That the fallowing special license taxes are hereby imposed for the privilege of car rying on the business, trade, pro fession, or doing tbs acts named or described herein, within the corporate limits of the City of Clinton, South Carolina, from the 1st day of January, 1905, to the 31st diy of December, 1905, in clusive, and annually thereafter until repealed or amended, and that the same shall be due and payable oa or before the 1st day of March, 1905, and each thereafter, unless otherwise in provided, ^ except in where a person, firm, company, or corporation shall inaugurate and start a new business or enter prise, whereupon the license tax for the same shall be due and payable on the day such business is begun. New businesses which shall ap ply for license on or after Janu ary 1st shall pay the minimum fee as stated in the ordinance for its classification at the time of acquiring the license and at the end of the calendar year the total license payment based on the ac tual business done shaU be due and payable with credit allowed for that amount which has pre viously been paid. The license tax for the second yehr shall be cal culated on the basis of business done in the first calendar year multiplied by the number of months necessary to give busi ness doirc in twelve months. The amount of the said special license tax shall be the amount placed opposite each business, trade, profession, or act herein- below named, respectively, and the amount shall be the cost of said special license tax per an num unless otherwise specified, to wit: ADVERTISING— Advertising by motor ve hicle or otherwise on the streets, Including distri bution of handbills, cir culars or other advertis ing matter, or bill post ing, whose gross annual income is $3,000 or less $ 95.00 For each additional $1,000 of gross income Provided, the provisions hereof shall not apply to any person, firm or cor poration maintaining a regular place of boMnsss in the City of Clinton when such advertising is restricted to the ad vertising of said busi ness by the person hav ing the license to oper ate said hwainess. Each insurance com pany issuing any policy or policies covering any property or risks, locat ed in the City of Clinton shall file with the City Clerk on or before Feb ruary 15th of each year a statement under oath showing all premiums collected on insurance policies issued during the preceding year by said company and cover ing any property or risks located in the City. Such statement, howev er, is not to include any premiums reported and shown upon the sworn statement or its agent, but all others. It is hereby declared that it shall be conclu sively presumed that the premiums charged for the issuance of any pol icy covering any prop erty, real or personal, ^ or risk within the City, were collected within the City. Where two or more kinds of business are con ducted in the same place, it shall be the duty of the licensee to keep an accurate account of the affMrs of each kind of business and to separate satisfactorily the affairs of each so that the proper amount of tax imposed and pay able on each type of business may be readily ascertained, oth erwise the maximum rate ap plicable to any type of business being operated shall apply to the whole. Section 2. That all licenses is sued under and by virtue of this ordinance shall be non-transfer- able and except for a license for a day, week, or month, shall ter minate and end on the 31st day of December, 1965, but may be re voked at any time by the City Council of the City of Clinton on satisfactory cause being shown; and except licenses issued for a day, a week, or a month, annual rate shall be charged for all li censes issued prior to June 1, 19*. three-fourths of the annuM *.00 .75 rate shall be charge^ for all li censes issued after May 31st, 19*, and prior to September 1, 19*, except as otherwise herein provided; and one-half of the an nual rate for all licenses issued after August 31, 19*. and prior to December 31, 19*. except as otherwise herein provided. Section 3. That every person, corporation, or partnership re quired by ttyis ordinance to obtain a license to engage in any ness, trade, profession, or occu pation, for which a license is re quired, shall at tbe time of apply ing for such license, or any time as may be required by the City Council, furnish to the City Clerk, or auditor of the City, such other and further information as may be necessary for correctly ascertaining the license to be as- sessed and collected. Section 4. Any person, firm, company or corporation prose cuting or engaging in any busi- new, trade, occupation or profes sion or keeping or malntoi».i« g any establishment named In this ordinance without first having paid the license tax imposed thereon, or shall violate other- wiw any of the terms or provis ions of this ordinance, shall, up on conviction, be fined not ex ceeding one hundred dollars, or be imprisoned not exceeding thirty days, at the discretion of the Recorder. Section 5. TRADE OR OCCUPATION FOR WHICH A UCENSE IS RE QUIRED, SHALL AT THE TIME OF APPLYDfG FOR SUCH LI CENSE MAKE A STATEMENT J2E** BEFORE AN OFFICER QUALIFIED TO AD- MINISTER OATHS, AND FILE SUCH STATEMENT WITH THE. CITY CLERK SETTING' FORTH: (a) HIS OR HER NAME, STYLE OF FIRM, NAME OF COMPANY. OR CORPORA TION; (b) THE TRADE, BUSINESS. PROFESSION, OR OCCUPA TION FOR WHICH A UCENSE IS REQUIRED; (c) IN THOSE CASES IN WHICH SUCH INFORMATION IS REQUIRED, THE AMOUNT OF BUSINESS DONE DURING THE PREVIOUS YEAR IN THE SAME OCCUPATION, TRADE. BUSINESS, OR PROFESSION. THE CITY CLERK SHALL THEREUPON ASSESS AND COLLECT THE PROPER U- CENSE TAX AS PROVIDED FOR IN THIS ORDINANCE, AND UPON SUCH TAX BEING PAID, SHALL ISSUE TO THE APPUCANT THE PROPER LI CENSE. Section 8. For any business, trade, occupation, or profession not enumerated in Section I of this ordinance, the license shall be fixed by the Mayor and he is hereby given full power and au thority to fix the same and such license therefor as shall bt fixed by the Mayor shall be as binding in every respect as though it were specifically enumerated and/or designated in this ordinance. Section 9. The license taxes herein imposed are levied for the purpose of raising funds to meet the ordinary annuM expenses of the City of Clinton for the fiscM year commencing on the 1st day of January, 1966, and for the pur pose of paying in whole or in part legal indebtedness of the said City incurred for ordinary expenses thereof falling due during the said fiscM year. . , Section 10. All annuM licenses must be paid on jr before March 1st, 19*, or peralty of an addi tionM ten (10%) per centum of the amount herein stated ■hall be charged after March 1, 19*. If said license tax is not paid on or before March 15, ’05, the busi ness .shall be closed by the Chief of Police and action brought in Recorder’s Court for the City un der Section 4 of this ordinance for the misdemeanor of doing business without a license. Section 11. If any word, clause, sentence or section of this ordinance be declared unconsti tutional or in contravention of any law or laws of the State of South Carolina, such shall not af fect any other word, clause, sen tence, or section hereof. Section 12. This ordinance shall be effective from the date of its passage.
