Tho cap tain's boat swamped about daylight; all lost but four out of her, the captain, pilot, second mate and stoward. Tho other life boat pickod them up. Ha says that among tho prison ers at present cotUlnod at tho Dry Tortugas, is Col. C. C. Tow, who was wounded and captured at tho bnttto of Sharpsburg; that ho was taken to j Fort Dolawarc, ana afterwards to Fort Clinch, on tho Florida coast; that at timo point, in his trans fer, in an attompt to escapo, hu killed a Colonel Turnor of tho Northolm nrniy, for which ho was tried by a court-martial, and sonlonccd to per petual imprisonment at tho Dry Tortugas: thal ho lind bean severely wounded in his hip, probably in tho attompt to escapo, from wliich ho was still suf fering. Ito says that Col. Tow ia passing uudor an m. inned nama, but that ho gave him his real i nanto; and though professing to no intimacy or frequency of intercourse with Col. It appears that tho son tonco of two of them wa commuted by Qonoral Sickloa; that Secretary Kteuton, in viow of tho opinion hold by the Supremo Court relativo to tho legality of military trials sinco tho cloao of hostilities, -.recommended tho commutation of tho death sentence. Tho other two, who ho says ho behoves woro tho murderers, woro properly triod hu foro a military tribunal, justly convicted, but lt did not seem to'him proper to recommend their execution, in view of the opinion which he know was held by tho Supreme Court. Ho recommend ed tho confinement of tho prisoners at the Tortu gas, but afterward changed tho recommendation to lori Delaware. Ho consulted no ono bul Gon ers! Townsend as to tho propor placo of imprison ment, and locommondcu Fort Dolawaro becauno ho thought it on tho whole tho beat of tho military prisons for that purpose Ho itovcr for a moment anticipated that tho civil couria would intorfero with thom there. Elliott, proving that his name be changed, sotting forth that ho was a resident of Onoida Countv, N. Y., wbou the war began, and namod Silas . Smith, but wishing to avoid the draft, ho loft tho State, came to Memphis, and adopted tho nama of S. W. Elliott, and that hu and bia wifo had gono under that name over since. Ho now prayed that his namo bo changed back to Hilas E. Smith. Judge Leonard remarked that this was probably tho most renal kable document that had over boen submitted to the court. Justice Creighton moved that his namo bo changod, and that Justino Walker bo allowed to name him. (Laughter.) Justice Millor moved to take away his namo and loavo him without any. (Laughter.)
