The jury gave Gideon a verdict for 115,MM. a motion was made before Justice Pryor of the New York Hupreme Court for a new trial on the side ground that Dwyer had 1 received bad advice from his lawyer. On the motion Dwyer alleged for the first time that he had not s|H>ken the alleged slanderous word*, which were that Gideon was no s|»ort*t|isn and bad been ruled off the track in Nashville. Two men present at the quarrel made affidavit that Dwyer did not use the words imputed to him. Originally Dwyer demurred to the complaint, alleging that the words were not IH>cUotia, and when the derision ws* made against him he ap- inraled to the General Term which af firmed the lower court. In each per mission to answer was given. He did not answer hot went up to tbe Court of Appeals, which threw out. the cas« fur want of jurisdiction.
