Be it enacted by the Senate and House of Representatives of the State of South Carolina, now met and sitting in General Assembly, and by the authority of the same, That the Governor ?B hereby nut hoi iz ed to appoint separate and dis* tinot boards of pilot commissioners for the ports of Charleston, Beaufort and Georgetown, each board to consist of three persona, of whom two shall be, or shall have been, seafaring men, and the third a fnll branoh pilot. The commis? sioners of pilotage for the port of Bean fort ebal! have jurisdiction over St. He? lena, Port Boval and all entra??os South? ward. Sao. 2. The said commissioners shall have power to organize, from time to time, a board of examination, by adding to their number two nautical men, if deemed necessary by them, to be chosen by themselves; and it shall be tho duty of tho said examining boards to examine each and all applicants as to his or their Sompetenoy to work or manage vessels, nd, generally, to discharge the duties of a pilot or pilots; and no license, or branoh, shall bo granted to any person, unless he re?oives the certificate of com? petency signed by a majority of suoh examining board. SEO. 8. That each and every applicant for a branch, or license, before he shall receive a certificate from a majority ol the examining board, shall pay to said board the sum of five dollars to defra; the expenses of suoh examination and o issuing said certificate. SEO. 4. Apprentices shall be taken bj full branoh pilots only, with the approva of the respective boards of commission ora of pilotage, and shall serve two yean before receiving a nine-foot branch, o license; the last year of service itshal be the duty of their masters to take th* said apprentices on board of all vessels so that they may beoome complete!; competent to discharge their duties After holding their branches, or license! of nine feet, for two years, if competent to the satisfaction of their masters, the shall reoeive a twelve-foot branch, c license, which they must hold in servio for two years, nt the end of which tim they may reoeive a full branoh, or lioensc In ah cases, however, tho applicant fe apprenticeship shall be eighteen years < age previous to receiving his nine-foe branch, or license: Provided, That an person, or persons, who have been trat ing between either of the ports aboi mentioned, and other ports, for a peric of five years, shall, npon a satisfactoi examination before either of therespeo ive boards of commissioners, be entitle to reoeive from said board a full brant or license. SEO. 5. The said reBpeotive boards pilot commissioners shall give to the a; plioants approved by them either limited license or branoh, or a fi license or branob, according as the a plication and discovered fitness of tl applicant sh all be, signed by a majori of the examining board, or by thc chairman, as the majority of said boa may direct, requiring of each applicat before the delivery to him of snob licen or branch, to swear and subscribe to t following oath, to be administered the president of the board, to wit: . A L, do solemnly swear (or affirm) tba will well and faithfully, and according the best of my skill and knowledge, ej cute and discharge the business and du of a licensed pilot or apprentice (as t case may be) for the bar and harbor Charleston, Beaufort or Georgetown, the case may be,) and that I will, at times, wind, weather and health pern ting, use my best endeavors to repair board of all ships and vessels that I B1J see and conceive to be bound for, coming into, or going out of, the port harbor of Charleston, Beaufort Georgetown, (as the case maybe,) uni that I am well asmred that some otl licensed pilot is then on board the sae And I do further swear (or affirm) the will, from time to time, and at. all tim make tho best despatch in my power convey safely over the bar of Char! ton, Beaufort or Georgetown, (as case may be,) overy vessel committee] my caro, in coming in or going ont the same; and that I will, irom time time, and at all times, truly obser follow and fulfill, to the best of my s and ability and knowledge, all such dors and directions as I shall or may oeive from the commissioners of pilot relative to all matters and things t may appertain to the duty of a pi and, further, that I will not, at the et time, be owner, part owner, nor be tereated, direotly or indirectly, in na than two boats employed in the bush of the pilotage of the bar and harben Charleston, Beaufort or Georgetown, the case may be.) So help me God.' SEO. 6. That ufter any mich pei HOI applicant shall have taken tho oath affirmation aforesaid, and subscribe! the same, tho said board of commissi ere shall require such person to exec to thom and their successors in offic bond with two sureties, to be appro by them, in the sum of five bund dollar*, if his licen so be of nico or twi * feet; or in the som of one thousand lars, if it be a full lioense; wbioh b shall be conditioned for the faithful oharge of his duties as snoh pilot; wh upon tho said board of commissioi shall deliver to such person a license be measured by bis respective draf water; enid lieense to be signed eithe the presidont of the said board, ni direction of a majority thereof, ot suoh majority themselves. Sic, 7. That the respective hoare commissioners of pilotage shall 1 power and authority, for any caue oharge, to them satisfactorily prove? order and direct any or all pilots, their respectivo bars and harbors, tc liver np his or their license or licei And to tnke out n new license or licet bat no pilot who sholl satisfy them of the falsity of any such charge brought against him shall be required to pay au additional foo for his now license; and it shall bo the duty of tho said respective boards of commissioners to lay before the Coonty Commissioners of their re? spective Counties, immediately after the execution thereof, all bonds given by pilots; and if the said County Commis? sioners be not satisfied with tho security on suoh bond, every pilot whoBe sureties shall be deemed insufficient, shall givo a new bond, with such sureties and within suoh time as shall be approved or de rounded by the said County Com mis? sioners, in whioh caso the pilot shall J e oeive a new license on surrendering his former one. And every pilot not com? plying with these conditions, or any of them, Bball forthwith forfeit his license, and sholl be disqualified to act as pilot at oitber of the respective bars or har? bors aforesaid, for the period of twolve (12) months. The number of pilots for either of the bars or harbors above named shall be determined by the re? spectivo board of commissioners afore? said: Provided, That said board of com? missioners shall make no distinction ic tho selection of pilots on account ol race, color or previous condition. SEO. 8. The majority of the respective boards of pilotage aforesaid shall have power and authority, in their respcotiv< jurisdictions, to take away tho license o a pilot for a given time, or to dec?an his license null and void, as the natur? of the case may demand, upon charge o any dereliction of duty made and prove? against him; but eaoh and overy pilo against whom any charge shall be mad shall be entitled to a hearing before hi board of pilot commissioners, and t make any proper defence to suoh charg before said board of commissioners; an if any pilot has forfeited his license, o is no longer entitled to the use of hi I license, by virlne of this or nny othe clause of this Act, the commissioners c pilotage shall have the power to ords the harbormaster of their respeotn harbors to call on him for tho enrrend< of his license; and if he shall refuse t give np the same to the harbormaster i on demand, the latter shall notify fi one week in the publie daily papers, < for three weeks in the public weekly p pers of his respective harbor, that sue person has no longer a right to net as pilot until he be re-instated by tho boa: of commissioners. SEO. 9. No pilot shall discontinue not for three months, nor shall he abse I himself at any time from his respecti port or harbor, without permission fro the commissioners of pilotage of 1 said port or harbor, nor shall any pi! hire out his pilot-boat to any person persons whomsoever, unless he sabs tute another boat, to bo approved by t commissioners aforesaid. But the sc commissioners shall never givo snob pi I mission unless, in their opinion, th( shall be a sufficient number of boats i tnally engaged in the service of pilotai Nor shall any pilot substituto or empl as a pilot any one from whom licet has been taken away, or become f I feited, as aforesaid; and any pilot ben in anywise offending shall, for each a every such offence, be deprived of license hythe commissioners, oran Monty of them, and if so deprived, shall be proceeded against as provk in the latter part of the preceding ti tion of this Act, and shall moreover f feit and pay to the State a sum not oeeding one hundred dollars. SEO. 10. That in oase of war no pi shall bring in or furnish supplies to i armed vessel belonging to an enem\ war with tho United States, or si carry out any armed vessel to snell o my, without being ordered to do BO the constituted authorities of the Uni States; and every pilot herein in a wise offending shall forthwith forfeit license, and bo disqualified forever a from acting asa pilot; and if, at : time, the President of tho United Sta or the Qovernor of the State, shall | hibit to furnish with supplies, oi J bring in or carry out any vessel or i sols belonging to any nation or State toa subject or subjects of any natioi i State, it shall be the duty of every pi i for either the bars or harbors heron fore named, to comply with every s prohibition, on pain of incurring same penalty and punishment as for offence in timo of war. j SEO. ll. That overy pilot cruisiu standing out to sou, shall offer services first to the vessel nearest to bar, except when he sees a moro dis vossol in distress, under a penalty of dollars, for each aud overy such nef and refusal, either of approaching nearest vessel, and of boarding he required, or of aiding any vessel sho\ signals of distress in the case above r tioned; and the commissioners of p age, or a majority of thom, may, at t discretion, deprive tho said pilot ol license: Provided, however, That not! herein contained shall extend, or construed to extend, to vessels of description mentioned in tho prece seotion, all of which vessels it sha the duty of every pilot to avoid as n as possible, whenever they aro know or justly suspected by, him ns suoh. SEO. 12. Whenever tho Qovernc the State shall issue a proclamation Meeting vessels from certain port countries to quarantine, lt shall be duty of ovory pilot conducting ony j vesHcl over the bur of the ports a named to bring her to the quarantine ground, and to remain on board, or go to the lazaretto, without coming up to the port until tho port physician shall permit it; and during the timo for which any snob pilot remains on board any suoh vessel, or stays at the lazaretto, he shall be allowed four dollurs for each nud every day of his remaining ou board or staying at tho lazaretto as aforesaid, and be foand in necessary provisions aud accommodations, at the expense of tho master, owner or consignee of such vossel. And every pilot neglecting or refusing to bring any such vessel to the quarantine grounds, or coming to the port without previously obtaining the port physician's permission, or before the time limited by the said port physi? cian, shall, for each and overy suoh offence, be deprived of his license, and Bhall not obtain another license before the expiration of one year, and forfeit and pay the sum of fifty dollars tc th< State. SEO. 13. The pilot ground shall extenc from euch of the bars above named thirty miles Eastward, Southward and West ward, and any master or commander o a vessel bearing toward either of san coasts or bars (all coasters aud othe vessels trading between any ports withii this Statu excepted) who Bhall refuse t receive on board a licensed pilot, wh shall offer to board, Bhall be, and i hereby, made liable? on his arrival o either af the said ports, to pay the pile who first offered to go on board and tak charge of suoh vessel the rates and fee allowed and established as horeinaftc mentioned, us if suoh pilot had aotuall brought in such vessel to either por Provided, however. That if a pilot ha1 ing a nine or twelve-feet license only, i the oaso may be, ia refused by the ma ter of a vessel of greater draft, sue master shall not be liable to him for bi pilotage: And provided, also, That if pilot refuse to produce his license to tl master of a vessel, when the latter d mauds it, the fees of pilotage shall n be charged against the master ceglectii the services of such pilot. SEO. l?. That any pilot boarding vessel on pilot ground shall bo enlitli to receive from the master, owner consignee, four dollars for every day his being on board previous to h coming into port, in addition to the fe of pilotage hereinafter established. TL every pilot of an inward bound veso who shall be directed by tho master anchor in the roads, and afterwai bring her into port, shall bo entitled receive four dollars from tho roast owner or consignee; also four dollars bring a vessel anchored in the stream the request of tho master, owner or c< sign?e) and moor her at the wharf; fe dollars to unmoor (at the request of I owner, roaster or consignee) and nncl in the stream, or from the stream to I roads, to be paid us aforesaid. SEC. 15. That tho pilot who brotij in the vessel shall have the exclus light of carrying her out, unless master or commander of such vet shall, within a fortnight after his arri in port, prove to tho satisfaction of pilot commissioners at said port, o majority of them, that tho tame p hud misbehaved during tho time ho 1 charge of suoh vessel, or unless the e pilot shall have been deprived of license bofore the departure of s vessel; in cither of which cases auot pilot may bo cmplt yed, who shall bo titled to receive tho outward piloti And every pilot having or becoming titled to carry out a vossel shall eil attend in person or procuro another j. of his own degree to attend for hine such outward bound vessel ofter twi hours' notice by thu master, by hoisting of his junk at tho?orotop-m head, lor that time, during daylij But if such pilot should neither att in noison, nor substitute another pen pilot of equal degree with himself, master of such vessel shall bo at libe after tho expiration of tho above lim space of time, to employ another j of equal license, who shall bo bouu not previously engaged, to carry t vessel out, and who bhall bo entitle tho outward pilotage. Anil any j who shall carry out a vessel, not b entitled to' do BO, shall be liablo tc pilot who had tho right in the aim of pilotage paid or duo for carrying out. And any pilot who brought vessel shall have a right to d?niant fees of pilotage, und tho lawful chm as aforesaid, before her departure ! port. And whenever a pilot, hnvi right to oarry out n vessel, is appro sive that his fees of pilotage rouy ni paid by her muster, owner or cousip he shall have a right to denni id his in advunco, or such security for the ment thereof ns shall bo reason a bk satisfactory; and, on failure the may refuse to carry lieront. SEO. Iii. That the foregoing pro? hibition shall not extend to prevent any person from assisting any vessel in dis? tress, without a pilot on board, if such person shall deliver up such vessel to the first pilot who shall afterwards como on board ?.nd offer to conduct such vessel; and, also, that the captain and crew of a vessel shall not be liable to such fine for conduotiug her over the bar without tho aid of a pdot if, in either of the two Inst mentioned cases, a signal for a pilot is worn. SEC. 17. That every master of an oat ward bound vessel shall, at the appoint? ed timo of his departure, have his ves? sel in readiness for Bailing, nod, as a signal thereof, hoist a jock at the fore top-masthead; and overy master of a vessel who shall detain a pilot, at the time appointed, so that ho cannot pro? ceed to sea, though wind and weather should permit, shall pay to such pilot four dollars por day during the time ol his actual detention on such vessel. SEC. 18. That if any master or com? mander of a vessel shall carry off any ol tho pilots for either of tho bars or har bora aforesaid, he shaii ailow every suol pilot four dollars for each and overy daj during his absence, and supply him witt provisions and other necessaries in th? same manner as is usual for tho mainte nance and accommodation of masters o vessels, and the master, as well as tin owner, consignee and security of sucl vessels, shall be liable for the aforesai? sum: Provided, however, That no pilot who is carried off as aforesaid, shall b entitled to any of the sums aforesaid, i auch vessel shall have laid to for tb space of sixteen hours after bavin creased tho bar, and no pilot boat sba! have appeared at tho time to rocciv such pilot on board: Provided, alec That the master, owner or cousigne shall defray the expenso of such pile back to either of said ports, as the eas may be. SEO. 19. That tho owner or owners < overy pilot boat, or pilot or pilots wh may hire such boat, or may be employe thereon, shall cause such number to t put on tho most conspicuous place i each boat's main and foresail, as may I designated by tho harbor-master of tb respective port, and thu figures desij i eating tho number of tho boats, as afor said, s frail bo ut least five feet in longtl and bo made to appear ns conspicuous i possible, by being placed on each side , tho main and foresail of overy boat use in tho pilotage; and every pilot omittit or neglecting to number tho boat i i which ho may be interested, shall, < conviction beforo tho commissioners pilotage, be deprived of his licene und shall, iu addition, bo liable to pay , Quo of one hundred dollars. . SEC. 20. Tho rospectivo eoiumiss ors of pilotage shall have power mid i thor i ty to prescribo to the several p \ of their respective ports such orders i regulations, not inconsistent with \ Act, us to them, or a majority of tl nay appear suitable and prnpir. any pilot neglecting or refusing to con? form to any euch orders or regulations, s?mil forfeit and pay, for each offence, the sum of fifty dollars. SEO. 25. That the harbor ma?ter o? each of the aforesaid harbors shall be bound to keep constantly a complete re? gister, specifying the licenses of all the pilots (with their residences) of his re? spective bar and harbor, and of all boats to which they aro severally attached, aod tho name, number and thc owner or owners of the same; and also to register noy change or alteration that may take place in either of the nbovo particulars; which change or alteration the pilots aro hereby required, from time to time, to report to the harbor-master of their re? spective port, as they may occnr, in order that masters of vessels or persons inte? rested may have it always in their power to know from him at once who are tho responsible persons on board of each boat, and thereby obtain such informa? tion as they may find necessary. And every pilot or owner of a pilot boat ne? glecting or refusing to report, os afore? said, shall, for each omission, forfeit and pay a fine not exceeding fifty dollars. And it shall bo tho duty of said harbor? master, on tho first Monday of each month, to report to the commissioners of pilotage a register as above specified, and also such pilots as may have neglected or refused to comply with tho foregoing re? quisitions. And the said harbor-master shall furnish every master of a vessel coming to tho harbor-master's oflioo with a copy of this Act, for the purpose of perusing it at said office, without charg? ing or being allowed to charge any fee or perquisite for any or either of the afore? said services. And for every neglect of duty in the premises, the said harbor? master (of eithor of the aforesaid ports) shall forfeit and pay a sum not exceeding fifty dollars, to bo imposed by the com? missioners of pilotage at his respective port, and deducted from his salary. SEO. 2G. That it shall bethe duty of the commissioners of pilotage of either of tho ports aforesaid, on the occasion of any marino disaster to any vessel in charge of a pilot of their respective port, to make a oareful examination of tho cause or causes of such disaster, by immediately summoning before them the pilot in charge of the vessel, and obtaining such testimony from the par? ties interested or not, as the case may be, in their powers; and the result of such investigation shall be placed npon record, copies of which shall be fur? nished, when desired, at the exponso of the applicant. Tho marine reports of tho daily papers, or private information, shall be deemed sufficient cause for such investigation by the commissioners of pilotage. SEO. 27. That each and every Qne, for foituro and penalty for each and every offonco against this Act, or any part, cluuso or article, shall be prosecuted, sued for and recovered in any court of competent jurisdiction, for the use of tho State. And the ponalties imposed in this Act shall, in every case, bo reco? vered, although tho commissioners of pilotage may not think propor to deprive the pilot in default of his license in any instance herein authorized. And the commissioners of pilotage now in office shall act as such until tho appointment of others, under tho provisions of this Act, and shall exercise all tho powers vosted in tho commissioners of pilota; e under tho provisions of this Act. SEC. 28. Tho members of tho respect? ivo boards of commissioners herein pro? vided for shall hold their offices for two years, un less sooner removed by tho Governor. When a vacancy occurs, a new appointment shall bo mudo for the full term. SEC. 29. This Act Rhall not bo con? strued to interfere with tho rights of any pilots who nlreudy hold eil her a limited or full branch or license; but all such pilots, after the passage of this Act, shall bo subject to all its penalties and forfeitures, and entitled to all its privi? leges and immunities. SEC. 30. That all Aots, or parts of Acts, inconsistent with the provisions of this Act, and nil ordinances, or parts of ordinuuecs, iu conflict with or inconsist? ent with tho provisions thereof, be, and the samo aro hereby, repealed.
