QUESTION.-Yesterday the question was raised in the United States Court, in the due of Pope TS. Biggs, as to whether the peremptory challenging of two jurors in civil cases, aa existing under tbe St ita law of 1810, was applicable to jory trials in the United States Courts. Tbe question was raised by the plaintiff's attorney, sad argued by tbe Hen. Thomas Y. 8imons and the Hon. C. G. Hem minger in favor of the right, and by tbs Bon. W. D. Porter and T. G. Barker, Esq., contra. Judge Biyan held that the right was inapplicable in tbe United States Court, ss the role had Derer been adopted lor its practice. In consequence of a tack of a quorum the regular moe I in fr of the City Council was not held laat night. Eight o clock ia the time appointed for the meetings, and at that boor Aldermen E. W. M. Mackey, T. J. Mackey, D. Barrow, J. F. Greene, Thorne, L. F. Wall, E. P. Wall and Hampton, the last four colored, were assem? bled around the board. The four colored men clustered together in the centre of the board, and were entertained in conversation by Aldermen E. W. M. Mackey. Alderman T. J. Mackey amused, himself hy writing on a large sheet of paper, what after? ward was ascertained. to be a ticket for city officers. This paper he passed baok and forth tobie white and colered friends, explaining td them where the joke lay, doing so until each and every one "saw" it. Thus the time passed. The fifteen minutes allowed by the ordinance to elapse before tbe meeting can expire by default, dragged elowly by, but the Mayor oame not. In fire minntes more ho did, however, and called the meeting to order. The olerk called the roll, and those shove mentioned, eight in number, answered. The Mayor. There being no quorum pres? ent, FD heir a motion to adjourn. Alderman Barrow. I move that the Board adjourn until Tuesday night next. The Mayor, i'll hear a motion to adjourn. E. P. Wall (colored.) I move we adjourn, subject to tbe call of the Mayor. Alderman Barrow. My motion was seconded, Tbe Mayor. I am not entertaining motions io adjourn to a fixed time. Alderman Greene. I seconded his (Bar? row's) motion. Alderman Barrow. I do not see how yon can entertain one motion to adjourn and not another. He then read a mle from Jefferson's Manual regardiog the adjournment of meetings to a given time, and claimed that the role ap. plied in this case. The Mayor. That mle only governs legisla? tive bodies, and not this Council. The only motion I can enteitain is one to adjourn. AB there is no motion to that effect I now adjourn Council. The Mayor then arose and waa leaving the chamber, when Alderman T. J. Mackey jumped to his seat and said, in a sarcastic tone: I regret that yon bare left the chair eo abruptly, as I have a ticket for city officers to present, made np from your known personal friends. This announcement occasioned a great deal of amusement, and a large namber of persons, who are known to bare "an eye to offica" and "hopes," gathered around bim to look over the ' paper which the Alderman freely displayed. Conspicuous among this crowd, was the nan? keen-colored office-hunter De Large, who voci? ferously requested a copy for the African Missionary. The Mayor, who had only turned to look at Alderman Mackey when he addressed bim, had, by thia time, left the chamber. Alderman Barrow. I move that Alderman L. F. Wall take the chair and adjourn the Board properly. Wall, colored, arising, and with an innatural dignity, said: I decline. Alderman Barrow. 1 mean Alderman E. P. WalL E. P. Wall, colored. I enjoy a good joke, bnt I will not be made a down of in snch a farce as is being enacted here. [Laughter.] Alderman T. J. Mackey. It is not necessary that any Alderman should take the chair. The petition, which THK NXWS of Monday last mentioned as being in circulation among the frequenters of the courthouse aud other build? ings in the vicinity of Broad and Meeting streets, to get Council, to pave that section with a newly patented pavement, is we learn, being energetically poshed forward, the mov? ers claiming that the noise from passing vehi? cles interrupts the business of the courts, and that the sawdust whioh was laid down to dead? en the noise blows in then* own and everybody else's eye?. As we have said before, the city coffers are not in a condition to have this work done at present, and, besides, there are other streets that sadly need paving, and should re? ceive attention first. For instance, King-street, on whioh nearly all of the retail trade of the city is transacted. The judges, jurymen, law? yers and others will have to bear with the noise for awhile longer, and if the sawdust will persist in blowing into their eyes, they can have it removed altogether. INTEKZSXLNQ EXXBCUSXS or TEE 8UHDAT SOBIOL or THE CTTADXL SQUABS BAPTIST CHUECH. - On Sunday last the anniversary of toe Sunday-school of the Citadel Square Baptist Church was celebrated in tbat Church, and tho exercise j were of a most interesting character. The reports upon the condition of the school showed that there are at present four officers, twenty-three male and female teachers, one hundred and forty six male, and one hundred and forty-nine female sohoiara. During tbe past year one fe mal a teacher and one female Bsholar were removed by deatb; one officer, one female teacher, one male and tbree female scholars united themselves with tho Church. The "Infant class" of this school has eighty two members, bat only one-fourth of the num? ber wore present, the epidemic (measles) keep? ing the remainder away. A prize was given to each member of this class, and about forty prizes were distributed among the more ad? vanced scholars. The exercises wero conducted in tho follow? ing order: Singing, "Marching Along;'1 prayer by the pastor; singing, "A Land Without a Storm;" reading of Scripture; singing, j "We'll Try to bo L'ke Jesus;" adcress by the pastor; Superintendent's report; singing, "The Better Land;' distribution of prized; singing, { "Singing and Praising;" benediction. Porter for defendant. Jory No. 1 were occupied with hearing testimony until the hour of adjournment. In the Bankrupt Court, Wm. Summer was finally discharged in bankruptcy. THE STATE CO?BT-IN THE GEN EBAL SES? SIONS-HON. B. B. CARPENTEE, PRESIDING. The case of the State vs. Gabriel Levy, indict? ment for murder was up for trial. The cir sumstanees, as developed by the evidence, are briefly these: On the 25th of September, 1868, the prisoner and deceased were at work upon the plantation of Dr. B irkcr on Cooper River, about fourteen miles from the city. A dispute occurred be? tween the prisoner and one Robin Steward, which was afterwards interfered in by the de? ceased. After daring the prisoner to come ont on the bank, the deceased assaulted him. The prisoner did not return the assault at first, but upon its being continued, picked np a paddle in an adjoining canoe and hit the deceased upon the head; that before being separated, the prisoner and deceased resumed the work, and that on the next day Richard Nesbitt died. After the examination of the testimony, John A. Moroso, Esq., opened for the defence. He contended that even if the death resulted from the blows as alleged, the circumstances of the case deprived it of its criminal nature, and made it a case of homicide se defendendo- that the prisoner inflicted the blow under the im? pression that he was about to receive great bodily barm, and only after having retreated. He demanded a verdict of acquittal for the prisoner. Attorney-General Chamberlain then address? ed the jury in reply. He contended that the right of self-defence was undenied, but that it should be only exercised in a reasonable man ner, and that the infliction of the blow was the promptings of malice, and that the jory were bound to convict of murder or manslaughter. G. H. Sass, Esq., closed the argument in be? half of the defence. He contended, first, that there was an absence of malice necessary to make it murder; second, that it was not in evi? dence that the death resulted from the blow, and that, even admitting that, under all the circumstances, it was a case of justifiable hom? icide. His Honor the Judge charged the jory that under the evidence they were bound to return a verdict of murder or manslaughter.
