Iu this case there has been no order of a State Court respecting poymeut or j distribution. There has been uo re? ceiver appoiuted to tuke possession of the cfleets of the insolvent corporation. The court has required tbe officers of the company to remain in possession and make no transfor; tbey have not so made transfer; the transfer was by ope? ration of law, upon the application for the benefit of the bankrupt Aot to the District Court. We do not thiuk a State Conrt can, by any process, pre? vent a party from applying to the Dis? trict Court for thu benefit of the pro? visions of Ihe bankrupt law.
