schooner Laura 8. Watson, bound for Ducksvillo,
S. C., tho following statement of tho burning of
tho steamer City of Bath.
On Sunday morning, Fobruary 20th, Cupo nat

blowing a strong galo and a rory sharp soa run
ning from the N. W., ll A. M., mado a v nal on

boat, with clown men). When sho wont over, thoy
lot our lino go, and tho first sea carried them out
of our roach. There was Buch a bad sea, our small
boat could not havo lived two minutes. Ho wo mado
sail, wore ship and stood back again; did not reach
thom tho first tinto. Wo mado live Uoka; tu iee
wo stood by and could not find thom, thoro was
such a heavy sea and ono end of tho boat waa sunk.
All but four moin wero washed away and drowned.
We saved four by running by thom and heaving
them lines; thoir namoa aro Frank Tuby, Charles
Davis, Jeremiah O'Brien and Patrick Donovan, all
of Boston. Thoro woro 26 persons on board tho
steamer and 22 lost. Thoro woco taroo passengers,
o'ie n an, woman and child. THb fire started in
ono of tho coal bunkors, causod by a partiton tak
ing fire from a lamp that was banging against it;
took fire about 1 o'clock Sunday morning; thc
steamer was hove to at the time. The boals loft
tho steamer about 4 o'clock in tho morning; tliroo
boats-two lifo aud one common boat. Tho cap
tain's boat swamped about daylight; all lost but
four out of her, the captain, pilot, second mate and
stoward. Tho other life boat pickod them up.
Tho passengers woro in tho captain's boat; tho
captain loft tho woman and child in his boat dead.
The common boat left the hip with four mon in
her. Wo conld not und anything of them, though
wo continued our search from ll o'clock until
nicht.
The mon wo eared were flrcmon. Thoy say they
think the Captain was under Ute infinonco of liquor
whon they pickod thom or him up, and I think so,
too, by the way he managed tho boat whon ho
tried to get alongside of us. I did nil in my
power to save them. Uly vessel was in ballast, and
very light, so wo could not handlo her very well.

Tho citizens of this place woro greatly surprised
though gratified to learn that Colonel 'Pow is prob
bably yet alivo. A youug man, who gives his
name as W. W. Wallaco, a citizen of Little Rock,
Arkansas, ropreBcntu himself to havo boen a
prisoner in tho Government prison at tho Dry Tor
tugas, whore ho haiLboon confined sinco Juno,
18 *J, and from which rte waa released on tho 7th
of January last. Ha says that among tho prison
ers at present cotUlnod at tho Dry Tortugas, is
Col. C. C. Tow, who was wounded and captured at
tho bnttto of Sharpsburg; that ho was taken to j
Fort Dolawarc, ana afterwards to Fort Clinch, on
tho Florida coast; that at timo point, in his trans
fer, in an attompt to escapo, hu killed a Colonel
Turnor of tho Northolm nrniy, for which ho was
tried by a court-martial, and sonlonccd to per
petual imprisonment at tho Dry Tortugas: thal ho
lind bean severely wounded in his hip, probably in
tho attompt to escapo, from wliich ho was still suf
fering. Ito says that Col. Tow ia passing uudor an
m. inned nama, but that ho gave him his real i
nanto; and though professing to no intimacy or
frequency of intercourse with Col. Tow, is satis
fled of bis identity. It will be romomborod that at
tho first report of" his death, it was stated that bo
was shot in tho hoad; this insu save ho has still tho
murks of a wound in his hoad.

tho opinion hold by the Supremo Court relativo to
tho legality of military trials sinco tho cloao of
hostilities, -.recommended tho commutation of tho
death sentence. Tho other two, who ho says ho
behoves woro tho murderers, woro properly triod
hu foro a military tribunal, justly convicted, but lt
did not seem to'him proper to recommend their
execution, in view of the opinion which he know
was held by tho Supreme Court. Ho recommend
ed tho confinement of tho prisoners at the Tortu
gas, but afterward changed tho recommendation
to lori Delaware. Ho consulted no ono bul Gon
ers! Townsend as to tho propor placo of imprison
ment, and locommondcu Fort Dolawaro becauno
ho thought it on tho whole tho beat of tho military

When tho writ of habeas cormts was issued, ho

and decline to deliver un tho prisoners. Ho does
not state what ordoru, if any, wore sent to the of
ficers by tho Attornoy Qonoral, at tho instance of
thu President, nor does bo say anything about tho
intluonco brought to bear upon tho President to

A petition was received from ono S. W. Elliott,
proving that his name be changed, sotting forth
that ho was a resident of Onoida Countv, N. Y.,
wbou the war began, and namod Silas . Smith,
but wishing to avoid the draft, ho loft tho State,
came to Memphis, and adopted tho nama of S. W.
Elliott, and that hu and bia wifo had gono under
that name over since. Ho now prayed that his
namo bo changed back to Hilas E. Smith. Judge
Leonard remarked that this was probably tho
most renal kable document that had over boen
submitted to the court. Justice Creighton moved
that his namo bo changod, and that Justino
Walker bo allowed to name him. (Laughter.)
Justice Millor moved to take away his namo and
loavo him without any. (Laughter.) Justice
Walker said that tho court had nothing to do with
it whatever; ho could ohnngo his namo forty timos
if he wanted to, bnt tho county court had nothing
