Ba it ordained, by the Mayor and the Aldermen of the city nf Co? lumbia, in Council assembled, That a Board of Health be, and the Hame is hereby, established, which shall consist of twelve members, to be chose o by bal? lot by tho City Council,rat their first meeting in May of. euch and every year; and said Board shall be so chosen, that three of them Bboll be elected from Ward No. 1, three from Ward No. 2, three from Ward No. 3, aud three from Wurd No. 4, seven of whom shall constitute a quorum; audit nny person so eleoted a member of tho Board of Health, shall refuse or neglect to perform the dutiee hereafter required, bo shall, upon con? viction thereof before the City Council, forfeit and pay the Bum of $45: Provided, That no person shall be compelled to serve more than ono yenr in every throe. That tte suid Board of Health, of whom sn ven shall constitute a quorum, shall meet at least once a .fortnight from the first day June to tho first day of November of each and every year, und at euell other times and at such places UK they nm y deem necessary and convenient, for tho purpose of receiving and communicat? ing all posBibln information relative to the health of thu city, and to ad" iso and consult together respecting thc preserva? tion of the sume; nod shall have full und ample powers to adopt and carry into effect all such measures, rules and regu? lations as they may deem necessary to the discbarge of the trust hereby confided to them; and each and every practical physician within tho city is hereby re? quired to give immediate information of the existence of any contagious or malig? nant disease to the Board, or to any mem? ber thereof, and at all convenient times to aid and advise the said Board in the preservation of the health of the city, and in tho preservation or suppression of contagious or malignant diseases. SEC. 3. Be it further ordained. That it shall be the duty of each and every member of the said Board to cause to be removed, from tho streets within the Ward under his or their charge, all of feusivo substances or nuisances tending to endanger the health of the citizens of the city; and the Chief of Police and his assistants, and the Superintendent of tho Streets, are hereby required, without de? lay, to obey all orders or precepts that shall be given them, or either of them, by either of the members of said Board respecting removal of such nuisances. SEO. 4. Be ii further ordained, That the said Board of Heulth, or any mem? ber thereof, shall havo power, and arc hereby invested with full authority, to enter into and upon any lot, ground or possessions of any person or persons, and thoroughly examine the same; and whenever the said Board, or any mem? ber thereof, shall have oause to suspect that any foul or noxious efiluvia origi? nates, or is collected in any house, cel? lar, or in any enclosure whatever, shut up from public view, they, or any ol them, may demand entry therein, and direct the same to be opened and venti? lated, or the cause of such efiluvia to bc removed, as maybe deemed necessary; and if tho owner or occupant of such lot, house, cellar or enclosure shall refuse or delay to open tho same, or suffer it to bo examined and ventilated, or removed, as aforesaid, or shall in any wise ob? struct tho said Board, or any membei thereof, or any policoman or other officer, in discharge of his or their official duty, such owner or occupant shall bo fined not exceeding twenty dollars for each and every day he, she or they shall sc neglect, refuse or delay, after demaud by said Board, or any member thereof; and shall also defray all expenses incurred in tue removal or suppression of snob nui? sances, nnder the direction of said Board, or any member thereof. Thal the Chief of Polioe, or acting Chief o: Police, shall have power, and is hereby authorized and required, to demanc entrance iuto any lot, building, cellar oi enclosure, wherein he may suspeot um nuisance to exist, for the purpose o ascertaining whether any such nuisanci does exist therein; and if the owner o: occupant of any such lot, building ellar or enclosure shall refuse to permi said Chief of Police, or acting Chief o Polioe, BO to enter for tho purpose afore said, or shall otherwise obstruct or hi tide him in the discharge of the above duty such owner or occupant shall forfeit an? pay for each and every offence a sum nc exceeding twenty dollars.
