C. Law Review." In the article by T. C.'R. Legare, Jr., the previous cases involving tuition are discussed along with current ideas as to what they mean. "To date, all attacks on the right of a state to prescribe higher tutition for a non resident have failed," Legare writes. The area that is open to attack, according to Legare, is the requirement that a non resident student "retain that status throughout his continu ous regular term." It was found that the rule did not give the student any chance to show a change of status, and therefore denied "equality of opportunity to per sons similarly situated." It is clear, according to Legare, "that the key to deter mining whether a student qual ifies as a resident student ... is whether it is his intent to become a permanent resident of the state." The statement, "I intend to make this my permanent home," Legare writes, is worth less by itself. There are 9 factors to be con sidered in establishing resi dence, according to Legare.
