TER OF ERSKINE COLLEGE, AT DUE WEST, IN ABBEVILLE COUNTY, S. C. SECTION 1. Be il enacted by the Senate and House of Representatives of the State of South Carolina, now met and sitting in General Assembly, and by the authority of the same, That Rev. J. Boyce, D. D., Rev. W. M. Grier, J. S. Miller, J. W. Hearst, P. H. Bradley, W. K. Bradley, D. O. Hawthorne, J. L. Pressley, W. S. Lowry, Wm. Hood, Rev. J. N. Young, Rev. J. I. Bonner, J. P. Kennedy, Rev. J. P. Pressley, D. That Sections 2, 3, 4, 5 and 6 of an Act entitled "Au Act to charter and incorporate Erskine College, at Duo West, in Abbeville District," ratified December 20, 1850, be, and tho same are hereby, continued in force. SEC. 3. This Act shall bo taken and deemed to be a public Act, and continuo in force until repealed. Approved March 12, 1872. AN ACT TO INCORPORATE THE DEAUFORT HORSE RAILROAD COMPANY, TN THE TOWN AND COUNTY OF BEAUFORT. SECTION 1, Be it enacted by the Senate and House of Representatives of the Slate of South drolina, now met and sitting in General Assembly, and by the authority of the same, That Robert Smalls, R. S. Bennett, P. E. Ezekiol, James M. Cro fut, W. J. Whipper, J. B. Bascomb, Samuel Greene, J. NV. Collins, N. B. Meyers, E. Nehemias, and all those per? sons who may hereafter be associated with thom, be, and the same aro hereby, made and declared a body corporate, under tho stylo and titlo of the Beaufort Horso Railroad Company, and, by snch title, may sue and bo sued, und muy plead and be impleaded, and shall have authority and power to take, subscribe and raise a capital stock to tho amount of twenty-tivo thousand (25,000) dollars, in shares of twenty-live (25) dollars each, for the pur poso horeiu specified; and they aro hereby farther authorized and empowered to increase the said capital stock tc? the som of fifty thousand dol? lars: Provided. That such increase shall bo assented to by tho majority of the stockholders. SEC. 2. That the said Beaufort Horso Railroad Company, of Beaufort, shall have power and authority to lay a track from the East end of Bay street, in tho town of Beaufort, through and along Bay street, and connecting with the Port Royal Railroad, and suoh othor points as they may deem most advan? tageous. SEC 3. That the said Beaufort Horso Railroad Company, of Beaufort, shall be able and oapable, by its corporate name, to buy property and to sell, for tho pur? pose of its business, to sae and bo sued, to plead and bo imploaded in any court of law or equity in this Stato, and havo succession of officers and members, and shall havo power to muko by-laws, not repugnant to the laws of tho land, for the government and good order of its members, as shall be deemed expedient by a majority of the Btookholders, and to have a common seal, and to alter and make new the same. SEO. 4. That the said Beaufort Horse Railway Company, of Beaufort, shall have power and authority to issue bonds to an amount equal to one-half of tho capital subscribed, the same to bo re? deemable) at snob timo, not exceeding ten (10) years, as may be agreed upon by said Company, and to bear interest nt seven per cent, per annum, payable semi-annually. SEO. 5. That this Aot shall remain in foroe and continue for tho term of ninety-nine years. SEO. G. That all Acts inconsistent with this Act are hereby repealed. Approved March 12, 1872. AK ACT LEOALIZINO CERTAIN MARRIAGES, AND FOR OTHER PURPOSES THEREIN MENTIONED. SECTION 1. Be it enacted by the Senate and House of Representatives of the State of South Carolina, now met and sitting in General Assembly, and by Hie authority of the same, That all persons in tho State of Sonth Carolina who, previous to their actnal emancipation, had undertaken and agreed to ocoupy the relation to each other of husband and wife, and are cohabiting as such, or in any woy re? cognizing tho relation as still existing at the timo of tho passage of this Act, whether tho ri tea of marriage have been celebrated or not, shall bo deemed hus? band and wife, and bo entitled to all tho rights and privileges, and bo subject to all tho duties and obligations of that re? lation, in Uko manner ns if they had been duly married according to law. SEC. 2, And nil of their children shall bo deemed legitimate, whether born bo fore or after the passage of this Aot; and, where the parties have ceased to cohabit before tho pasBago of this Act, in conse? quence of tho death of the woman, or from other cause, all of tho children of the woman recognized by the man to bo hisshall be deemed legitimate: Provided, however, That no provision of this Act shall bo deemed to extend to parsons who have agreed to live in concubinage after their emancipation. Robertson, John IVgnow, Charles Logan, R. O. Shiver, Owen Daly, M. J. Calnan, and their as sociales and successors, bo, and they arc hereby deolared to be, a body corporate and politic, by the name and stylo of thc Columbia Jockoy Club, and shall have power to retain, possess and enjoy al snob property as they may now bo pog sessed of or entitled to, or which ebal hereafter bo acquired by them, and te sell, alien or in any way transfer the same, or any part thereof: Provided, Tho amount of property so hold shal not exoeed twenty-five thousand dollars SEO. 2.
