,v License Ordinance /W ORDINANCE IMPOSING A LI CENSE TAX ON ALL PERSONS. FIRMS, AND CORPORATIONS-^ WHO ENGAGE IN OR CARRT ON ANY BUSINESS OR PRO FESSION IN THE CITY OF SOCTH CAROLINA. BE IT ORDAINED BY THE (TTY ('OUNCEL OF THE CITY OF CLINTON, SOUTH CAROLINA. IN COUNCIL ASSEMBLED Section 1. That no person, firm or corporation shall after the first day erf January*, 1960, engage in. prose cute or carry on any business or profession hereinafter named, with in the corporate limits of the City of Clinton, without first having paid a special license tax therefor. The amount of said apecial tax shall be the amount placed opposite each oc cupation. business, or profession, hereinbelow named, respectively, and the amount shall be the cost of said special tax per annum unless otherwise specified, to wit: ADVERTISING— Advertising by motor ve hicles or otherwise on the streets, including distribu tion of hand bills, circulars, other advertsiing matter or hill posting, whose gross annual income is $3,009.00 or less $ for each additional $1,000.- 00 of gross annual income Provided, the provisions hereof shall not apply to any person, firm or corpo ration maintaining a regu lar place of busihess in the City of Clinton when such advertising restricted to to the advertising of said business by the person hav ing a license to operate said busihess ADVERTEi REPRESENTATTV PUBLISHER, ADVERTIS- , ^ ER. As a- condition precedent to the granting oi>issuing of any license for the oj5eration of any taxicab, automobile, hack, or other vehicle for hauling or transporting pas sengers for hire within the cor porate limits of the City of Clin ton. the applicant for such license shall first be required to file with the City Clerk of the City of Clin ton a policy pr policies of insur ance issued rby a company or companies doing business in the State of South Carolina upon each taxicab, automobile or v vehicle to be operated under such license, covering liability in an amount of not less than $5,000.00 for injury to any one person and in an amount not less than $10,000.- 00 for injury to more than one person injured in one accident, and in an amount of not less than $5,000 00 for damages to the prop erty of any person or person^. Said insurance shall be of a type that shall be carried in a com- 'pany or companies to be approv ed by the City Council of the City -of Clinton and shall be maintained in full force at all times during the term of any li cense issued thereunder, and it shall be unlawful for any taxicab, automobile or vehicle for trans porting o' hauling passengers for hire to be operated in the City of Clinton at any time without having such insurance in full force and effect. That all licenses issued under and by virtue of this ordi nance shall be non-transferrable and except for a license for a day, a week or a month shall terminate and end on the 31st day of Decem ber, 1960, but- may be revoked at any time by the City Council of the City of Clinton on satsifactory cause being shown; and except li cense issued for a day, a week or a month, annual rate shall be charg ed for all licenses issued prior to June 1st, 1960, three-fourths of the annual rate shall be charged, for all licenses issued after May 31, 1960, and prior to September 1, 1960; and one-half the annual rate for all licenses issued after August 31, 1960, and prior to December 31, 1960. »•« * Section 3. That every person, cor poration or partnership;^ required by this ordinance to obtain a li cense to engage in any business, trade, profession, or occupation, for which a license is required, shall at the time of applying for such li cense, or at any other time as may be required by the City Council, furnish to the City Clerk or audi tor of the City, such other and fur ther information as may ,be neces sary for correctly ascertaining the license to be assessed and collected. Section 4. Any person, firm or corporation prosecuting or - engag ing in any business, trade, occu pation or profession or keeping or maintaining any establishment named in this ordinance without first having paid the license tax imposed thereon, or shall violate otherwise any .of the terms or pro visions of this ordinance, shall up on conviction, be fined not exceed ing one hundred dollars or be im prisoned not exceeding thirty days with or without hard labor at the discretion of the* Recorder trying the case. ; Section 5. Where a license is im posed by this ordinance upon any business, profession, or occupation, and such business, profession or oc cupation is carried on or conducted by an agent, clerk or, employee, such agent, clerk or employee shall be subject to all the penalties herein imposed should the said business, profession or occupatioh be carried on or prosecuted with out the license imposed having been paid in the same manner as if such agent, clerk, or employee were the proprietor of such business, profes sion or occupation. Section 6. Where amount of li cense provided for herein is de pendent upon the amount of income, receipts or sales, the basis for as certaining the amount of said li cense shall be the amount of the in come or sales for the preceding year ending December 31, 1959. Section.7.. That every person, firm, company, or corporation, re quired by this ordinance to obtain a license to engage in any business, trade, or occupation for which a li cense is required, shall at the time of applying for such license make a statement under oath, before an officer qualified to administer oaths and file said statement kith the City Clerk setting forth: (1) His or her name, style of firm, name of company or corporation. (2) The trade, business; profes sion or occupation for which, a li cense is required. v ^ (3) The amount of business pro posed to. be done during the cur rent year and in those cases in which such information is required, the amount of business done during the previous year in the same occu pation, trade, business or profes sion if the same was carried [on or prosecuted the previous year. The City Clerk shall thereupon assess and collect the proper licerfse tax as provided for in this ordinance, and upon such tax being paid, shall issue to the applicant the proper li cense. v Section 8. For any business, trade, occupation, or profession not enum erated in Section 1 of this ordi nance, the license shall be fixed by the Mayor and he is hereby given full power and authority to fix the same and such license therefor as shall be fixed by the Mayor shall be as binding in every respect as though it were specifically enumer ated or designated in this ordinance. Section 9. The license taxes here in imposed Ire levied for the pur pose of raising' funds to meet the annual ordinary expenses of the City of Clinton for the fiscal year commencing the 1st day of Janu ary, I960, and for the purpose of paying in whole or in part any legal indebtedness of the said City incur red for ordinary expenses thereof falling duo the said fiscal year. If license is not paid on or before March 15, 1960, the business shall be closed by the Chief of Police ahd action brought in Recorder’s*Court for the Town under Section 4 of this ordinance for the misdemeanor of doing bus- ness without license. Section 11. If any word, clause, sentence, of section of this ordi nance be declared unconstitutional or in contravention of any law or laws of the State of South Carolina, such shall not affect any other word, clause, sentence, or section thereof. Section 12. This ordinance Shall be effective from the date of its passage. DONE AND RATIFIED by the City Council of the City of Clin ton, South Carolina, in Council as sembled and the corporate seal of the said City of Clinton hereto af fixed this the 7th day of Decem ber, A.
