MURDER AND MONEY. The Case of McConnell- Acquittal of the Prisoner. ?> JJIinoie has been indulging in the sensation cf a murder trial which attracts more than or? dinary at ent ion, both from the peculiar cir? cumstances ot the crime and the fact that the agency relied npon for conviction was circum? stantial evidence. The following is a brief ] statement ot the facti involved m the case : OJ the morning of the 9eli of February last -the inhabitants of the quiet little village cf] Jacksonville were startled by finding dead and murdered in his office Mr. Murray McCoonoil. one of the oldest and most prominent of the citizens of the place. It was sboitly before breakfast, and the hour when, in a small towo, there is least apprehension of danger or crime, every ou e bei Dg moving. Within a short time, suspicion being of-course intensely excited, facts were developed which led to the arrest of Wm. A. Robinson, a young man of heretofore good charaoter, a grocer by occupation, and the son of an old and esteemed oitizeu. Bab inaon was the debtor of General McConnell, and the theory of the prosecution is that out In the Western village was re-enacted on a small Beale the Webster-Parkman tragedy, which has made Boston celebrated. Tho ?monot, it is tine, in this eise was but small , some few hundred d-liara-but tue passions aroused were the same. At all events, this tragedy starts a eutrges tive reflection. One of the great risks speed? ing the loaning of money does not ordinarily seem to be taken into account Lenders will . earafully weigh the security, the danger ot loss by death, fire, fraud or other causes, but they rarely toke into estimation the perd into which they may venture their lives. An igno? rant or thoughtless debtor will always look on the death Of a creditor as a relief, and in more than one wey it is. It is at least a suspension of proceedings or temporary diversion, and human natore knows that administrators do not push and collect with the same vigor as their dead principals. A thousand times, debt has made the deDtor wish, even perhaps un? consciously, for the end ot bis creditor; and nore than once ii h zs nerved the arm to drive the fatal blow. Should the bargain be a hard ons-should the terms be exacting and gri the conscience of the debtor will even at pt to defend what his hand shrinks from. In this case, so far as we know, the loan was usurious. IQ the statement ot the prisoner, received in evidence, we find that be admite that he owed money to the murdered man, and gives ns the items of the transaction. Says the accused : "I have been acquainted with General McConnell ever ance I came to Jack? sonville, intimated ; I have bad business with him; the first was on the 31 day of May, 1867; I borrowed money of bim-$420, $300 at 40 per cent, premium ; I give my note, due in one year, st 10 per cent ; it was paid and takeo up; I give anjther note in Septem b?r of that year; Kelsey Bod signed the $400 note; General Mc? Connell gave me gold oom-no coupons or bonds; I pail the note by giving another note for $400. at 10 per cent interest from date; I don't remember when it was dae; Messrs. Mil? ler ? Miyfoid were securities; I executed the note in 8eptembti; the 17rb, I think; it was paid-in December; I paid the laBt note in this office; General McConnell and I were present, and no one else; it waa in the afternoon, late in the day ; I paid him an even $41)0; 1 think-j thi note included the interest; 1 paid it, and he gave me $5; I think the note was drawn io duding 10 per cent, a tvance on the first note; I paid the first note by giyrog him hts note and paying $20 and interest, cash; this is tbe Int .note; the other note- was even $400; I owed him that amount; I know the note wis given tor $400, and I paid han that amount, sad he paid me $5; 1 decoyed that note on the same dav; burned u'lnmj stove in De? cember; I did not notify roy securities that 'I had paid that note and execu o J another. " In more than one feature this statement is -vague and unsatisfjotory. Was the forty per fffinti arimniagivenin exchange for gold? If Bot, McConnell was asking and rece ving fifty percent tor this loan-s rate which, if exact ad, the ueb or could not live nuder. On tbe Sd of May. 1867, gold was not?t torty percent, premium but at hirt> -five, so that, under the most favorttblo construcci?n. Mr. McConnell ?as getting some fi teen per cent, from a maa who could only apparently pay his notes by giving new ones. Grea' sympathy for the prisoner prevailed among his neighbors and those of ihe mur? dered man. Everv morning, we aro told be .u titul bouquets ot flowers wert sent bim and lent their gratef .1 presenco to the otherwise grim hall ot juscioe. The prosecution depended entirely on cir? cumstantial evidence-that r. mauce-^ronnd of the law-and thia loot stimulated u..usual in? terest and discu-siou. Above we bave given the motivo ss ureed by the state m its theory cf DruM om iou. It is of coarse, in om-limit, impossiole to ev. uout ma the tv-atimouy, which consists of a vast mass of slixhl aud mdepen dent faots. dome of tho iurora in this fase, when select? ed, asserted their willingness to convict a man on direct tcstim my of murder, bot they weio sjnwiiiiug to do BO when the evidence is purely eireumsuutiul This distinc i?n is more than foolish. lia fact is proved, it matters little how it iidoo and lawyers and me aplnsiciins both admit notv that ot the two kinds of evi? dence, tuat commonly known as circumstan? tial, wheo-tulland on broken is more reliable than that which is properly know^ as direct. And yet men, or a good man - men. as m this ?ase, from the timidity of iguorance, ignore this fact. It bas, indeed, among professional mon, fjrowu almost axiomatic lo assc . that olrcutn itautu I evidence m almost al WL ye more relia Ms than d reot test mouy. Thia is. however, perhaps pashm- tho- doctrine too tar, and ?erta.i.jyopeuM the advocate who preaches rt to ser otis dancer. Ououmsiarjesa^the mute .witnesses of this lino ot evideuco-do not come into court of themselv. e. Ibet leqoire to be proved bv witnesses who give dire* testmcnyto the Jsct ol their exisieuce.' In their being pro-, J. n. duce i lies the danger. They may be mi bap prehended-they may not all be brought our and tbey are not free fran the one great dan? ger woich direct evidence is exposed to. The wit ness wbo swears to circumstantial evidence may swear falsely as well as tbe one who swears to direct evidence. Whether he avers a collateral circumstance or a direct tact from his own ejes and ears, alike he may perjure himself and mislead a jory. The acquittal of (be accused in this instance seems to have been in accordance with the wisbes of all those interested .as friends or present as spectators of the trial. Innocency was a popular verdict long before the legal ODe wa? banded in. Bat this destroys none of the deductions we have made. Io fact, the result of the trial ciincbes them; for if tbe supposed inducement; be so Dowerful, then justice should be more alert, and" if circamstantial evidence be so unerring, then is the fact of innocency, as well as emit, the better established. -A yoong planter named Marr, son of B. H. Marr, a prominent lawyer of New Orleans, was waylaid and murdered last week on bis planta? tion, in Mississippi, by negroes. When found he had been dead probably tw boors, and one hundred and thirty-two buckshot were discov? ered in bis body. Be bad gone out, it is said, fot the purpose of arresting a negro, and was waylaid and murdered by a gang. (Eomtnerri?!. Kot po rt?. PBOVIt ENCE.
