A search resulted In the discovery or Powell, with six buckshot tn his leg and hip. The shot lodged In his hip was drawn ont with a piece of his shirt, which had been driven in the wound made by the missile. The other shot had not been extracted up to Sunday night. The wounds are regarded as serious, though not ncccssarUy fatal. The party who fired -upon Powell had made good his escape when as sistance reached him, so that It Is not positively stated who commute 1 the deed, except by Pow ell, who claims to be able to Identify the person." Harbormaster's Fees.?a case of importance to that portion of our Community who arc In torestcd in shipping was tried yesterday before Magistrate J. G. Mackey. The action was brought by the Harbormaster, # G. B. StuJiiard, against Captain Vau Gelder,'or the schooner D. V. Streaker, for tonnage duties undor the ordlnanco of lRii. The defence relied upon the 10th section 1st article of the consti tution, which .forbids any Stn.o without the consent or Congress rrom laying any duty on tonnage. The plalntlir contended that such con sent had been given. The enso wns elaborately argued, aud the magistrale reserved his decision. Alderman T. J. Mackey appeared for the Har bormaster. Messrs. Simonton A Barker repre sented the vessel. During the trial Mr. Thomas, City Treasurer, testified that the amonnt received by the city from tonnage duties averaged throe hundred and fifty dollars per month. We have no doubt that tho case will be carried to the highest court. Ilcrgman, who swindled the mer chants or Savannah, cane here and attempted the same game, were arrested and discharged upon a writ of habeas corj>us, handed their counsel a package of money marked $50, which contained only $37, then fled to Wilmington, where they were again arrostcd, and again sued out a writ of habeas corpus, but did not get off upon It, and gave tholr counsel a gold watch, so-called, but which was brass. The Judge before whom the writ was returned in Wilmington ordered thorn to bo held for four teen days, In order to give the deputy sheriff of Savannah, Mr. George S. Ilarthetmcss, time to get a requisition from Governor Bullock, or Geor gia, upon Governor Bolden, of North Carolina. Mr. Burthclmcss Immediately went to Atlanta, procured the requisition, and started for Balclgh, telegraphing to Lieutenant Pblllppy, of the Charleston detective force, to Join him at Wil mington, which he did. Night before last Mr. Barthelmcss returned rrom Raleigh to Wilming ton, met Lieutenant Pblllppy, and made arrange ments for leaving on the evening truin. The sheriff of Wilmington promised tosend the prisoners to the depot. They were started from the Jail about dark, both In charge or two police men. Ono or them, Wcstlake, when at the cor ner or Mulberry and Front streets, broke away rrom the guard and ran ror dear life. Seeing that he was about to succeed In making IiIb escape, one or the officers, Nash, a negro, Bred at him with a pistol, striking him in t ho back, but not hurting him very badly. Be was thereupon secured and, with his companion, delivered to the nniters waiting at the depot. These officerrt seeing that the wounded man was not much hurl, and rearing that If they remained much longer they would lose their, prisoners, determined to come straight along, wnlch they did, and arrived here yesterday afternoon. Wcstlake, who was quite weak rrom the effects cf his wound, was, with Bergman, carried into the detective office and Dr. J. Somcrs Bulst sont ror. ne came in a few moments a - -- *sed tho wound.. He round that tho ball, at |>Ao, had entered the right side and glanced afwrg the ribs, and remained In the flash. He advised that it be allowed to remain, to which Wcstlake, who didn't fancy the probing, agreed. About 8 o'clock last night the prisoners were placid aboard of the steamer Dictator, for Sa vannah, in charge of Mr. Barthelmcss and omcor TruaB. Both prisoners take their arrest very coolly, especially Bergman. Both expressed tho opinion that they were on the road to the State hotel at MllledgcvlUc, Georgia; that If the officers had al lowed them to remain in Wilmington twclvo hours longer, they would have gotten off under a writ of habeas corpus, as everything was ar ranged for It. Bergman says that ho was very much surprised when Wcstlake was shot; that he cursed tho negro policeman, which made the negro mob that had collected -very mad, und they wanted to mob him; that ho wouldn't have minded Wsstlake's being shot so much "if it hadn't, been d_pne by a-nigger."
