Pierpont was invalid, on Hie ground that there was no such State-as Virginia in the Union, recognized by the Federal Go vernment or Semite as such; that Gov. Pierpont had been appointed Governor by the President, but he had no right to make such an appointment: that the Governor of New York had no legal authority to ex? patriate a citizen on the r?quisition of Gov. .Pierpont, and that we have no treaty with Virginia for that purpose. Olney was ar? rested on tho requisition of Gov. Pierpont, charged with running od" Ids vessel while under an attachment for debt.
