Wc would call the attention of our
respected contemporary to the fact that
he goes peihitpsu little farther than hie
authority, Mr. Charles Moise, had pro
posed to go in making the sweeping
charge tliat Gen. Hagood had appro'
priated fees to hia persona! use which
belonged of right to the State Treasury.
Mr. Moise derived the facte he has
•tatod as to the amount of these fees so
received by Gen. Hagood from the
comptroller a personal account, and Mr.
Motsc would thus be careful in imput
ing as a fact what he had derived as an
inference^ But he this as it may, we
arc intent only on the facts. Let ftsaec

following Act, or rather amendment of
an Act, which, previous to the amend
ment, provided, io connection with
these insurance licenses, for the pay
ment “into the Treasury of the State
the sum of five dollars, the sum to be
appropriated for the use and benefit of
the State." Now, the amendment-
which General Hagood found as the
law of the State was and is (see Statute*
at Large, Vol. XY r , page 375. )
“That it shall not be lawful for any agent
of any Insurance company, Ac., Ac., to
transact business of insurance in this
Stato without first obtaining a license
from the ComptrollofrOcncral, and for
every such license the company or agent
taking the same shall pay to the Compv
troller-Gcneral the sum of fire dollars."

sented for its adoption.

the previous commanding the payment
“into the State Treasury for the use
and benefit of the State," Comptroller-
• General Hagood found the comptroller
in receipt or these fees aa an undisputed
legitimate purquuite. Was this a vici
ous appropriation under a fraudulent
construction of the amendment by the
Republican Comptroller-General, or was
it a legitimate constractiee sustained by
the usage of other States ?
It seems that the duties appropriate
to these insurauce matters m most
States are conducted by an insurance
commissioner, who gets either a salary
or the feos as his compensation. And in
those Stales where the duties are at
tached to the comptroller’s and auditor’s
office the fees attached to the business
are bestowed on the auditor or comp
troller. In the case of California, where
the fees are enormous, the insurance
commissioner is pat on a salary and the
feet go to the State Treasury.
It would thus seem that the amend-
mett r in changing the previous provisions
touching the appropriation of these fees,
had a legitimate purpose in view iu the
change made m providing for the pay
ment thereof to-the comptroller-general,
and not as hitherto “to the use irad
benefit of theState. J ’ -
Now, in reply to the second question
touching General Hagood’a taking ad-
vantage of a false constroction of the
Act by a previous official, and the over
sight of Democratic legislators in the
premises. This question is tiee^sear.ly
answered to some extent in answering
the first question; but there are material
facts of record, which we will now set
forth, which will not leave in any hon-
eet mind not moved by present inter
est or personal maignity the least room
for cavil.
The facts are these, if our recollec
tion serves us rightly ; Mr, Blue, in
the first seesioa ol the Democratic
made a motion in the House
providing for the rescinding of the ap
propriation of these fees as made under
the Act just cited. After considerable
discussion the motion was abandoned.
This is the recollection of the fact*.

ale and find as follows:
