He told a straight story of the affair, about as follows: With several others was at a party given at Mrs Ellen Thomas's on Saturday night Jan. 28. h, 1911, naving some music and singing, and three Nance boys, Willie, Lee and Winn, and one Holden boy came in and acted as if they were drunk. \\\ the nartv in the house excepting these boys left the room and went on the back porch. One Nance boy struck the window and Lizzie Thomas said: "Now you break that window," and Lee Nance said: 4,I will pay for it," if it is not over three dollars," and then the three Nance boys went out on the back porch where the party that had left the room had gathered and asked the tfirls who put thern up to say what they had. Then Nance turned ! him loose and ran behind the kitchen and fell. Mr D K Rotter being Mrs Thomas son-in-law is the reason she asked him to restore quiet. The Solicitor tried hard to break down the testimony of this witness, but he did not succeed. Miss Minnie Thomas, a daughter of Mrs Ellen Thomas was swofn and testified in efTect as follows: Stated that on Saturday night Jan 22th herself Mr Rice, Lizzie and Mr Verecn were standing up singing and playing, and Victor Bessent was sitting off helping them sing. Four drunk men, Willie, Lee and Winn Nance, and one Holden boy came in and said they had come there to do and say what they pleased. UllUUlWl-l VI1VA1 UUVV/ V?UJ U went out where they were, and began cursiug and was asked by Mr D K Potter not to do so as this was a widow lady's hou^e, and she hadn't been well long, and they said they had come out there to do and say what they pleased, and began cursing aud the mother came out and asked the girls to come in, and witness said ''My Lord, what will we do"? and she run into the house and about that time the shooting occurred. She told the boys when they first came in that they were not invited there and ih3y had better go on back. J T Ward calicd for the defense testified that the Nance boys passed his place on their way out to Mrs Thomas' and were drinking ans using bad language, He was a good witness, and took the cross questions of the solicitor ail in good humor, Victor Cox swore that he saw these boys at Little River the same night before the killing, and that they were drinking, lie saw them fighting a negro in the store of Mr B N Gore the same night before they went out to Mrs Thomas'. Rev Bryant was called to testify that at the request of others he went out to Mrs Thomas'to help quell the trouble which it was said was going on there He was in a party consisting of several citizens of Little River, The State undertook to try to show that Nance was shot in the back of the arm the first time, and that he wheeled round and was shot the second time through the heart. The defense produced severel witnesses showing that the bullet wound in the arm of the dead man was in the front part of the upper arm near the lower end of the large muscle, /entering in front and breaking the | bone in the arm. The case was taken up in the late afternoon on Tuesday and was concluded in the forenoon on Wednesday. The defendant was represented by H 11 Woodward, and the State by the solicitor, Hon Walter H Wells. Miss Daisy Stephens and her brother, Leland visited in the Lake Swamp section Saturday and Sunday H. Gerrald and son, Sam White, Jo Hard wick, Smith Hard wick, John Floyd, Noah Edwards and Albert Sarvis were all pleasant callers at Charley W. Johnson's on Saturday the 25th inst.
