Rad Bookkeeping. The accounts of the dispensary have been kept, up to the dato of the bookkeeping of Mr. J. L. Thorpe, ir. a most chaotic condition. Numerous entries havo been got rid of by trans? ferring them to vuspcndod accounts, and then transferring suspended ac? counts to merchandise accounts: and at the end of the fiscal year. Nov. 30, '1906, the report was made ignoring liability for invoices amounting to $96,969.08, whereas the stock pur? chased with the $96,969.08 was set down as an asset, thus showing $214, 526.08 of profit, whereas a liability of $96.969.08 was ignored, which would reduce it to only about $117,557.23 profits, e Litigation. . Tho first obligation that arose was the claim by the United States gov? ernment that the county dispensaries had been selling beer in wholesale quantities, and they' assessed $4,525. 01 again>t the dispensary for license taxes during the assessable period md charged up $28,241.87 for taxes that were too old to be assessed. It >ecame noce?sary to pay the $4,525.01 ind?-r protest 10 avoid a seizure and this was done, and an appeal taken tJ the commissioner of internal revenue, vho, up to this time, has made no leclsion on the matter. The $28, .'41.87 of the liability can only be col? lected by Ipvtltutlr g suit by the United ?date* government against the State. \nd Up to this time they have not in? stituted fuch *ult. but It shruld he remembered that It is a possible 11a dllty. The next litigation to arise was a ult of Garrett & Co. against the 'ommlsston ss Individuals instituted in the city of Norfolk, whore one' member of the commission was serv ti, for $10,000 damages on account of the fact that a large amount of vines, amounting to, about $5,000, had been returned on two grounds. The next litigation was a proceed? ing Instituted In che United States circuit court for mandamus to re lulre the commission to pay the claim of Garrett & Co. This was heard be? fore Judge Prltchard in Richmond. Vs., on the 19th and 20th of Novem? ber, and the mandamus wr?s refucsd. bet the court retained the bill to look into the question of Its Jurisdiction %o 3refit some equitable relief In the premises and has made no decision on i he matter as yet. Wilson Distilling Co. entered suit against the commission in a case in? stituted on the 80th day of December, 1907, In which they allege that the commission is about to discriminate igulnst the plaintiff In the payment of claims and asks the court to take chargo cf the funds and the establish? ment of claims. This case Is In the hands of our attorney also and la t"? be heard on the lllh day ot January, 1908, at Asheville, N. C, on the mo? tion for a permanent injunction. There are numerous coumy dispen? ser)' bonds which appear to be liable for balances, most of which aro dia puled. These matters would have beep taken up much sooner but the audit company's report was necessary as 'a prerequisite to proceeding and It has be* n in the hands of the commission only about 40 days, and the meagre information to ho got from the slip? shod method of k?ening accounts and settling with dlsponscia aa developed by the examination of tho books ren? dered It doubtful In the Judgment of the commission whether it would be judicious to Institute legal proceed? ings on these bonds or not. The A?*?cts. The assets, as appears by our books and statements, are as follows: Cash on hand $*S4.903.4?. amounts receiv? able $116.574.36. real estate $56,973. 1 And the liabilities are as follows: .Cash due cTOditfttl 0* the adjusted balances suhieet t-? be scaled for over? charges 3612.908.66. The commission calls to the atten? tion ef the governor and the legisla? ture the fact that a number of coun? ties oW< the mon ^y expended in en? forcing the law under the Brie? act The counties; except Darlington, have not ( < ich ted their tax and have not levied It. In fact, and it Is for the leg? islature to determine what shall now hr done as the i*Jaa aliasing has not the power to require the levying and collecting or u tax. The counties of No wherry and Pictosna levied and got* lect? d tlu lr tax ggg paid the sums du? by them promptly wh? n called ujen. tin othoi c nintlei have not re ? ponded, except the county of Dar? llngton, whieh ha* paid $60.X9. Qvvtxdiafgjca, The board has evidence of gros-s ov? en barges In the pun hase ?f liquor* and supplies and that these over? charge* have been admitted by repre* sentativv of many of the house.| which rendered ?t necessary to go over each account with th<. books of the creditors and ascertain the priOS which they charged othef people for the same goods. The work has been begun and the date has been set for try ing such cases, and will proceed at such date to hoar the testimony of each claimant along that line as well as such ochcr evidence as Is at hand. Helping Mr. Lyon. There was undoubtedly strong grounds to suspect very great de? linquencies In the former manage? ment of the State dispensary by its high officials. The commission con? ceived it its duty to give all the assist? ance possible to the attorney gonere.l in discovering und bringing before the proper forum any party or parties guilty of misdeeds, and it has, as a result, incurred considerable expense, the result of wjiieh will no doubt ap? pear at the proper time and place: the said expense being charged ir. the expense of administration, and be? ing covered by the broad power given to investigate in the act creating the comimsslort. There are a few suits which have gone to judgment against officials of the State dispensary, State consta? bles and oth'T otficilas, there being one for about $100 against O. W. Ta tum, State dispensary commissioner, and U. B. Hammett, chief constable. The commission has been advised and holds that the judgments are not charged against the State dispensary but are merely Judgments against these officials in their individual ca? pacity, and that it Is not a liability which this commission is authorized to pay. In the case above referred to against Tatum and Hammett, the Stato received the goods and sob! tho same and it would appear that it should make good the judgment foi the recovery of ehe same, but as i matter for the committee on claiim of the legislature, as this commission ias no further power than to direc ittention to the same. City Using Property. The attention of the legislature i hereby called to the fact that the cit of Columbia is occupying a .ctrip c real estate of the State for a sidewalk The measurement will probably sho. 12 feet to 15 feet of the lot on whir the State dispensary is located, cov red and occupied by the sidewalk > lervais street and this should hav? ittention before this occupatioi ripens Into a right. As to the rea estate, we are holding it intact, suo jeet to the x legislature. The bes thing, we think, to be done with 11 would be to sell the property and tun: the proceeds into the hands ?f the State treasurer. The reason wo re? commend this is that real estate now seems to be at Its height and we feel that the price obtained from it wouU. >e as much aa they could ever get foi It and would save an expense of lnr uranee and salary of watchman, day and night, as it is Insured in the sinking fund, and this is one of the requirements of the sinking fund commission. All the buildings will deteriorate rapidly if not occupied and the expense of maintenance will be heavy. As will be seen by this report, it will be necessary for the commission to continue in session for probably six months, but this is left ta the dis? cretion of the legislature. W. J. Murray, Chairman. The report on debts of county dis? pensary boards shows a total of $104, 621.43, of which nearly half is hue from Richland, the board hero secur? ing some very valuable stock at a bargain. The total maount due from 11 of the counties voting out the dispensary is $22,880.89, Lancaster having a credit of $64.07 and Cherokee $11.27. The receipts from the State treas? urer were $129,216.07 and the amount received from sales and collections $639.302.44, making a total of $768, 520.51. The disbursements up to the time the commission took charge amounted to $25,127.36 and the comm'ssion ex? pended $59,389.66, leaving a cash bal nr.ee of $684,003.49. *Bees Laxative Cough Syrup for ?coughs, colds, croup and whooping cough grows in favor daily. Washington, Jan. 7.?Severe de? nunciation was heaped upon President Roosevelt in the house of representa? tives today by Mr. Wlllett, of New York. In the course of some remarks on the financial question he charged the president with not being a sensi? ble man and with having characteriz? ed the heads of great industrial insti? tutions as dishonest, thereby bringing on a condition of lack of confidence among the people and ultimately a panic. The trouble with the president, he said, had been that he had not been turning on the light, but turning on the gas. "We have had too much talk from him," he said. "The president had gone forth day after day to the Amer? ican people and the people of the world and declared to them that the / man who holds the reins of our gret.t industrial institutions are dishonest, ire not worthy of our confidence and trust. We want cheer " he said; "we U> not want our chief executive going lip and down this country condemning md striking with the hip stick every - hing lhat sticks up it1 head." What was wanted, he laid, was a lan to perform his duties with digni y and with power and with the m luence of all sane men behind him. "It has been said our president is dneere," he continued. "He may >c so, but we want good sens*} in the I resident along with his sincerity." He declared that President Roose elt was not a sensible man, and con luded: "It Is because of what I charge him ?ith, with all the powers of my mind nd body as my profound conviction tnd because of his lack of sense and ick of due aprpeelattcn of the true onditlon of our nation, that wo have hlr< panic today."
