But pre? cisely because it strengthens Franco and pacifies Paris does it menace tho "per? sonal empire" with final dissolution. Qen. Troohu is a man of great military genius and ability, who has been kept as for in the back-ground as his surpassiug abilities would permit, because ho has never given his cordial support to tho Imperial Government. He is neither a Republican nor a royalist as such, but a soldier who understands tho principles of liberty sufficiently to regard them as the sole foundation in modern times of durable national strength. In the event of victory over the invaders, he will become the irresistible standard-bearer of a really free and responsible administration of the Government. Meanwhile, aud ns a military measure only, his command of Paris assures to Marshal Bazaine the fullest and most persistent reinforcement of his armies at Chulons. Tho two com? manders are in constant communication by telegraph; and Paris, under Trochu, is made a part of the mighty forces fighting for France at Chalons under Bazaine.-Hew York World. Mr. W. is a gen? tleman of high respectability, and during the prevalence of tho cholera in St. Louis, watched tho result of the application of the Fain Killer for this diseaso, and his testimony can be reliod upon with tho utmost confidence: DEAR Sm: You recollect when I saw you in January last, my expressing to you my most sanguino expectations that Davis* PAIN KILLER would havo a tremendous sale in Hie West this season, and my anticipations have been more than realized, and tho testimony of thousands who hove used it has been that they would not be willing to go to bcd at night without it in tho house. On tho appearance of tho cholera in this city, Buch was tho coD?donco in thc Pain Killer as a remedy, that many who purchased it remarked to mo that they bad no fears or dread of tho cholera, as long aa they hud thc Pain Killer by them, and hundreds took it1 daily as a preventative, for no person can have a doraugemcnt of tho bowels or diar? rhoea, if they uso thia modicine. This was the security and confidence of hundreds acquainted "with it, and when their friends wore attacked with tho Cholera, they would administer tho remedy in largo quantities, and In every caso when it has been taken in any of the first stages of this disease, it hus proved successful. I consider it an infallible remedy. I have not beard of any individual in any family who need tho Pain Killer when attacked, but speedily recovered. The clerk informed mn that ho administer? ed it to persons when cold or in the cramps, and it gave immediate relief, but still it should bo given quickly, for when tho dis? charge of "rico water" bas begun, the hone of life has fled. Should thia disease make its appearance among you, as in all probability it will, bo not alarmed; you and all others there have the remedy, and I am confident if the Pain Killer is used, not a singlo death by cho? lera will occur in your city. SEC. 072. When, by tho terms of Sec? tion three hundred and sixty-uine, tho appellant is entitled to a new trial iu tho Appellate Court, ho shall, at tho timo of making the appeal, aud in all other cases, if ho desires nstay of execution of the judgmeut, givo security as provided iu tho next Section. SEC. 373. Tho security shall be a written undertaking, executed by ouc or moro sufficient sureties, approved by thc court below, to tho effect that if judg? ment bo rcudercd against the appellant, aud executiou thereon bo returned un? satisfied, in whole or iu part, tho sure? ties will pay tho amount unsatisfied. SEC. 371. Tho delivery of tho under? taking to tho court below shall stay tlx issuing of execution; or, if it have beer issued, tho service of a copy of th? undertaking, certified by tho court be low, upon tho officer holding tho exe cution, shall stay further proceeding thereon. SEC. 375. Where, by reason of th< death of a Trial Justice, or his remova from tho County, or auy other cause, tin undertaking ou tho appeal cannot bo do livered to him, it shall bo filed with thi clerk of tho appellate court and notio thereof givcu to tho respondent, or hi attorney or agent, ns provided iu sectioi three hundred aud fifty-four, it shal thereupon have tho same effect as if de livered to the Trial Justice. SEC. 37G. Wheu, by reason of th death of a Trial Justice, or his abseuc from tho Count}*, or any other cause, th notice of appeal cannot bo served as prc vided by section threo hundred an seventy, it may be served by leaving th same with tho clerk of the Couuty. SEC. 377. The court below shall there upon, after ten dsys, and withiu thirt days after service of tho uotice of ai peal, make a return to tho Appellat Court of the testimony, proceedings au judgment, and file the same iu thu A] pellatc Court. Tho return may bo con polled by attachment. SEC. 378. When a Trial Justice, whom a judgment appealed from v rendered, shall have gone out of oil beforo a return is ordered, he sin nevertheless, make a return i si tho sa manner, and with the like effect, as if were still in office. SEC. 879. If the return be defeeti the appellate court may direct a furtl or amended return as often as may uocoseary, and may compel n com pliai with its order by attachment. And court shall always bo deemed open these purposes. SEC. 380. If a Trial Justice, wh judgment is appealed from, shall die, come insane, or remove from the Sh the appellate court may examino \ uesses on oath, to the facts and circt staucesof the trial or judgment, and termino the appeal, as if tho facts 1 been returned by tho Trial Justice, he shall have removed to another Cou within tho State, the appellate c< maj' compel him to make the return if he were still withiu tho Couuty wi the judgment was rendered. SEC. 381. If a return be made, the appeal is from a judgmeut win? now trial may uot bo had, as provi by this chapter, it may bo brought heming, upon uotico by either part; uot less than eight days.
