Editor News-Reporter: Having noticed a very peculiar, aud more especially such a very uncommon statement in your paper made by one of the jurors in the now famous Hayes trial, in which said juror undertakes to substantiate the verdict of the jury in fiuding {the defendants 'not guilt}'", I desire to say a few words in riply thereto, and very kindly ask that you give me space in the valued and valuable columns of your paper for so doing. Mr James, one of the jurors, seems to realize the fact that a great tumult is being made among the iutelligent public, which sentiment has been expressed broadly throngh the newspapers. We cannot recall in the history of our country where a juror, after rendering his verdict according to the law and evidence, afterwards ' - : A tin hi ir> undertake to explain lu tuu the reasons for his decision, but we 1 do find an instance recorded in Matt, xxvii: where ''Pilot saw that he could prevail nothing', but rather a ' tumult was made. He took water and washed his hands before the multitude saying, I am innocent of the blood of this just person; see ye to it". Hut instead of Mr James washing his hands in water he pre ferred irdinging the newspapers before the public. 1 agree with Judge Cooke when he said there was plenty of good jury material 111 Columbus county if properly sorted out. His Honor is a maD of profound intelligence and knew that out of two hundred .men that there were some few that could easily be bought, else he would not liavo added the additional clause "if properly sorted". There is no doubt that some of the best men of Columbus county were drawn on that jury, butjthaving honesty enough * '?- " 1*1 c\ rA when on fXIIDloatiou irilUKiy iiiauc j known their opinion as to the case and, of course, they were rejected. But when Mr James, who lived only i a short distance from the scene of ( the tragedy, and this being at least 1 a month afterwards, was called 1 frankly sa'd he know nothing of the 1 killing and had no cause whatever to | express his feelings in regard to the 1 Tabor tragedy, which was so universally known throughout the whole ( South. How could such an occurance have ever escaped the ears of 1 Mr James, who lives on an R F D., where papers pass daily? Mr James declared openly in the court room that he had not expressed an opiu ion in the Hayes case, and does no' the above alone qualify him as the juror he represents. It has been rumored that some members of the jury represented some ministers cfl the Unknown Tongue system that penetrated the dark corners of Columbus county, also that two of the jurymen were tenants for the Hon J B Shulkens. Mr James admits that every man on the jury were first class and had every evidence of perfect gentlemen The intelligent can decide this question. Mr James has stated in his article that he had never seen Neill or Rosa Hayes until they were brought into the court room, but since the ac quittal he must have become intimately associated with them, or else he could not have stated so forcibly that "they already have a supply of pistols, and it seems that they understand using them, too," In this expression the writer admits emphatically by the use of the pronoun "they" in the clause "they understand using them, too," that Neill, Rosa and Lloyd Hayes enterred into I Ml t-* , a conspiracy ana aia kiu uooert m Flo.vd. Mr James speaks philosophically when he says "God never made a better being than a good woman, neither was tbore a worse curso to a good moral man than a bad woman." According to the character certificate of Mr James ho is upright and a man of moral character surely |Mr James can sympathize with a man who has a bad woman. I do not see how any setof jury having the knowledge that an intelligent ju"y should have and professing to have the intelligence that Mr James claims that ho and the other jurors had in rendering a just verdict. as he claimed they did "according to the law and evidence" making known their decision before - - * - * ?- 4 A A. ? Judge LiooKe anu me court, anu tnen be simple enough to appear in the papers trying to clear certain facts, and bring certificates of endorsements by parts of the defendants' witnesses. And what is strickingly noticeable is chat Mr James' iastendorser is Mr J L Boyd, Esq , a man that has been dead for several years, now for Mr James to take the signature of a dead man to endorse his good moral character, its my opinion that be goes lacking for "standbyers." Mr James says "we jurors feel clear from blxrre" and if they have done their dutv just and right I trust no blame will rest on them. But I am glad to state that Mrs Hayes, when at the judgment bar, will not have a jury of this kind to " ?? ???? render . r a verdict; \>ut a just God who d'. j all things v/ell. Mr James -also states that the prisoners go free and rejoice. They may feel that they a<re out of prison, but coi-ld they fe?I /good and rejoice, and thai this b'ack deed that they have committed ha.-* been washed Ifoui choir hands, where their own home towns, Tabor, N. C., and Loris, S. C., have forbidden them ever making a location there again? Now teey will have to search for an abiding place elsewhere. Certainly the Hayes jury have heard of the steps ftiot hauo hppn taken bv the food. honest and intelligent citizens of these two striving towns. Surely they must see how sentiment stands as to the guilt of the parties acquitted. Mr James states he once fived in Horry countv. I am confident should he never make another location in South Carolina that the public at large will feel honored by his absence. W. K. Brown.
