There were clouds of witnesses, conversations, letters and records glib and pat to tho oc casion. In brief, there was nothing wanted but the seal of his excellency'. Tho only copy of that was in the possession of a rival school of ronaissant art and the restoration of antiques, then doing business ljofore the land commission. % And yet the claim was rejected! Having lately i worn mended two separate claimant* to a patent for tho same land the land com mission became cautious and conservative. Roscommon was cit first astounded, then indignant, and then warlike—he was for an “appale to onst!” With the reader’s previous knowledge ot Roscommon’s disposition this may seem some what inconsistent, but there are certain natures to whom litigation has all the exeite- in-nt of gambling, and it should fee home in mind that this was his first lawsuit. So that his lawyer, Mr. Saponaceous Wood, found him in that belligerent mood to which coun sel ore obliged to hypocritically bring all the sophi tries of their profession. “Of course yon have your right toon appeal, but calm your self, my dear sir, and consider. But even thin did not satisfy her until she had made some alterations, and when she finally brought her finished study to Don Royal, she looked at him a little defiantly. But there still stands ou record a letter by this young gentleman, arraigning tho legal wisdom of the land, which is not en tirely devoid of amusement or even instruc tion to young men desirous of obtaining pub licity and capital. Howbeit, tho supreme court was obliged to protect itself by procur ing the legislation of his functions out of its local fingers into the larger palm of its own attorney. These various processes of law and equity, which, when exercised ipractically in the af fairs of ordinary business, might have occu pied a few months’ time, dragged, clung, re trograded, or advanced slowly during a period of eight or nine years. But the strong anns of Biggs and Thatcher held possession, and possibly, by the same tactics employed on the other sido, arrested or delayed eject ment, and so mode and sold quicksilver, while their opponents were spending gold, until- Biggs, sorely hit in the interlacing of his ar mor, fell In the lists, his clieek growing What is this, little one? More of this wo would know, O Car men—smallest of brunettes—speak, little one, even in thine own melodious speech, that I may commend thee and thy rare discretion to my own fair country women. Alas, neither the present chronicler nor Mistress Plodgitt got any further informa- tioiHi om the prudent Carmen, and must fain speculate upon < or tain facts that were already known. Mistress Carmen’s little room was opposite to Thatcher’s, and once or twice, the doors lieing open, Thatcher hod a glimpse across the passage of a black-haired and a sturdy, boy- waxen and his strong arm feeble, anil finding j little figure in a great bluo apron, perched himself in this sore condition, and passing, ns it were, made over his bharo in trust to his comrade ami died. Whereat, from that time henceforward, Royal Thatcher reignod in bis stead. Anil so, having anticipated the legal record, we will go Imck to the various human in terests that helped to make it up. To begin with Roscommon: To justice to his later conduct and on a stool l»efore an easel, and on the other hand, Carmen had often been conscious of the fumes of a tobacco pipe penetrating her cloistered seclusion, and had seen across the passage, vaguely enveloped in the same nico tine cloud, an American Olympian, in a rocking chair, with his feet on tho mantel j shelf. They had once or twice met on tho do i staircase, oil which occasion Thatcher Lad ex- i greeted her with u word or two of respectful pression, it must bo remembered that I yet half humorous courtesy—a courtesy when he accepted the claim for the i which never really offends a true woman, “Red Rock rancho,” }'ot unquestioned, from ; although it ofteiv piques her self-aplomb by tho hands of Garcia, ho was careless, or at j the slight assumption of superiority in the least unsuspicious of fraud. It was not until | humorist. A woman is quick to recognize ho had experienced the intoxication of litiga tion that ho felt, somehow, that he was a wronged and defrauded man, hut with tho obstinacy of defrauded mon, preferred to ar raign some one fact or individual as tho im pelling cause of his wrong, rather than the various circumstances that led to it. To this simple mind it was mode patent that the “Blue Mass Company” wore making money out of a mine which he claimed, and which was not yet adjudged to thorn. Every dollar they took out was a fresh count in this gen eral indictment. Every delay towards this adjustment of rights—although made by his own lawyer—was a personal wrong. The ftieitj fact that there never was m r had been miy quid pro quo for this immense property— that it had fallen to him for a mere song- only added zest to his struggle. The possibility of his losing this mere speculation affected him more strongly than if ho had already paid down tho million he expected to get from tho mine. I don't know that I have indicated as plainly os I might that universal prefer ence on tho port of mankind to get something from nothing, and to acquire the largest re. turn for the least possible expenditure, but I question my right to say that Roscommon was much more reprehensible than his fel-1 lows. But it told upon him as it did upon all over whom the spirit of the mur dered Concho brooded—upon all whom avarice alternately flattered and tortured. From his quiet gains in his legitimate business, from the little capital accumu lated through industry and economy, he lav ished thousands on this chimera of his fancy. He grew grizzled and worn over his self-im posed delusion; ho no longer jested with his customers, regardless of quality or station or importance; ho had cliques to mollify, enemies to placate, friends to reword. The grocery suffered; through giving food and lodgment to eloudsof unimpeachable witnesses before the kind commission and the district court, '‘Mrs, our profession- technical though they may found herself losing money. Tbr keen gray eyes of the claimant of the “Bed Rock Rancho" wore at ways on the lookout for friend or enemy, inborn talent for historic misrepresentation unpleasantly through a de fective memory: a year or two after he the fact that tho gi*eat and more dangerous passions are always serious, and may be ex cused if in self-respect she is often induced to try if there be not somewhere under the skin of this laughing Mcrcutio the flesh and blood of a Romeo. Thatcher was hp na ture a defender and protector; weak ness, and weakness alone, stirred the depths of bis tenderness—often, I fear, only through its half-humorous aspects—and on this plane he was pleased to place w omen and children. I mention this fact for the tenefit of the more youthful members of my species, and am satisfied that an unconditional 'sur render and the complete laying down at the foot of beauty of all strong masculinity is a cheap Gallicism that is untranslatable to most women worthy tho winning. For a woman must always look up to the man she truly loves—even if she has to go down on her knees to do it. Only tho masculine reader w ill infer from thia that Cannen wos in love with Thatcher; tho more critical and analytical feminine eye will see nothing herein that might not have happened consistently with friendship. For Thatcher was no sentimentalist; he had hardly paid a compliment to the girl—even in the unspoken but most delicate form of attention. There were days when his room door was closed; there were days days succeeding these blanks when he met her as frankly and naturally as if he had seen her yesterday. Indeed, on those days following his flight the simple-minded Carmen, being aware—heaven knows how—that hp had not opened his door during that period, and fearing sickness, sud den death, or perhaps suicide, by her appeals to tba landlady, assisted unwittingly in dis covering his flight and defection. As she was for a few moments os indignant os Mrs. Plodgitt, it is evident that she ted but little sympathy with the delinquent. And be- sides, hitherto she had* known only Concho, her earliest friend, and was true to his memory, as agonist all Americanos, whom she firmly believed to be his murderers 8a she dismissed the offer and the man from her mind, and went back to her pointing—a fancy portrait of eke good Padre Junipero Serra, a groat missionary, who, happily for the integrity of hj^* banes and character, died some hundred years before the Americans took possession of California. The picture was fair but unsalable, and she began to think seriously of sign painting, which was then much more popular and marketable. But she was mistaken; in tho evening he? renewed tho conversation. But that night poor Carmen cried herself to sleep, re solving that she would hereafter cast aside her wicked undo for this good-hearted Americano, yet nevor one© connected her in nocent penmanship with the deadly feud be tween them. Women—the best of them—are strong as to collateral facts, swift of deduc tion, but vague as children are to the exact statement or recognition of premises. It is hardly necessary to say that Carmen had never thought of connecting any act oi here with the claims of her uncle, and tho circum stance of the signature she had totally for gotten. The masculine reader will nour understand Carmen’s confusion and blushes, and believe himself an ass to have thought them a Con fession of original affection. Tho feminine reader will, by this time, become satisfied that the deceitful minx’s solo idea was to gain tlie affections of Thatcher. And really I don’t know who is right. Nevertheless, she painted a sketch for Thntchor—which now adorns tho company’s office in San Francisco, in which the property | is laid out in pleasing geometrical lines, and ; the rosy promise of tho future iiistiuct in ! every touch of th© brash. Then, having : earned her “wage,” as sho behoved, she be-; came somewhat cold and shy to Thatcher. Whereat that gentleman redoubled his atten-! tions, scefhg only in her presence a certain 1 meprise, which concerned her more than him self. The niece of his enemy meant nothing more to him than an interesting girl—to te protected always—to te feared, Dover. But even suspicion may be insidiously placed iu noble minds. Mistress Plodgitt, thus early estopped of matchmaking, of course put the blame on her | ' own sex, and went over to tho stronger sido— tho man’s. “It's a great pity gals should te so curious;” | she said, sotto vocc, to Thatcher, when Car-1 men was in one of her sullen moods. “Yet I s'pose it’s in her blood. Forgetting their relations of host and guest, she was al**>- lutely rude.
