Be it ordained by the Town Council of the Town of Clinton in Council assembled: Section 1: Adoption of and com pliance with South Carolina Stat ute Law... Section 3: Possession for unlaw ful use... No person shall accept receive or have in possession any alcoholic liquors for unlawful use under the provisions of this Ordi nance. ] t i Section 4: Personal or Religious use... It shall be unlawful for any intoxicating liquors to be stored or kept within the corporate*limits of the Town, except for one’s own personal use or that of his imme diate family, or for religious pur poses, and then only at his usual place of residence and only when the same shall have been procured in a lawful manner. The residence of a person shall be where his fam ily resides if he has a family re siding in the Town, if not, at the place where he usually sleeps. No place of amusement shall be maintained within or in connection with any store or warehouse operated by a licensed retailer or a licensed wholesaler. Section 10: Hours of sale. No sale, barter, exchange, gift, transfer or delivery of any alcoholic liquors shall be made, offered or permitted between the hours of sundown and sunrise in any store or warehouse operated by licensed wholesaler or retailer. Section 11: Drinking in retail establishment. No retail dealer shall permit any alcoholic liquor to be drunk on the premises of his es tablishment. No person shall take a drink oi alcoholic liquor in any retail establishment. Section 12: Retail establishment to be locked at night. Every retail dealer shall securely close and lock every means of entry to his busi ness establishment at sundown and shall not open the same for busi- this Section. Section 5: Dealing with alco holic liquors on which Stale and Federal Tax not paid. It shall be unlawful for any person to manufacture, store, keep, receive, have in possession, transport, ship, buy, sell, barter, exchange or de liver any alcoholic liquors within the Town unless the State and gress or egress save fom the front. Stationery Department 4 sold, bartered, exchanged, given, transferred or delivered any alco holic liquors to minors or to any person when intoxicated or insane. Section 15: Sale. etc., by retail dealer of less than 1-2 pint. It shall be unlawful for any retail dealer to sell or offer for sale, bater or ex change or permit to be sold, bar tered or exchanged any alcoholic liquor in any less quantities than one-half pint. Section 18: Possession by retail dealer of package containing ..less than one-half pint. It shall be un lawful for any retail dealer to own or keep in possession any alcoholic liquor in separate packages con taining less than one-half pint. Section 17: Purchase from unli censed dealer prohibited. It shall be unlawful for any person to pur chase or otherwise procure, within the Town, any alcoholic liquor oth er than from licensed dealers as provided by law. Section 18: Possession of bottle of liquor with no revenue ..stamp thereon. No person shall have in possession any bottle or other pack age containing alcoholic liquor, which does not have affixed there to the revenue stamps as required by law. Section 19: Confiscation and sale of chattel used in illegal trans portation. Any chattel used pri marily and with knowledge of the owner thereof in transportation of alcoholic liquors in violation of the provisions of this Ordinance and of the laws of the State of South Carolina shall be subject to confis cation and sale in the same manner as provided by laws of the State of South Carolina in the matter of unstamped liquors. Such chattel may be sold to any person. When such chattel has been seized by municipal officers of the Town, thej proceeds of such sale shall be paid to the Town for its use. Section 20: Employmonl of min- : or in liquor business. It shall be | unlawful for any person under the age of 21 years to tfork as employ-j ee or otherwise in a retail, whole-! sale or manufacturing liquor busi-j ness. It shall be unlawful to em ploy, knowingly, any person under the age of 21 years to work as an employee or otherwse in a retail, wholesale, or manufacturing liquor business. Section 21: Days upon which al coholic liquors may not bo sold. Alcoholic liquors shall not be sold on Sunday, election days, or any« other day upon which sale shall be prohibited by the Governor. Section 22: Soixure when State and Federal tax not paid or person not ..licensed. All alcoholic li quors found in possession and cus tody or within the control of any person, handled, stored, used or distributed without payment of the; State and Federal tax provided by law having been duly made, or without such person having been duly licensed by the South Caro lina Tax Commission so required by law, may be seized and confis- j qated. Section 23: That any violation of any of the provisions of this or-, dinance including the statutory I laws of the State as herein adopt-1 ed, shall be punished, upon con viction, by a fine of not exceeding; One Hundred ($100.00) Dollars or by [ imprisonment for not exceeding thirty (30) days, in the discretion of) the Mayor. Section 24: If any word, clause,! sentence or section of this Ordi-| nance be declared unconstitutional or in contravention of any law or laws of the State of South Carolina, such shall not effect any other word, clause, sentence* or section thereof. Section 25: This Ordinance shall go into effect on the 7th day of July, A. D., 1953.
