Mr. Avcrlll Iben applied through Ids counsel, Messrs. Wilkinson A Miles, to Judge Car penter lor a writ or habeas corpus, which was granted by the Judge and made returnable imme diately ; but nt the request, or the City Attorney ror time to prepare a return, 1 o'clock was an nounced n.s the hour to hear the case, at Judge Carpenter's house.
