Thq supreme court yesterday in an order granted a stay of remit ittur in the Jones case from Union county. The order was signed by Chief Justice Jones and the grounds upon which it was gra4nted are not stated. The remittitur is stayed. un til further onder of the court. The attorneys for Jones are giveen until Aipril 1 in which to file an amended petition and argument for rehear ing. A recent decision. of the su preme court affirmed the judgment of the Union county eircuit court rwhere W. T. Jones, a wealthy plan ter was found guilty of the murder of his wife with recommendations to the mercy of the court. The following is the order of the court: "State of South Carolina, in Su preme Court--April Term, 1910. "The -State vs. W. T. Jones. "Upon heariong the petition here in for stay of remittitur and for rehearing it is ordered: "That the remittitur be stayed until further order of this court. "It is further ordered that ap pellant have till April 1, 1910, (in. elusive) in which to file amended petition and argament for rehearing. "Ira B. Jones, "Chief Justice." The following special was reeeiv ed last night from Spartanburg with reference to the position of the attorney for W. T. Jones: Mr. Stanyarne Wilson, attorney for W. T. Jones of Union, sentenced to life imprisonment for wife mur der in commenting upon the action of Chief Justice Jones in granting a stay of remittitur in that case said it simply means that the supreme court would hold the case under its jurisdiction for such action as it -may desire to take. The court may reIaw the casl again, may grant a rehearing 01 may without further consideration send its recent decision sustammin the decision of the circuit couri back to that court and thus end the ~matter. "When the supreme cou.rt sends a ~decision confirming the cir cuit court back to that court its dietion pnds and thie eas4 is settled,'' said Mr. Wilson. "'This action just leaves the ease 'with the supreme court," Mr. Wil son added. "Of course I don't kiow what the court will do 0r whether it will do anything." Mr. Wilson says if the supreme court has not seen, fit to make pub lie the grounds for granting the stay in the W. T. Jones case he does otfeel that he is justified in mak :ing any statement, as to the argu. :mnents submritted by counsel for the idefense. Tillman, in the words of 'his physician, Dr. Piekford, "has had a miost unusual rally," and he will be taken to his home in Trenton next Wednesday eveniing. During -thE past two or three days the conval escenee of the senatoJr has been sc progressive that he has become rest less and it was all his family could do to refrain from taking him home at once. He wanted to go last 'night, de claring that he wanted to see his flowers while they were in bloom. Hie can walk about the room, and he talked freely. Dr. Pickford says that when he gets to Trenton he will be able to walk about the yard .among his flowers. The senator has been a constant source of surprise to all about Wash i'ugton, where, a little over three weeks ago, there was general expec tation that he would die. When it became apparent that he would live it was generaLy ,bedierydd thsati he would lose the use of either his right leg or of his speech, or both. When now the senator walks and talks and shows steady progress to ward complete recovery, the mar velous vitality of the man is a sub ject of universal comment. Dr. Babcock said when he was here. "Tillman is now reaping the 'benefit of his long years of regulax -an temnprate nhysical .life." THREE APPOINTMENTS ARE STILL HELD UP Delay in Keeping Union, Newberry and Laurens Postmaster on the Anxious Bench. Washington, March 12.-The ap pointments of postmasters at New berry, Laurens and Uion are still hung up. Capt. Capers, to whom these mat ters are reported from time to time, learned today that the Newberry ,appointment is fixed upon, Mr. Pur cell's reappointment being assured, awaiting only the routine papers to be d4elared before the po4mster general signs the nomination. In the Union ease a report of the post offiee inspector sent down to inves .tigate was made today, but it has ;not yet been taken up by the de paTment. Nothing has yet been determined in the Laurens case, which was ordered investigated. Evidences -come of growing anxi ety in all three of these eases as day by day passes, other postoffiee com missions bei-ng sent to the senate, but none for South Carolina. Messrs. Pureel1, at Newberry, Hun ter at Union, and MoCravy at Lau rens are on the anxious bench. HOOK WORM AT UNIVERSITY. Studeonts at Columbia Are Exam ined.-Report Exaggerated. Columbia, March 12.-Statements by the president and by th6 phy sicians of the University today serve to contradict the reported condition that 60 per cent. of the students of the University of South Carolie have the hook worm. "Out of 60 suspects examined," said Dr. Weston, "I found only half a dozen mild cases, which are being treated with fine results.'' "Out of the thirty examinations," said Dr. Watson, "the examinations made by Dr. Coward for me show onl- four eases, which are getting on ely, so there are not more than a dozen cases at the most.' All of 'which reveals less than ten per cent. at the most, and as only sus peet eases we examed, it4 is reasonable to conclude that an ex amination of the entire student body would cut down the percentage ,over half, if not more. Dr. S. C. Mitehell, president of the University, was surprised to learno that such a report had gained currency as that 60 per cent. of many students examined had been! Ifound to have the disease. ":After the recent health confer enee in Columbia,'' said Dr. Mitchell, "' some of the students, of their ow.n motion had themselves exam ined and a few of these being found to 'have the trouble in some degree, went promptly to the infirmary, and t'here received the proper treat mrent, whiich is very simple. I think the number of eases did not exceed (ten'. The matter has not caused the Islightest ripple in the life of the University. It hbas just percepti.bly increased the attendance at the in ~firmary.
