The body had wounds in the stomach, and he under? stood that the deceased was shot on Thursday and 'died on Friday. : -, Dr. DWIGHT testified that he was summoned by Mr. EAYXNEL to inspect the dead body, and found 'tho wound to he in the abdomen, and two lechea in ditmoter. . The body was ranch swoilem. There wen several larg* buckshot found in the wound, some of which ho extracted. He was satisfied that be died from the wound, whioh was inflicted at dose qoirterS, os there was Lat one opening. It tras evidently a gun shot wound. He -had-*Mve* leen Strawberry before Wf?ath; tt?H? most have been a large and .po werful man, far more BO than the prisoner.!! jL'J ?HLJ?. efl. John Horry, colored, testified that he was the brother-in-law of the deceased, and had known him. about three years. He had known nothing about any quarrels between BRANDON and the de? ceased until Isaac had stopped at his houso, after he had left Mr. RAVENEL'S and had Bhown the Bummona he had obtained. He advised Isaac not to deliver the summons in person, but to stop at the house of Messer ve y and got one of his boys to go. He re-fused to do this, saying that he had 'been entrusted with the summons, and would deliver them in person. He did not show the sum? mons, but said they were in his pocket. Ho first heard of the shooting from two negro men who lived near BRANDON, and afterward from BRANDON himself, who told him that his brother was shot. Ho went to tho spot and found Isaac lying down by Mr. HEWES' fence; he was on his back, with both hands outstretched. Isaac knew that he was dying and told him to take the summons from his pocket to Mr. RAVE? NED. He examined his wound and found his waistcoat burnt by tho wad, but the shirt was not scorched. Isaac begged him not to turn him over as he did not think he would live, that BRANDON had shot him. Ho went across a ?old and got i cart and took him to HEWES' house; he could not walk. Isaac told him he had gone to BRANDON'S house and knocked, but no one came. BRANDON subsequently came to the door and he presented tho summons to him, when BRANDON took down his 'gun and said, "did I not tell you never to come here," and then shot him; he dropped the sum? mons ou the floor. Isaac died on Friday, about 10 or ll o'clock, while he had gone to Hr. RAVEN EL. this closed the testimony for the prosecution, and the counsel for the defence proposed to placo th? prisoner on the stand; this was agreed to, but the Attorney-General insisted that the son of the prisoner, who was also a witness, should be re? moved from the room during the evidence. '. Mr. INO. C. BBAKDON deposed that, he was a farmer in Berkley District, and was also a minister of the Gospel in the Baptist Church. That in the spring bf 1866, Strawberry and his wife Henri o I ia, came to his gate and called him. They said that they had no place to stay, and begged him to let them stay on lus place, and plant a piec9 of | ground. He had never owned a negro, and re? fused for some time, but they came baok a second thud and he finally consented to let the wo? man stay, in the kitchen, and plant a piece of j ground on shares, on the condition that they would croate BO disturbance. This was agreed to, but Isaac soon commenoed beating bis children ai unreasonable hours and making a terrible noise. He bore this for some time, but finally remonstra? ted with Isaac, who told him he would stop, but did not, and he ordered them away, but on the solicita? tion of his wife, consented to let her remain, but for? bid Isaac his premises. The day the last potatoe was dug,h e again told them to leave and they went to Mr. HEWES. He had been repeatedly disturbed during their stay, by turbulent conduct; this was particu? larly the case one night when Isaac told him that he would make his children beat bis son, and would j beat him also if he did not stop talking to him. After they had left, he did not think anything mora of it until he saw Isaac coming through the gate into the house. The family were at the din? ner table, and Isaac approached without knocking or speaking, but had a vindictive look. As he ar proached tue table, Brandon arose and came to? ward him, and seeing that he was eyeing the gun, which was in a rack over the door, he moved to? ward it at the san e time that Isaac did, and both seined it simultaneously- Isaac at the muzzle and i ho at tho breech. A struggle ensued in which the gun waa discharged, the hammer catching in his clothes. HENRY BRANDON, the son of the prisoner, was ?hen introduced, and the objections as to his age and knowledge of the responsibilities were satis? fied by his ans wara. His statement corroborated his father's in every particular, and gave no addi? tional light to the case. The argument was opened by W. G.
