To these* chang es Arnett made return through ins attorney Jas E. Peurifoy, Esq. After hearing his affidavit. Judge OeVore, dismissed the case against him. The following remarks were ad- dressen to Arnett by Judge DeVore: “This a place here where no un derhanded tricks should be allowed and it is very wrong for you to charge a man to get him a position and it would have been very wrong for you to do it if deputy sheriff. It is wrong to so use your influence. This is a form of graft and yoi.r love of money is prooablv the cause of your having gone wrong. This is the way graft is started, and I warn you against allowing the occurrence again. If you had been deputy sheriff it would have gone hard with you and you would probably have have had to, serve a term in the penitentiary. I would urge you and everyone to avoid this in the future. This is a place where every thing must go straight. I am in- clined to dismiss Ihe case on the testimony you present, and an order will be prepared accordingly.” RETURN OF G. S. ARNETT. To the Hon J W DeVore, presid ing judge: The undersigned, underetanding that a rule was issued against him by his Honor Judge Geo. E. Prince at the last term of this court, and while the same was not served on deponent, deponent nevertheless begs leave to make return to said rule and affidavits, (a copy of the affidavits having been seen by de ponent) as follows: First. Deponent denies that he was a deputy-sheriff of the county at the time mentioned in said affida vit, that he has not held the office of deputy sheriff for about six or eight years prior thereto. Second. Deponent denies that he appointed the said J M Avant. Paul Herndon, and A E Hill bailiffs at said court and had nothing to do with their appointment except to recommend them to the sheriff and to carry a message from sheriff L G Ownes, to J M Avant requesting him to serve. Third. Deponent further denies that he corruptly exacted money from said bailiffs, but alleges that said bailiffs agreed to give thi« de ponent fifty cents per day if de ponent ooul4 succeed in getting the sheriff to keep them on as bailiffs during the entire term of court; that deponent did not intend to vio late any law of this atate, either civil or criminal, and as soon as he learned that it was not right for him to accept the said money, he im mediately returned it to the parties. Fourth. That deponent was not conscious of having done anything wrong nor did he intend to do ary- thinif in contempt of the person, dignity, or authority of the court. Fifth.
