AN ACT TO RENEW AND AMEND THE CHAR? TER OP THE TOWN OP WTXLIA3IST0N. SECTION 1. Be it enacted by the Senate and House 'of Representatives of the State of South Carolina, ?ow met and sitting in General Assembly, arid by the authority of the same, That from and immediately, after the passage of this Act, all and . every person or persons who may havo resided within tho corporate limits of the town of Williamston for ono year, or who may own a freehold therein, and their saccessors, are hereby declared to be members of the corporation hereby intended to bo created. SEC. 2. That the said persons aud their successors shall, from and after tho passngo of this Act, become a body politic and corporate, and shall bo known and called by the name of the town of Williamston, aud its corporate limits shall extend oue mile in the direc? tion of the cardinal points from tho pro sent brick hotel as a centre, and form a circle. SEC. 3. That tho said town shall bo g.. reruod by un Intendant and four Wardens, who shall be persons that ac? tually reside within tho limits of tho cor? poration, and have so resided at least twelve months immediately precoding their election. The said Intendant and ?jjBfcdena shall be elected on tho second ?-'?V?Kiday in September in each year, ten days' notice having boen previously given, and shall coutiuue iu offloo for one year, and until the election and qualification of their successors. And | all male iuhabitanta of the said towu, I who shall have attaiued tho ago of I tweuty-ouo yoars and resided therein sixty days immediately preceding thu election, shall be entitled to voto for said Intendant and Wardens: Provided, That no person shall bo allowed to voto ! at auy such election who shall not have j registered his name as a voter with tho Clerk of the Council, in a book or books to be kept by him for that purpose, by 10 o'olock A. M., oa tho day preceding every such ?lection. SEC. 'k. That said election shall bo held in some convenient public place iu \ said towu, from 9 o'clock in tho moruing > until 5 o'olook ia the evening, and when ! the polls shall bo closed, the managers shall forthwith proceed to oount the votes, under oath, publicly, stating tho whole number of votes cast for ench can? didate or person voted for, and shall transmit their report for tho same, in a sealed envelope, to the Intendant of tho town, aud if thero bo no such Intend? ant, the same shall bo transmitted to tho Clerk of the Court of Anderson County. The said Intendant, or Clerk of tho Court, shall open tho report of tho said managers, and shall announce and pub? lish tho whole number of votes cast, and tho whole number oast for each candi? date, when tho several candidates re? ceiving thc highest number of legal votos for tho offices whioh they wero voted for, shall be declared duly olectod. Tho Intendant and Wardens, for tho time being, shall always appoint three managers to conduot the election, who, before thoy open the polls for said elec? tion , shall take the oath fairly and im? partially to conduot tho snme. And the Intendant and Wardens, beforo entering upon the duties of their office, shall, re? spectively, take the oath prescribed by the Constitution of this Stato, and also the following oath, to wit: "As Intend? ant (or Warden) of tho town of Wil liamston, I will faithfully and impartial? ly, to tho best of my ability, exorciso the trust roposed in mo, and will use my best endeavors to preserve the peace, and carry into effect, according to law, the purpose for which I have been elect? ed. So help me God." Ssa 5. In. case a vacancy should occur in tho office of Intendant, or any of the Wardens, by death, resignation, or otherwise, an election to fill such va? cancy shall be held by the appointment of the Intendant and Warden or Ward? ens; and, in case there be noue, thou by the appointment of the Clerk of the Court of Anderson County. SEO. 6. That the Iuteudant and Ward? ens, duly elected and qualified, shall be, during their term of office, vested with all the powers and authority with which Trial Justices are at present vested by law, except the trial of oivil cases, and except as it may be otherwise provided in this Aot. And the Intendant shall and may, as often as may be necessary, summon the Wardens to meot in Coun? cil, any two of whom, with the Intend? ant, or any three Wardens, may consti? tute a quorum to transact business; and they shall be known by the name of the Town Council of Williamston; and they and their successors hereafter to be elected, may have a oommou seal, which shall be affixed to all other ordinances, may sue and bo sued, plead and bo im pleaded, in any court of law or equity in thia State, aud purchase, hold, possess and enjoy, to them and thoir BueceBsore in perpetuity, or for any term of years, any estate?, real, personal or mixed, and sell, alien and convey the same: Pro? vided, The samo shall not exceed, at nnv one time, the sum of ton thousand dol? lars. And tho said Intendant and Ward ens shall have full power to make ant establish all such rules, by-laws and or dinances respecting tho roads, streets markets and police of said town as shal appear to them necessary aud requisite for the security, welfare aud convenient of tho said town, or for preserving th< health, peace, order and good govern ment within the same. And tho sait Counoil may fix and imposo fines ant penalties for the violation thereof, nm appropriate tho same to tho public us of the said corporation: Provided, Tba in all cases of trials to be had before th said Town Council, as hereinbofore pro vided, the party oharged shall be cite to trial by service upon him of a sum mons, under the hand of the Iutondaul any one of the Warders, or the Clerk c the Counoil, wherein shall bo expressed with oertainty, the offence oharged, an the time and place of trial, which sei vice shall be made at least five days b( fore the day of trial. SEO. 7. That the Intenduntand Wan ens of the said towu shall have full au only power to grant or refuse license t retail spirituous liquors within tho Bni limits, which license shall bo granted i the same manner, und upon tho san: conditions, as they now are, or mu hereafter be, under tho laws of th Stato, except that tho Town Coutte shall havo the power to regulate tl prioo of licenses to keep taverns aud I retail spirituous liquors: Provided, Th: ia no instance the price of a license so 1 keep tavern or retail spirituous liquo shall bo fixed at a less sum than is e tabliahed by tho laws of this Stato; an all tho porters vested formerly iu tl Commissioners of Roads are herel granted to the said Intendant and War ens within tho said limits; and c moneys paid for licenses, aud for fin and forfeitures, for rotailiug spirituel liquors, kooping taverns, billiard table within tho said limits, without licons shall bo appropriated to tho uses ot sa corporation: Provided, That the luton ant and Wardens, duly elected and qua fled, shall not havo power to grant ai liceuses to keep tavern or retail spirit ous liquors to extond beyond the tin for which they shall have been elected SEC. 8. That it shall be tho duty tho said Intendant and Wardens to kc all streets, roads and ways, within the corporate limits, open and in good i pair; and, for that purpose, they aro i vested with all tho powers granted fe merly to tho Commissioners of Boat And they shall havo powor to compoui with all persons liablo to work t streets, ways and roads in said tow upon such terms as they shall, by ort nance, establish; the moneys so receiv to bo applied to the public use. SEC. U. That tho paid Towu Conn shall have power to impose an aunt tax upou tho keepers of all billin tables and ten pin alleys, or other JJ alleys, within tho discretion of sn Council; aud to grant or refuse liceni for thc same, upon such term;, and cc ditious, aud subject to such regulatiot as they may, by ordinance, establii They shall also havo power to impose tax, within their discretion, ou all sa made by itiueraut traders aud auetic eera, on all publia drays, wagoi oorringos, omnibuses, and other vchic kept for hire, and on tho owners or p: prietors of all dogs, hog1?, sheep, go: and cattle kopi -"ithin tho aorpori limits of said town. Tho said To Council shall have power to impose annual tax on the amount of all sales goods, wares and merchandize, and a upon tho amount of incomoarising fr? all factorage aud merchandize, empli ments, faculties and professions, inolt ing the profession of dentistry; a upou tho amount of income from moneys loaned at interest, and fr dividends received from banks and other stocks: Provided, That no shall bo imposed, in any one caso, to ceed tho rato of thirty cents on et hundred dollars of tba value of st sales and income. And the said Town Council shall have power to impose an annual tax on all carriages and wagons, of whatever kind, kept for private use; on all gold, silver und other watches, kept for private use, within the limits of the said town. And the said Town Council shall have power to impose an annual tax, not exceeding thirty cents on every hundred dollurs of the value of all real estate lyiug in the corporate limits of said town, the real estate of ohurches and school ussr ? i uti ou s ex? cepted; und, for that purpose, they shall appoint three freeholders residing therein to assess tho value of Baid real estate, upon oath, and roturn the assess? ment, within ono month, to said Coun? cil for taxation; and to fill any vacancy occasioned by the death, resignation, refusal to servo, or removal from office, ol the said assessor. And the said Town Council shall have power to regulate tho price of licenses upon ull public shows uud exhibitions in said town; to erect a powder magazine, and to compel any person holding more than twenty-five pounds of power to store the same therein, and to make regulations for rates of storage thereof, and for keep? ing and storing the samo. And the said Town Council shall have power to enforce tho payment of all taxes and assessments, levied under tho authority of this Act, against the property and persons of defaulters, to tho sumo ex? tent, and in the same manner us is pro? vided by law for the collection of the general State tax, except that execu? tions to enforce tho payment of town taxes shall be issued under the seal of the corporation, and direoted to the Town Marshal, or other person espe? cially appointed by the said Town Coun? cil, to collect tho same; nud all property upon which a tax shall be levied and assessed, is hereby declared and made liable for tho payment thereof in pre? ference to other debts due by the person owning auch property at the time of the assessment, except debts due tho State, whioh shall be first paid. Tho snid moneys, together with all other moneye collected by authority of thc provisions of this Act, and tho ordinances pulsed in conformity thereto, from whatevei source said moneyB may arise, to bo paid into the treasury of said town, for the uso of tho corporation. SEC. lt). That returus shall be made, on oath, to tho Clerk of tho Town Coun? cil, during tho month of January, ir each year, of tho amount of all sales ol merchandize, professional, mechanical or other incomes, and of the quantity and kind of all other property than rea estate subject to taxation, under the pro visions of this Act, by persons who ma^ be liable to pay the taxes on the same and the said taxes shall be paid on a: before the first day of March then nex ensuing. Upon failure thereof, an^ party in default shall bo subject to thi penalties now provided by law for failun to pay tho general State tax. SEC. ll. That thc said Town Counci shall have authority to require all per sons owning a lot or lots in Baid town b mako and keep in good repair side-walk in front of t>aid lot or lots, wheneve they shall front or ndjoin any publi street of said town, if, in tho judgmeu ?of the Council, such side-walks shull b necessary, tho width thereof, aud th manner of their construction, to bc dc siguated and regulated by tho sai Council; and for default or refusal t make and keep in repair such side-walk* tho Town Council may causo the sam to bo made nud put in repair, and ri quire tho owuor to pay tho price c making or repairing; sud tho said Tow Council arc hereby empowered to su for and ?ecover tho samo action of del in any court of competent jurisdiclio in Anderson County: Provided, Thc such cou tract for making or repairing h let lo tho lowes), bidder. SEC. 12. That tho said Town Coane shall have power, with the conseui i tho adjacent land-owners, to close a such roads, streets and ways within th said town as they may deem necessary by sale of the freehold therein, either i private or public sale, as they mn adjudge best for tho interest of sui town; and they shall also havo power t lay out, adopt, opeu aud keep in repai all suoh new streets, roads aud ways t they may, from time to time, deem iu portant or necessary for the improve ment and convenience of said towi Pron'-It'd, That no new street, road c way shall he opened without first huviu obtained tho consent of the land-owut through whoso premises any such ne street, road or way may pass. SEC. lu. That thc said Town Couuc shall have power, aud are hereby BUth< rized, to elect om> or moro Marshals, t allix their salaries and prescribe thc: duties, who ?hall bo duly sworn in, an invested with nil tho power aud subjet to all the duties and liabilities that Coi stables now have or aro subjected, b law, in addition to tho duties and Uah lities especially conferred aud impose on them by the Town Council: /Vi vided, That their jurisdiction Bhall li confined to the corporate limits of sai town. SEC. 14. That the said Town Couuc clmll have powor to establish a guai house, and to prescribe by ordiuanci suitable rules and regulations for kee] iug and goveruiug the same, and for tl confinement of all persons who may I subject to bo committed for the viohitic of auy ordinance of tho town passed i conformity with tho provisions of th Act; and the said Town Council may, I ordinanoo, or tho said Intendant ac Wardens, in person, any ono or moro i them, authorize aud require tho Marsh of tho town, or any Constable special appointed for that purpose, to arrest at commit to tho said guard house, for term not exceeding twenty-four hour any person or persons who, within tl corporate limits of tho said town, mr he engaged in a breach of thc peace, ni riotous or disorderly conduct, open o scenity, public drunkenness, or iu ai conduct grossly indecent or dangeroi to tho citizens of said towo, or any them; and it shall be the duty of the Town Marshals to arrest and commit all suoh offenders, when required to do BO, and who shall have power to call to their assistance the posse comitaius, if need be, to aid in making *3uch arrest; und upon the failure of such persons to perform such duty ns required, they shall, seve? rally, be subject to such tines and penal? ties aa tho Town Council may establish; and all persons so imprisoned shall pay tho costs aud expenses incident to their imprisonment: Provided, That such im? prisonment shall not exempt tho party from payment of any tine the Council may impose for tho offence for which ho may have been committed. SEC. 15. That tbe said Town Council shall havo power to collect the taxes from all persons representing publicly, within the corporate limits, for gain or reward, auy plays or shows, of what na? ture or kind soever, to be used for the purposes of said corporation. SEC. 15. That nil fiues which shall hereafter bo collected by conviction in the Court of Sessions, for retailing without license within the corporate limits of said towu, shall bo paid one half to tho informer und the other half to said Town Council, for the uses of the corporation. SEC. 17. Tho said Town Council shall have power and authority to abate all nuisances withiu tho corporate limite, and also to appoint a board of health for Baid town, and to pnss all such ordi? nances as may bo necessary to detiuo tho powers and duties of said board. SEC. 18. That the Intendant aud Wurd eds shall, during their term of office, bo exempt .from streot duty ; aud each Tow n Council shall, within one month after the expiration of their term of office, make out and return to their successors a full account of their receipts aud ex? penditures during their term, and shall pay over all moneys iu their hands be? longing to tho corporation, nnd deliver up all property, books, records and other papers incident to their office, to their successor?; and, ou failure so to do, they shall be liable to the punishment pre? scribed in tho twentieth section of this Act. SEC. 19. That all ordinances heretofore passed by the Town Council of Williams ton, in conformity with tho authority granted by existing laws, shall be, nut! they aro hereby, declared legal nut] valid. SEC. 20. That for any willful violation of duty, malpractice, ubuse or oppros sion, tho said Intendant and Wardens joiutly and severally, shall be liable tc iudictmentin the Court of Sessions, und upon conviction, to punishment by line not exceeding ono hundred dollars, be sides being liable for damages to an] person injured. SEO. 21. That all Acts, and parts o Acts, heretofore passed in relation to tin incorporation of the town of Williams ton, be, and the sumo aro hereby, re pealed. And this Act shall ho deeniei and taken to be a public Act, and con tinue in forco for the term of twent; years, aud until the end of tho aessio: of tho Legi.'ilature then next ensuing.
