forfeit and pay a fine of i wo dollars to the Treasury of tho County where tho causo is tried, to be assessed by such Magistrate, r id collected on hi.^ warrant without other process. VIII. An appeal from the judg? ment of a Magistrate to tho next stated term of the Circuit Court in tho County where the judgment is rendered may be taken by either party, if claimed within two hours after tho rendition thereof. IX. In criminal cases, the party appealing shall, at the time of thc appeal, give security by way of recog? nizance to the Treasurer of the Coun? ty where tho offence is charged tc have been committed, if tho prosecu? tion be on complaint of an informing officer; if otherwise, to tho proseen tor, conditioned that the appellant shall personally appear before soie Circuit Court, and there .prosccutt his appeal to effect, and abide tin order of the Court thereon. X. In civil eases, the party appeal j ing shall, at the time of the appeal give security by way of recognizant*! to the adverse party that the appel hint shall prosecute his appeal t< I effect, and auswer and pay all inter vening damages occasioned by dela; to the appellee, with additional cost if judgment bo affirmed. XI. Tho appellant shall produc and enter in the Court to which th appeal ia taken attested copies of th original writ, process, record of judg ment, and all evidence filed in th Court from which the appeal wo allowed. In tho Circuit Court th cause sliall be heard de novo, or as : no trial had been had. XII. The fee of each juror for tr? ing an action thall be twenty-fiv cents, to be advanced by the part praying for a jury before a venil shall issue. XIII. This Act shall take effe< immediately, and nil Acts or parts ( Acts inconsistent herewith are ? pealed. I. Be it enacted by Ute Senate a, lionne of Representatives of the St< of South Carolina, noic met and sitti in General Assembly, and by the a thor it y of the same, Any malo citize of the age of twenty-one years, hu ing read law in the office of any pn ticing attorney of good standing this State, for the period of t< years, or graduated at any rece nized law school in the United Statt shall, on tho examination of tin members of the Bar, appointed the Circuit Court for that purpo who shall certify that ho is a pers of good moral character, and poss ses tho requisite learning and abili bo admitted to practice in the Ciro and Probate Courts as an attorni solicitor and counsellor, upon taki tho oath prescribed in tho Consti tiou: Prodded, That in extraordini cases, the Judge presiding may, his discretion, dispense with any p tiou of the two years study her required. And tho Judges of Supreme Court may, in like mann and under like regulations, ndi persons to practice OS attorneys, s citors and counsellors in the Supre Court, and admittance to tho I premc Court shall eutitle them practico in all of the Courts of t State. II. Any person of good moral c racter, who hast been admitted practice as au attorney, solicitoi counsellor in any Court of recori any of the United States, or in i Court of tho United States, shall, producing the proper evidence tin of, on motion, be admitted to pi tics as such in the Courts of sim grado in this State, on taking prescribed oath. III. Any nttorney, solicitor counnellor, having been admitte? practice in the Circnit and Prol Courts, and pi?ul?ued accept? therein two years, shall, on mo and recommendation of any attor j ney of record in tho Supremo Court, bo admitted to practie in said 1 Court. IV. Tho oath required t J bo taken by this Act shall bo administered in open Court, and tho name of thc person taking tho samo entered in a roll or boole kept for that purpose, and a certificate of said oath shall bo filed in Court. V. Attorneys, solicitors and coun? sellors may bo removed or suspend? ed, and also, in aggravated cases, im? prisoned not exceeding twenty-four hours by tho several Courts in which they may have been admitted to prac? tice, if in tho presence of such Courts they aro guilty of any disor? derly conduct causing an interrup? tion of business or amounting to an open and direct oontempt of the Conrt, bis authority or person; but subject to such removal, they shall hold their office for life. VI. Any attorney, solicitor or counsellor may bo removed or sus? pended who shall bo guilty of any deceit, malpractice or misdemeanor; but not until a copy of the charges against bim shall have been delivered to him by tho Clerk of tho Court in which the proceedings shall be bad, and an opportunity shall havo been giveu him of being heard in bis de? fence. VII. If any attorney, solicitor or I counsellor shall enter into any speeu I luting practices by purchasing, or I procuring to bo purchased, any note : or other demand for the purpose of putting the same in suit, when other? wise the owner or holder thereof would not sue the same, such attor? ney, solicitor or counsellor shall pay a line of one hundred dollars, and shall thereafter be incapable of prac? ticing ns such in any Court until re? stored by tho Supreme Court. VIII. No attorney, solicitor or counsellor shall be allowed to occupy more than two hours of tho time ol tho Court in tho argument of any cause, unless he shall first obtain the speciul permission of the Court to dc so. IX. This Act shall not be con? strued so as to prevent a citizen fron: prosecuting or defending his owu cause, if lie so desires. All Actf heretofore passed, regulating the ad? mission of attorneys, solicitors 01 counsellors to practice in tho Courti of this State, and all Acts incousist ent with, or supplied by, this Act are hereby repealed.
