Hatcher for marrying a white woman, as it was alleged, and against the Kor. M. P. Curroll, the minister who was charged with marrying the couple, wero made up ami the prosecution withdrawn for vCbe ^lime being. When this was dftne many of the people who had been acquainted with the case, and know both partios, expressed themselves as pleased with the out-come, because they wero unable to see any good end the prosecution could subserve if pushed. ?Just before the Judge and officers left here last Saturday, a telephone messago was recoived asking tho Judgo to call off the term of court at Marion on account of tho prevalence of small pox at that place. It was stated in the message that the disease had broken out in the jail and was otherwise at large in the town so that it would be dangerous to the public health to have tho court. The Judge signed an order calling off tho term of pourt. -^Saturday March 11th has been fixed for the preliminary hearing in tho matter of the violation of tho dispensary law in Green Sea township near Loris and Mt. Tabor. Many defendants arc involved, and some of them are women. It is charged that there is a still in- operation in that section of tho couuty, but the officers have so far been un- ? able to locate it. Both sides are 1 represented by attorneys. l New Business te Becln. The Hal L. Buck Company has eciOed to open in Conway a new epartment in their already large usiness on the corner opposite the ourt house, and it is for this purose that the new store is going up ext door to the present large uilding. Thoy will open in the new uilding, just as soon as it is competed, a full lino of furniture and ousc furnishing goods, so that when ne builds a house he can go to heir store and buy everything that ie needs to furnish it from tin- bodteads, bureaus and wash stands >eds and bed clothing, down l% the , viudow screens, matting carpeting [inner set, table cloth and doilies, t is to bo a house furnishing store n the full sense of the term. After a successful term of live nonths our school quietly closed last 'riday. Miss Efhe Vauglit gave entire satsfaction in every respect. Floyd, who assisted Miss /aught with the program called the louse to order ubout 7 o'clock, and hen the speeches and recitations :atne in order, and were very uinusng to the spectators, and made the )aronts feel proud. The first piece on the program iras "The Efforts of Children," by Dsby Cartretto. Followed by Josiuh and Btnnio Allen, aad Ivy Kujon. "On Counting the Chickens be ore thoy were llatohed." Then a lialogue entitled "The Peaces Maker" jy six bovs, followed by Ernest and Bonnie Baker and Eddie Allen, 'Hold on for the liight " Next on the poogram was "Trap pod. "a comedy bv Knoch Baker, Misses Ruth and Leila Baker and Miss Blanche Vaught. Other pieces were spoken by Enoch Allen, Nor ton Baker and Mrs. Emma Baker, md Berry and Zay Allen, who actad their parts well. After the exercises were over, Messrs. Cyrus Dorsey, T. J. Vaught md R. M. Floyd made interesting jpecehes. The closing address was made by Prof. J. II. Ncely, principal of the Rehoboth school. Mr. Neel.v is one ){ our most prominent young men, i worthy citizen and a fine speaker Messrs. Troy Floyd and Wheeler Vaught made fine.music which was liueh enjoyed by all present. IN MEMOKIaM. Dr. Arehibold Hector James Caliruith. He was horn in the state of Vir ginia, April 5th. 1838, and was 'ear d in Robinson county, N. 0. 11 lied at the residence of Mr. W S McCuskill, Jr., of Conway, S. C . where he lived after the death of his beloved wife. lie was married three limes, lirst marrying Miss Addie Woodward, second Miss Mary Katharine Melson, February 3rd 1880 and third Miss Carrie Brewer, November 188(5. 11c was a faithful soldier during the. war with the states and received x wound in one eye which caused the loss of its sight in his last days. He graduated in medicine with honors at the Edinboro Medical College institute June 16th 18(57 and took a Post Graduate course in the same institute in 1872 receiving his second diploma October 11th. These diplomas were found stored away in a tru nk. Ho then moved to Conway, S. C , and devoted his life to his profession until his death. He was electedcoronor of Horry county S. C., several conservative terms and was the incumbent at his death. Ho was a Mason of high standing and also one af the charter members of the Knights af Honor at Conway. Ho was a Faithful physician and a tender nurse winning the confidence and love of all. He was an Elder in the Kingston Presbyterian church and a 3hristian gentleman in the fullest sense, always putting the most lib aral construction possible on the words and acts of others. He always lid the right and gave others credit for trying to do no less He was a kind, tender husband and father. He ( left one daughter, (Miss Kate) and a lost of friends to mourn his loss, but their lass is his eternal gain, for ill believe he has gone to receive his sternal reward and crown of life that fadeth not away, C. It is a pity that the Lcgisla lure failed to pass the act to compel pooplo to send their children to t school The only privilege a poor v man has is the freo school. The jury to try the case were secured as follows: H. H. HulTkin, Foreman W. F. Ilolt. J J c l)ix, .1. H. Price, I) H. Bellamy, G W. Harris. W. J. Dorsev, J. H. Hughes, J, M Coojxt, Jas M. Dus- v enburv, J L Currie and Ed. Doyle. The State swore the following witnesses: I. A. Hell, Mrs. Lizzie Smith, 0 Miss Itosella Hell. W C Burnett, O. M. Watts, It M. Prince. A. J. El- u liott, W. (j Burnett were swot n as eye wit c nesses. The attorneys of the defen lants then swore the defendants one by % one and the Itev. .T. Davis Harrelson, E. B. Jenkins and Luke Elliott The State then called a few of their wit- \ nesses in reply, and the evidence r was announced closed. The Solicitor made the opening argument at about four o'clock on ' Thursday afternoon and was follow ' ed by H. II. Woodward Esq, and at the close of his address, the hour had arrived to adjourn for the da v. . On Friday morning the Hon K I J. Scarborough addressed the jury in behalf of the defendants and was ( followed by Solicitor Johnson in a } long argument for the prosecution. The court house was crowded to its utmost capacity during the whole ( time that the trial proceeded, and < many people who were very anxious to hear the case were turned away , from the court house door for lacs j of room. At the conclusion of the Solicitor's argument his Honor charged the s jurv and they retired to consider the \ ease at about 1 o'clock and returned J with their verdict at about the hour of six o'clock. W. T. Bell and C. C. Hell were found jjuilty of man- * slaughter and the rest of the de v fondants wer? found not guilty. On ' tin; following morning defendants' attorneys made a mot ion for a new trial, which was refused. W. T ( Bell eleven years and Geo. 0 Bclilt live years was the sentence of the court. Car- t roll arising out of the same matter as settled in the same way 1 The charge of murder against j j Charles Livingstone was tried on (, Friday afternoon and the State fail ine to make out a case against the defendant, the jud^e directed the jurv to write a verdict of not iruiltv 1 at the request of the Solicitor ' Young Livingstone was charged 1 with the killing of .lames Causey ' near Pine Island last January ^ Causey had attempted to take the ' life of Livingston, after following ^ hiin up and making threats, and was (]striking at the defendant with a ^ knife when Livingstone, shot, him in 'he arm. the load of shot taking ef s feet in i he fleshy part of the upper ' arm near the shoulder Causey lin-1 ( erred for some time and finally died, '' but according to the testimony of a physician who examined his body after death, the immediate cause of hisdrakhawas pneumonia The circumstances of the difficulty were all )' brouirht out at the cot ouor's inquost 11 and the jury exonerated Livingstone j* from blame. The evidence, at the trial clearly showed that the de- ^ fendant acted in self defense and I that it was doubtful that the wound n caused the man's death. ? The case of the State vs' Dave Bryant for vioiaotion of the dispensary law was continued ut the request of the Solicitor. y A bench warrant was issued for Willie Strickland against whom a sealed sentence was lodged at the last term of the court. b The greater part of the time on C Saturday morning was taken up C with equity matters and of course all jury cases on the civil side of the court had to be continued for lack of time.
