H. A.- M^ctze. chainnan, I. D. With erspoon, W. X. Taft, W. A. Waller, S. 8. Crittenden, M. W. Gary and L. J'. I'RtterSori. We find on phge 171 of the Senate Journal, Saturday/ December 14, the following r NfiW ADVERTISEMENTS. PERRY DAVIS’ t ‘Mr. Mcctze, from the Committee on the judiciary, reported back bill t» amend Section 6, Chanter LXII, of the General Statutes, approved February 22, 1873, In relation to licenre fees paid by insurance agents, asking leave to r# port that they have carefully considered the same and recoinmcud that the bill do not pass. “Respectfully submitted, “IIenkv A. Meetze, ^ Chairman. ‘•Ordered for cpnsidemtibn on Mon- dgfswt^ --—' - Senate Journal, JPuqc 201, Mutidqy, December 16. frenstfry,’’ where they lawfully bclouged ? 2d. Has Comptroller-General liagooil taken advaRiage of the construction of a former Kadtrrtl administration, and thereby absorbed foes to his own use on ‘‘Report (unfavorable) of committee account of the omission, neglect or oversight in the pr“miswr of the Demo eratic Legislature who have since held control ? 3d. Is the Comptroller-Gen eral lawfully and lairly entitled to these fees ? Wc would call the attention of our respected contemporary to the fact that he goes peihitpsu little farther than hie authority, Mr. Charles Moise, had pro posed to go in making the sweeping charge tliat Gen. Hagood had appro' priated fees to hia persona! use which belonged of right to the State Treasury. Mr. Moise derived the facte he has •tatod as to the amount of these fees so received by Gen. Hagood from the comptroller a personal account, and Mr. Motsc would thus be careful in imput ing as a fact what he had derived as an inference^ But he this as it may, we arc intent only on the facts. Let ftsaec what Urey are. la reply to the first question, wcTSiy that when Gen. Hagood came juto office ho found on tho Statute book the following Act, or rather amendment of an Act, which, previous to the amend ment, provided, io connection with these insurance licenses, for the pay ment “into the Treasury of the State the sum of five dollars, the sum to be appropriated for the use and benefit of the State." Now, the amendment- which General Hagood found as the law of the State was and is (see Statute* at Large, Vol. XY r , page 375. ) “That it shall not be lawful for any agent of any Insurance company, Ac., Ac., to transact business of insurance in this Stato without first obtaining a license from the ComptrollofrOcncral, and for every such license the company or agent taking the same shall pay to the Compv troller-Gcneral the sum of fire dollars." Accompanied by this plain and evi- pn the judrcmry ort MF to amend Sec tion 6, Chapter LX U, of the Genet at Statutes, approved February 22, 1873, in relation to lioeuse foes paid by hi- surahee' agents.' “On motion of Mr. Todd, the above report was adopted, iejecting the bill." Now, dors this look Tike an oversight or a construction surreptitiously taken os to the appropriation of the fees, or docs it look like a plain confirmation of the right, under the law, to thd fees and the intention yf the Senate that tlicy should be enjoyed as they had been by the comptroller-general? The parties intending to cut off these fees from the comptroller Introduced a bHTrestoring the exact language* of the original act os it had been amended, and the Senate re fused to pass the bill, meaning evidently to refuse to withhold these fees, as fought in the provisions of the bill pre sented for its adoption. S ytbing can be plainer on earth that the comptroller-general is and fairly entitled to theac fees, we ate at a loss to perceive it Now, wHl our son temporary, who “wants to sac Air play," publish thF reply ? The article of the Medium to which the Register replica is as follows r “la a letter to the Sumter True Southron, which we publish elsewhere, Mr. Cl>a»le* II, Moise chargee that General Hagood has turned all the in surance fees of his office which Imre come into his hands as the representa tive of the State into his own private purse and not into the public treasu ry. In this way it is charged that dur- sng hia four years’ service as comptrol ler be has received more than double the salary allowed him bv the 8tatc for hia official services. In the case of the other officers of the State government all foes have to be turned into the treasury although their sehtrics are no higher than the eomptrolfer’s and their duties just as laborious. Mr. Moiseis an inflnenti*! citizen of Sumter county, add w a candidate for Gen. Hagood’s dent dcpnrXnrr in the aLodment fooo> U ^ fi r n9 ™ 8 i8 not the first we have heard of the state- the previous commanding the payment “into the State Treasury for the use and benefit of the State," Comptroller- • General Hagood found the comptroller in receipt or these fees aa an undisputed legitimate purquuite. Was this a vici ous appropriation under a fraudulent construction of the amendment by the Republican Comptroller-General, or was it a legitimate constractiee sustained by the usage of other States ? It seems that the duties appropriate to these insurauce matters m most States are conducted by an insurance commissioner, who gets either a salary or the feos as his compensation. And in those Stales where the duties are at tached to the comptroller’s and auditor’s office the fees attached to the business are bestowed on the auditor or comp troller. In the case of California, where the fees are enormous, the insurance commissioner is pat on a salary and the feet go to the State Treasury. It would thus seem that the amend- mett r in changing the previous provisions touching the appropriation of these fees, had a legitimate purpose in view iu the change made m providing for the pay ment thereof to-the comptroller-general, and not as hitherto “to the use irad benefit of theState. J ’ - Now, in reply to the second question touching General Hagood’a taking ad- vantage of a false constroction of the Act by a previous official, and the over sight of Democratic legislators in the premises. This question is tiee^sear.ly answered to some extent in answering the first question; but there are material facts of record, which we will now set forth, which will not leave in any hon- eet mind not moved by present inter est or personal maignity the least room for cavil. The facts are these, if our recollec tion serves us rightly ; Mr, Blue, in the first seesioa ol the Democratic made a motion in the House providing for the rescinding of the ap propriation of these fees as made under the Act just cited. After considerable discussion the motion was abandoned. This is the recollection of the fact*. But vre tarn to the action of the Sen ale and find as follows: Extract Senate Journal 1878, Page 127, DecemberX\. « “Mr. Benbow asked and obtained the wnantmow consent of the Senate to ra- tithoat previous notice A meats contained in his letter, but they have never before be«D , published in any definite shape. Gen. Hagood cannot afford to let them go by nnnotiecd with out injury to himself. He is now a protninent candidate for Governor, and all auch charges, unless they are cx- ined, will only hare weight to drag im down. Wo want to set. fcir play, even though we cannot give him our support for the nomination.” 1 i m» --■» « - Fashionable Church Singing.—A Presbyterian minister recently delivered a lecture on ‘Congregational Psalmody,’ in which he referred to the incongrui ties thatoccur iu preoent division or repe tition Irues For instance : Love Thee better than before,’ was divided, ‘Lote Thee bet—;’ ‘We’ll catch the fleeting hour/ was sung, ‘We’ll catch the flee-—-;’ ‘My poor polluted heart,’ became ‘My poor pol—‘And take thy Pilgrim home/{‘And take thy pil—;’ ‘And in the pious He delights,’ became ‘And in the pi—/ and ‘Send down salvation from on high/ became ‘Send down Ral—-.’ A soprano in one case sang ‘Oh for a nun.’ and the chorus responded, ‘Oh, for a mansion in the skies.’ In waother case the soprano modestly sang, ‘Teach me to kiss,’ while the Lags rendered it quite prosaio by singing, •Teach tnc to kiss the rod.’ Imfortant to Real Estate Own krh.—In accordance with the Act de fining his duties, Col.
