The magistrate Issued a warrant charging tho
Alderman with assault with Intent to kill. Alder
man T. J. Maokcy was notified, and, shortly after
ward, appeared before! he mnglslratc. He waived
an examination, aud was required to give security
la the sum or one thousand dollars, to appear ror
trial at this term or Ihc State Court.

One Alderman yesterday, when remonstrated
with about voting for the charges against Alder
man T. J.' Mackcy K gave as his reason that his
wife might have been made a widow by that offi
cial's reckless shooting.
Mr. Charles Kanapaox has been appointed an
appraiser at large In place or Mr. C. W. Graves,
who has been appointed mall agent on the North
eastern Railroad.
Governor Scott has offered $fi000 reward for the
apprehension of "two white men," who murdered
Henry Thompson, negro, In Abbcvtl le.
Thowanrof rain Is being seriously felt. Tnc

Corbln has not received that $3000 yet.

were loud calls for "Ilowcn," "Ilowcn." In re

the window ami returned thanks for the compli
ment which the "gentlemen (Ittel of the Comet Star
Light Infantry" bad pttid him. He assured them
that he would take occasion to address" Ills con
stituents here In this very City of Charleston, ami

course. With this cheering and lifterai promise,
he excused himself rroiu any further remarks.
Another tune from the bund followed, after
which there was n discord or enthusiastic, but
wholly unintelligible, shouts tor various parties
who were wanted to make tho next speech,
finally, somebody managed to sound I he name

above the tumult, and our accommodating
Mayor poked his head from an upper
window. He spoke for about ton minutes,
opening with the mild suggestion that
some of his hearers were probably laborers?
Indeed, he would venture lo say most of them,
were laborers. Ho then launched out Into agio

labor In general, and of his own persistent and
unselfish devotion to the labor in tcrest In particu
lar, concluding with congratul?t lotis addressed
to the crowd on the great triumph which the la

These remarks, or course, were hailed with loud

again arrested, by two pollrcmcn, upon llic
charge of violating the ordinance "to prevent or
punish any person who may* exorcise, or attempt
to exercise, the duties or any municipaloinee, un
less lie shall have been duly elected to the same.''

offered to take the same bond which was required,
at the previous artest, which Mr. Avcrill declined
to give. Mr. Avcrlll Iben applied through Ids
counsel, Messrs. Wilkinson A Miles, to Judge Car
penter lor a writ or habeas corpus, which was
granted by the Judge and made returnable imme
diately ; but nt the request, or the City Attorney
ror time to prepare a return, 1 o'clock was an
nounced n.s the hour to hear the case, at Judge
Carpenter's house.

Magistrate Mackcy, and Alderman Harrow, were
present, and ihi hearing or the case was com
menced. The counsel ror Mr. Avcrlll argued that
the Mayor had no right to arrest, or order the ar
rest, of their client. The City Attorney read the
return lo the writs, nnd argued that the arrest
was legal, claiming that Mr. Avcrill had violated
the clly ordinance. ^
At the conclusion or the nrgnmcnts, Judge Car
penter decided that the arresl or Mr. Avcrlll was
illegal. Arier this decision was annotiucctl by his
Honor, Magistrale Mackey asked U Mr. Avcrill
could not be arrested again on the same charge
on a warrant Issued by a magistrate, to which
the Judge replied that the question was now In
the hands or a higher tribunal, und he would not
give an ofllclnl opinion, but he would advise that
Mr. Avcrill be let alone.
Late In the afternoon Mr. Avcrlll was rcarrestcd
upon a warrant issued by Magistrate Mackcy
at Oic Instance or M. Cauldchl. The warrant
charged him with having violated the law ratlUcd
In August, 1SG0, Imposing a penalty or fine or
Imprisonment upon all persons holding oillco by
military authority, or under the provisional gov
ernment, who exercised its duties after their suc
cessors had been appointed or elected.
Messrs. Miles A Wilkinson appeared ror Mr.
Avcrlll and clearly proved that he had not In any
way violated the law, whereupon he was dis
charged by the magistrale.
We are gratified to state that the Flour Inspec
torship troubles may now be considered at end,
for t'ie present nt least, anil we hope that Mr.
Avcrlll will not be Interfered with In the dis
charge or the duties or the office of Flour In
spector.
