Spurtanhurg, Nov. 21. -Four ol i< >god moinhors of tho mob who on! the night of August 18th last dyna mited the Spartanburg county jail in an effort to lynch Will Fali\ a no- , gro accused of assaulting a white wo ran not guilty, will he prosecutod. The grand Jury urged Solicitor Albert K. mil to institute criminal proceed ing against tile nu n and BUOh other ; members of the lynching mob as may I be apprehended. The accused mom liOI'H are W. lt. ?olOhOI', .less.' Wolfe. Kotiert Wilson ami Itohorl Ward, and Ho grand jury presents them in tho following languago: ?'Alter careful Investigation into the assault on tho Jail on tho night of August 18, 1913, wo find tliat cer tain parlies, utterly disregarded the lives of the Olilcors and the county] property, did make an assault on the j |all, witli the intent of taking the life of Will Fair. Wo present to the courl W. It. Uolchor, Jesse Wolfe, Hob Wilson and Robert Ward and ask our solicitor to prosecute them." Solicitor Hill wasted no time after the presentment was issued. At his request Judge DeVoro Issued bench warrants for the arrest of the four men. The Krand Jury's action, which is without precedent in this County, came like a thunderbolt from a clear sky. The excitement attending the arrest of Fair, the attempted lynch ing, the trial and the negro's acquit tal had long since died down and *.ho whole affair was regarded as a clos ed incident. There has been some talk a month or two ngo of a grand jury Investigation of the near-lynch ing hut after that body in its report at the duly term of court merely thanked Sheriff W. .1. White lor up holding tile majesty of tho law by hold ing tho mob at bay. it was supposed thai nothing more would be done. In the meanwhile, however, detectives have I.n at work, it is reported, and they ilid not conclude their investi gation until recently. W. (1. Query, foreman of the grand jury, declined today, however, to divulge the method of procedure adopted in the search for the identity of the members of the mob. He explained that to make this public might interfere with the appre hension of other members of the mob whose names are yet unknown. It was announced that further developments were expected and as the necessary evidence is secured by tho grand jury additional men will be presented. Nothing certain had been learned up to late Thursday as to the vo cations and residences of the four accused IUQ.U, but Winrd Is thought to be an employe of the telephone, com pany and one or more of the others are said to be mill workers. The grand jury's move startled Spartanhurg and has given delight to opponents of lynching. The negro Fair, it will be remem bered, was accused by a young wo man of near While Stone, the wife of a farmer, of having assaulted her in her home in the absence of all other members of her family. : Though she persisted in her story when Fall" was brought to trial, the preponderance of the evidence was that it was an hallucination on her part. Physicians who examined her testilled that they could find no evi dence thai she had been assaulted, and many negro witnesses testilled that while Fail' passed the woman's house he did not enter. Nevertheless Fair's acquittal in the face of the young woman's unequivocal accusation was regarded as epoch-making. After the unsuccessful attempt to lync h Fair he was carried to the state penitontlnry at Columbia Tor safe kocping and held there until a couple of days before his trial. tJIRI.S! UIKI.S!
