NEW YORK, March 23.-Mr. Pea? body, who has been here attending a meeting of the Trustees of the South? ern Education Fund, gave a dinner, last night, to General and Mrs. Grant and tho trustees. A largo number wcro present. At the closo of the banquet, Hon. Wm. Aiken, of South Carolina, moved, and Hon. Wm. A. Graham, of North Carolina, seconded, a resolution highly laudatory of Mr. Peabody. WASHINGTON, March 23. -A. H. Garland, ex-member of the Confede? rate Congress, and whose case brought ! out an opinion of the Supreme Court j abolishing the oath to attorneys, is j here. He will apply for a seat as j Senator from Arkansas, and, on his rejection, will bring the matter be- j fore the Supreme Court. NEW YORK, March 23-9.30 A. M. j Winter Garden and the Southern | Hotel are burning. A later despatch ? says Winter Garden was c.ti rely de? stroyed, together with Booth's ward? robe. The Southern Hotel was badly damaged by water-loss $300,000. Tho Confederate ram Virginia sometimes called the Merrimac-is to be hoisted with a torpedo! Messrs. Maltby <fc Co. are making arrange? ments to blow her up, and will be ready to do so by the latter part of this week or the first of next. At a public meeting in Providence, on Saturday, at which Governor Burnside presided, a committee was appointed to solicit contributions for the starving poor of the South. The St. Louis Democrats St. Jo? seph special says the Sioux City Re? misier, of a recent date, publishes a letter from Fort Union, stating that the fort was attacked by a large band of Indians a few days ago, but they were repulsed with loss, after a pro? tracted battle. The Indians were generally hostile, but tho occupants of tho fort were confident of their ability to repel any attack. Congressional. WASHINGTON, March 23. -In the House, the supplemental bill passed -the veto notwithstanding-11-4 to 25. The House failed to fix a day of adjournment. In the Senate, the supplemental bill passed-40 to 7. A concurrent resolution to adjourn on Tuesday to the first Monday in December passed. The President returned the supple? mental bill, with his objections. The bill provides for elections in ten States, for the purpose of making a constitution; but all elections, whils the original bill remains in force, come within its restrictions. Preli? minary to election, comes registra? tion, and tho unregistered cannot vote; preliminary to registration, a vague oath that the applicant is not disfranchised by participation in the rebellion; it is required that th.) ap? plicant for registration must decide this for himself. This is a fearful re- j sponsibility; for though the bill don't assign perjury, nor fix the penalty for mistaken swearing, we must not for? get that martial law pre vails, and that one and all are responsible to military commissions, without previons pre? sentment by grand juries. The mili? tary commander determines what is ^ an offence and prescribes the punish? ment. The fourth section provides that the military commander shall appoint all necessary boards of regis? tration-each consisting of three loyal persons-who maybe military officers, citizens of a State, or strangers exer? cising important functions, and vested with unlimited discretion. They de? cide questions and make returns; whatever errors or frauda they com? muait, pass unquestioued. By such measures, conventions of delegates are to be constituted. These delegates are to speak for the people. Common justice requires that tkey should have authority from the people. No con? vention so constituted will, in any sense, represent the wishes of tho people; for under itali embracing the exceptions and uncertainty which tho disfranchisement clause leaves open, tho great body of the people may be excluded from the polls; and ho deems it unnecessary to investigate further the details of the bill. No consideration could induce 'him to approve such an election law for any purpose, especially for the purpose of forming a constitution for a State. The President argues the question at somo length, illustrating that the formation of republican Govern? ments, according to Congressional ideas, may as weil commence in Ohio or Pennsylvania as North Carolina, and concludes as follows: I confi? dently believe that the time will come when these States will again occupy their true position in the Union. The barriers which now seem obstinate must yield to the force of enlight? ened and just public opinion, sooner or later, and unconstitutional and oppressive legislation will bc effaced from tho statute books. When this shall have been consummated, 1 pray God that the errors of the past may be forgotten, and that once more wo shall be a happy, united and prosper? ous people, and that at last, after the bitter and eventful experience through which wo have passed, we shall all come to know our only safety is in the preservation of tho Federal Constitution, and in according to every American citizen and every State the rights v.bioh ;that Costitu? tion secure;.
