Aldermen of the Oily pf Ool?Tnbia, in Council That it shall bo the duty of the Committee on tho Mark ot to set off and. assign the several parts of Baid market house for the sale and exhibition of different articles respectively; and the Btalls in the ?aid market house shall be lensed by the Clerk of the Market upon such terms and in such manner us the said Committee on the Market shall direct. SEC. 2. That the office of Clerk of tho Market shall bo continued as heretofore, and shall bo oleeted when and in the same manner as tho other city officers are, who shall hold his office by tho Kamo tenure; that tho said Clerk of tho Market shall bo required to give bond to the city of Columbiu in the penal sum of two thousand dollars, with two or more good sureties, to bo approved by the City Council, conditioned for tho faithful performance of his duties as Clerk of the Market. His duties shall be such as are herein pro? vided, and as may hereafter be required and proscribed by the City Council. His salary shall bo six hundred dollars ($000) peranuum, payable quarterly. SEC. 3. That all persons bringing to maiket beef, mutton, pork, veal or fish, shall be compelled to bring such articles to the market house, and romain there during market hours, when, after paying the required tax, they shall be furnished with a certifi? cate of license from the Market Clerk; and any person or persons failing to procure such certificate, shall be liable to a fine of five dollars for each and every offence. In case any person or persons shall bring or offer for sale any beef or other fresh meat in or about tho market house, or in the streets of tho city, BUflh person or per? sons (other than persons paying stallage) shall pay for each hcef seventy-five cents; and for each veal, sheep, hog or goat twenty-five cents; and, on refusal to pay the same, shall be lined two dollars for each and every offence; and any person who shall sell any beef * or other frosh meat elsewhere in tho city than at the market dining market hours, or without the requisite license, shall bo subject to u penalty not exceeding five dollars for each and every offence SEC. 4. That the market house shall he kept open for the sale of all marketable articles every day, (except Sunday,) during market hours, which hereofter shall be every morning in tho months of December, January and February, from 4 o'clock A. M. until 10 o'clock A. M.; in the months of March, April and May, and in tho months of September, October and November, fi om 4 o'clock A. M. until 9 o'clock A. M.; and in the months of June, July and August, from 4 o'clock A. M. until 8 o'clock A. M., as to all meats; and for fish, eggs, chickens, fruit, &c, until sunset, except Saturday night, when tho market shall be kept open until 9 o'clock P. M., except in the months of June, July and August, during which tho market shall be kept open until 10 o'clock P. M. SEC. 5. That no person or persons shall be permitted to monopo? lize the stalls or stands: Provided, That this shall not be construed to prohibit nny person occupyiug a stall or stand from renting a vacant stall or stand, when there shall be no other applicant for the same. SEC. G. That persons occupying stalls or stands, after using the sunni, shall be required to have the same thoroughly scoured and cleansed daily; and on failure to do so, such person or persons shall pay a fine of five dollars, and be prohibited from using or occupy? ing such stall or stand until said fine be paid. SEC. 7. That all articles sold in or near the market house by weight shall bo weighed with scales; and any person detected selling in thc market house any article or articles weighed with steelyards, or with scales unjustly balanced, or of using false weights, shall bo fined not less than ten and not exceeding twenty dollars; and any purchaser who shall consider himself aggrieved with regard to weight may make complaint thereof to the Clerk of tho Market, who thereupon shall cause the article whose weight is disputed to be reweighed, and his decision thereon shall be final. SEO. 8. That no diseased or unsound meat shall bo offered for sale, under a penalty of twenty-fivo dollars for each and every offence; and it shall bo the duty of tho Clerk of tho Market to seo that no such diseased or unsound meat is offered for sale in tho market or elsewhere in the city, and to inform against all offenders. SEC. 9. That the supervision of the market house shall hereafter devolve upon the Clerk of tho Market, whoso duty it shall be to have said market house lighted up every Saturday night until 9 o'clock P. M., and until 10 o'clock P. M. in tito above named months of May, June, July and August. He shall also enforce good order .in and about the market house; he shall inspect tho weights, scales and measures used therein, and test their correctness; ho shall have tho market house cleanly swept every day, and shall enforce all the regulations embraced in this ordinance; and in case of his neces? sary absence, tho Mayor shall appoint somo suitable person to per? form his duties during such absence, at tho expense of the said Clerk. SEO. 10. That no policeman of the city shall in future bo permit? ted to act as clerk or book-keeper for any person or persons selling any commodity in or near tho market house, nor bo interested directly or indirectly in such sales. SEC. ll. That all sums of money for stallage or fines, provided for by this ordinance,.shall be collected by thc said Clerk of tho Mar? ket, and bo accounted for and paid over by him to the City Clerk; and he shall furnish the City Clerk with tho names of the persons from whom tho samo was received, and on what account, at least once in every week. And all penalties hereby provided shall be imposed by the Mayor after hoaring the evidence, and in Iiis absence by one of the Aldermen. SEC. 12. That butchers and all other persons whatsoever, renting stalls in tho city market, are strictly forbidden from chopping moats on the counters of tho market, under a penalty of two dollars for each and every offence. SEC. 1?. That no person shall smoke tobacco within tho limits of the market, under a penalty of two dollars for each and ovcry offonce. SEO. 14. That the butchers and their employees will bo required to be cleanly dressed and wear a white apron constantly, whilst attending in the market, under a penalty of two dollars for oach ?and every day they neglect to do so. SEC. 15. That oil meats must bo kept within the stalls of tho market and sold therefrom; and any offender against this section by hanging for exhibition any beef or other meats from tho outside of their respective stalls shall be subject to a fine of fivo dollars for each and every offence. SEO. 1G. That no porsou or persons shall bo allowed to rido or hitch ft horse, mule or ox undor the sheds of* tho market, or to any post or posts that may bo placed thereabout, under a penalty of fivo dollars for each and every offence. SEO. 17. That it shall bo the duty of the Clerk of tho Market, or his assistant, to attend all meetings of tho Committee on Market, and record all proceedings of such meetings. SEO. 18. That no person shall buy or contract for, or caus? to be bought or contracted for, any quantity of provisions or other arti? cles usually vended in market during market hours, at the market or elsewhere in the city, without the requisite license, for tho pur? pose of speculation, or in any such quantities as to prevent others from having ari equal sh aro of tho samo, or as much thereof us the Clerk of the Market may suppose the applicant or applicants enti? tled to, according to tho supposed number of his, lier or their family, or according to the necessities of any charitable institution, under a penalty of not exceeding ten dollars. . SEC. 21. That this ordinance shall take effect from and after its ratification; and that all ordinances and parts of ordinanees, repug? nant to this ordinance, be, and the same are hereby, repealed. SECOND-HAND AUTICI.ES, JUNK, OLD METALS, AND OTHES LIKE COMMODITIES IN THE CLTY OF COLUMBIA. SECTION 1. Ile if ordained, by flu: Mayor and Aldermen of tiic City of Columbia, in Council asaembfed, and hy thc. authority of the name. That from and after the ratification of this ordinance, the keeper or keepers of every shop within the limits of the city of Columbia, where any kind of second-hand articles, junk, old metal, or other like commodities are purchased, sold, bartered or exchanged, sholl obtain from the City Council a license to do so, and shall pay to the City Clerk for .said license the sum of ono hundred dollars ($100); and such license (which shall continue for one year) shall not be transferable from one person to another, without the consent of the City (Jon ii eil. SF.?\ 2. Application for license Hhnll be made to the City Council; and every application shall be accompanied by the recoin inondation of at least three respectable freeholders, who shidl certify that the applicant is a tit and proper person to be entrusted with such a license; the person so applying shall deposit with the City Clerk tho price of the "said license, and, upon the licanso being granted, shall execute a bond in the penal sum of one thousand dollars ($1,000^ with two sureties, to be approved by the City Council, conditioned for the faithful observance of the provisions of this ordinance, and nil other ordinances hereafter passed in relation thereto. SEC. il. Every person receiving snell a license shall put np or over tho principal entrance to his or her shop a sign, designating that he or sin; is licensed, and containing his or her name; and shall keep a hook, in which shall be written, at the time of every purchuso or barter, a description of tho article or articles purchased or bar? tered for, tin; name and residence of tho person or persons from whom received, and the day and hour when such purchase or exchange was made; and such book shall be at all times open to the inspection of thc Mayor of tho city, the Chief of Police, or any person duly authorized by them, or either of them, to inspect the same. SEC. 4. Such shops shall not be kept open for tho purchase of an}' of the articles mentioned aforesaid, nor shall any purchase bo made by the keeper or keepers of any such shops, or by any person or persons for them, except between sunrise and sunset; and said shops shall be open at all times to the inspection of the Mayor of the city, the Chief of Police, or any person duly authorized by them, or either of them. SEC. 5. ?No keeper of any such shop shall himself, or through any tither person, either directly or indirectly, purchaso or receive, by way of barter or exchange, any of the articles mentioned afore? said, from any minor or apprentice, without the written permission of the parent, guardian or master of any such minor or apprentice, which written poMuission shall he filed, and produced whenever required, by any one authorized to inspect such shops. SEC. (>. Every person having obtained a license', who shall violate any of the provisto s of this ordinance, shall forfeit the samo, and, upon conviction thereof, shall pay a fino of not less than ten dollars ($10), nor more than fifty dollars ($50); and every person keeping such a shop, and carrying on business therein, without having first obtained a license to do so, shall pay a fino of not less than fifty dollars ($50), or more than one hundred dollars (100); all of which fines shall be recovered in the City Council, and sharl be disposed of as follows: One-half to the use of the person who sholl prosecute the offender to conviction, and tho remainder to the uso of the city. SECTION 1. ///.* it ordained, by thc Mayor and Aldermen of thc City of Col umina, in Council assembled, That hereafter no blacksmith shop shall be erected on any square terminating on Richardson street; and that tho blacksmith shops already erected on said squares shall hereafter only bo worked by the consent of the Council, and shall be subject to such conditions, restrictions and safeguards as the said Council shall from time to time impose SEC. 2. And IM: it further ordained, That no blacksmith shop shall bo erected and worked within tho corporate limits of the city of Columbia, unless notice thereof shall be given to thc Council, and tho consent of the Council obtained; and that all blacksmith shops, within the corporate limits, as well those already erected as thoso hereafter to be erected, shall be constructed in such manner as not to be liable to communicate fire to tho adjacent buildings, and sholl also be subject to such regulations, restrictions and safeguards as the said Council shall from time to time impose. SEC. ?1. And be it further ordained, That any person offending against any of the provisions of this ordinance shall bo subject to o penalty not exceeding ten dollars, and that each day's violation shall be considered a .separate offence. SEC. i. Ile. il f nether ordained, That this ordinance shall take effect from and after thc ratification thereof.
