'2. Be u./drifter ordained, That any. person liable to work : on the .streets' as aforesaid, who shall pay the tax or sum annually flied by the oriUnouce to raise supplies, as an exemption from v street work) shall be so exempt during tho timo for which he shall BO pay; and any person so liable to work on tho streets, who shall come to reside, in the city at any intermediate time between the annual periods fixed for the payment of the said tax, shall pay in proportion to tho. time ho shall so resido or come to reside in the city, before the next annual period for tho payment of said lax. '" SEO. 3. lie it further ordained, That it shall-not bo lawful tu obstruct or enclose any street or parts of any street without tho ' consent of tho City Council; and any person offending herein shall bo subject to a penalty of twelve dollars per month for every month such obstruction is continued or kept np. SEC. 4. lie it further ordained, That all persons who shall enclose .any street, or part or parts of streets, in the city of Columbia, by aud with thc consent of tho City Council, shall pay an annual tax of five dollars on any street or part of any street so enclosed, or such other price or sum as may bo fixed and determined by the City Council; but such street or part of any street so enclosed by tho .consent of the City Council, may at any timo be opened by tho order of the said City Council, anything to the contrary herein notwithstanding. SEC. 5. Be it further ordained, That it shall not bo lawful to mako 'any fire or fires in any of the open streets of the city of Columbia, except for tho purpose of cleaning said streets by the Chief of Police or under his orders; and any person offending herein shall be subject to a penalty of fivo dollars for each and every offence: SEC. G. Be it further ordained, That no wagoner or wagoners shall encamp in any of the streets of tho city, under a penalty of five dollars for each and every offence; and it shall be tho duty of the city police to report all violations of this ordinance. SEC. 7. He il further ordained, That the distance of twelve feet from the outside of each street, measured toward tho centre of said street, shall bo considered thc sidewalk or pavement; and at the corners of all streets these lines are to be extended to their inter? section. SEC. 8. Be it further ordained, That persons who shall bc engaged in building or repairing any house shall bo allowed twenty-five feet bet\veou the outer edge of tho sidewalk and tho middle of thu .street, (provided they do not obstruct tho drain,) for the temporary purpose of placing tho necessary timber or other building materials. SEO. 9. Be ii further ordained, That any person who shall deposit any lambor, wood, brush, bricks, stone, dirt, wagon, cart, carriage, chair, sulk ey, or other wheeled carriage, or shall suffer the same to be deposited before his or her door, except in case of building or repairing, as above provided), shall bc subject to a penalty of fivo dollars, if such lumber, carriage, &c, bc suffered to remain longer 'than six hours, and one dollar for every additional six hours such lumber, carriage, &c, be suffered to remain; and if said penalty bo not immediately paid, the article or articles, thing or things, so allowed to remain, shall bo seized hy the police, and after being advertised for two days at the market, shall be sold for thc payment of said penalty; and the overplus, if any, shall be paid over to tho owner. If the owner or occupant of any house or tenement permit any of tho above-mentioned things to remain before his or her door for more than six hours, without giving notice to ono of thc police? men, he or she shall bo presumed as consenting thereto. SEC. 10. Be it further ordained, That all owners of lots in tho city of Columbia shall each repair, mend and keep, at his or her own expense, tho sidewalk butting on his or her lot, according to Such directions as the Mayor and Aldermen may, from time to timo, give; and any person "neglecting or refusing to do so, after ten days' notice, shall forfeit and pay tho sum of teri dollars ($10) for each and every day he or she shall or may so refuse or neglect; and it shall bo the'duty-of tho Chief of Police, after the expiration of said notice, to causo said sidewalk to bo levelled or repaired at tho expense of tho owner of tho adjoining lot, which expense, when . approved by tho Mayor and Aldermen, shall be collected in the : saJtM? manner as thc tax upon real estate, af tersen days' notice to the party concerned. .'.?'. SEC. ll. lie it further ordained, That no person shall make or repair any cellar door in any street which shall extend more thnn five feet from tho foundation of tho building to which it is appur? tenant^ or more than one inch above the surface of thc adjacent ground or pavement, or which shall have an insecure or unsafe door, nuder a penalty of ten dollars for each cellar door and for each day it may be suffered to continue; nor shall any cellar door ,:joif*"any street'or pavement be kept open at night, except whilst actually in use, under a penalty of ten dollars for euch und every offence; and it shall bo the duty of the Chief of Police, or his assistants, to give notice when cellar doors may need repairs; and if the same be not repaired within two days after such notice, it shall bo the duty of the said Chief of Police to cause the same tc be repaired at the expense of the owner or occupant of thc promiso3, to ba recovorod as above provided for repair of pavements. SEO. 12. Be il further ordained, That it shall not bo lawful foi any person to obstruct the pavements or sidewalks with barrels, boxes, or with any article of merchandise; and no such barrel, box or other article of merchandise shall be placed on the edge or sidi of the pavement next tho street, or in tho street; but thc same, il placed upon the pavement at all, shall be placed on the side neil the wall of the adjoining store or building, and shall in no case Ix allowed to extend moro than three feet therefrom; and any pcrsoi: offending herein shall forfeit and pay for each and every offence tin sum of five dollars. SEO. 13. Be it further ordained, That it shall not bo lawful to driv< any wagon, cart, or othor carriage, or to ride or lead any horsi across or upon any open brick drain, within tho corporate limits o the oity of Columbia, except at the bridges or other places provide? for crossing said drains, under a penalty not exceeding twent; dollars for each and every offence. SEO. 14. Be il further ordained, That it shall not bo lawful wil fully to drive any wagon or other carriage, or to ride or lead an; . horse or mule, or suffer them to stand upon any pavement, excep in cases of absolute necessity; and any person offending hcrcii . shall bo subject to a fino of not less than ono dollar, nor moro thai forty-five dollars. SEO. 15. Be it further ordained, That if< any porson shall cn i down, kill, or wilfully damage any troo, natural or transplant?e growing in the Btreets of Columbia, or shall -wilfully destroy, injan . or remove any post, railing or box, used or erected for the purpos of protecting such trees or tho sidewalks, such person shall bo sub ! ijeot to a penalty not exceeding forty-fivo dollars for each and ever offence. Be it f wilier ordained, That it shall ?be. tmlarvial for any person or persons to build or orcct any steps, porch, stoop, or other obstructions upon any of the sidewalks of the city ; and any person offending herein' shall bo liable to a fine of teu\dollars ($10) for eacli and every day such' steps, porch or stoop,'or o thor obstructions, shall bc allowed to remain on any sidewalk, after notice tb remove the same, such fine to bo imposed by tho Mayor after trial and con? viction before him. AN ORDINANCE TO ANNEX NEW TERRITORY TO THE PRESENT WARDS OE THE CITY OK COLUMBIA. WHKUKAS, by an Act of tho General Assembly, approved February 2b\ 1870, certain territory therein named to the North and East of its present boundaries iu these directions, was added to the territory of tho city of Columbia, and by an Act of the said General Assem? bly, approved March 2, 1871, amending tho said Act, thc Mayor and Aldermen thereof are authorized and empowered to incorporate tho said territory into the wards thereof, us they aro now laid out; therefore, Be. il ordained, by the Mayor and Aldermen of the City of Columbia, in Council, assembled, and hy the authority of the mme, That ail that portion of the said lately annexed territory, situated between tho Northern line of Lower street and the Southern line of Lady street, projected to thu present extended Eastern boundary of the said city, shall be added to Ward No. 1, and, with its present terri? tory, shall constitute Ward No. 1; that all that portion of the said* newly annexed territory, situated between the like lines of Lady street and Plain street, projected to the said Eastern boundary, shall be added to Ward No. 2, and, with its present territory, shall constitute Ward No. 2; that all that portion of the said newly acquired teni tory, situated between the like lines of Plain street and Blauding street, projected to tho said Eastern boundary, shall bo added to Ward No. 3, and, with its present territory, shall con? stitute Ward No. 3; and that all that portion of the said lately aunoxed territory, situated butweeu Blanding street and the extended Northern limit of tho said city, projected likewise to the said Eastern boundary, shall bo added to Ward No. 4, and, with its present territory, shall constitute Ward No. 4. Be it ordained, hy the Mayor and Ahlermen of the City of Columbia* in Conned assembled, That from ami after tho passing of this ordi? nance, if any person or persons shall, within the corporate limits of the city of Columbia, rent, lease or let to hire any room or other place for public exhibition to any person or persons, or shall per? mit such room or other place of public exhibition to be occupied as a place for public exhibition for gain, before the person or persons j so occupying tho same shall have procured a license for such public exhibition, signed by the Mayor and countersigned by the City Clerk, such person or persons so offending shall be subject to a penalty of twenty dollars for each and every day such porson or persons shall so offend. (Signed) JOHN ALEXANDER, Mayor. WM. J. ETTEII, City Clerk. AN ORDINANCE REOULATINO AND ESTABLISHING THE FIRE DEPART? MENT or THE CITY OF COLVMIHA, S. C. SECTION 1. Ile it ordained, by the Mayor and Aldermen of the City nf Columbia, in Council assembled, and hy the authority of thc same, That on and after the passage of this ordinance, the fire depart? ment of this city shall be composed of the regular chartered fire engine and hook and bidder companies now existing, or which may hereafter bo regularly organized, having been duly chartered by tho Legislature of the State. SEC. 2. Be it further ordained, That the officers and members of the fire department, recognized as such by the City Council, when in active service as firemen, (a roll of whom shall be deposited with thc City Clerk,) shall be exempt from head and street tax. Sr:c. 3. fie it further ordained, That the Presidents and vice-Presi? dents of the several companies comprising the fire department of tho city shall constitute a Board of Fire Masters, whoso duty it shall lie to take charge of and regulate all matters appertaining to the department, including tho organization of a powder company, subject to the supervision of the City Council. SEC 4. He it further ordained, That the Board of Fire M asters shall have power to elect one of their members as President, and may elect a proper person as Secretary, outsido of said board, who shall keep a book of records of the transactions of the board. SEC. fi. Ile il further ordained, That tho Board of Fire Masters shall, at a r?gulai* meeting of their body, held for the purpose, in tho month of January of each and every year, elect a Chief and an Assistant Chief Engineer of the fire department of tho city. SEC. G. Beit further ordained, That tho Chief Engineer sholl have supreme control over the several companies of the department while nt any and every firo that may take place within thc limits of the city. SEC. 7. Ile it further ordained, That tho Assistant Chief shall assist tho Chief iii carrying orders and in regulating tho duties of the department at a fire, and, in the absence of the Chief, shall have full control. SEC. 8. He if further ordained, That tho Chief shall, at least once in each and every year, report in writing to the City Council a full statement of tho officers of the department, the number of fires, causes and probable damage, the working force. Dumber of feet of hose, and such other statistics as will convey a clear idea of tho strength and efficiency of the department. SEC. 0. He it further ordained, That all ordinances and parts of ordinances heretofore passed in relation to the firo department bo, and tho saino aro hornby, repealed.
