Dash at his request. The Sheriff was arrested by W. it. Trcadwoll Esq., Coroner, and brought before Magistrate T. II. Cooko, for preliminary examination on yesterday. The Sheriff appeared with his counsel! Cid. .W. F. Hutson, who contended in an able argument, referring to numerous authorities, that the Prosecuting party was not entitled to have homestead act off in tbis particular case. W. J. De Trovillu Esq., in behalf of tho Prosecu tor, was heard in reply. Magistrate Cooko. rendered the follow ing decision. From tho record iu this case, the Court issuiug the process has certified that the debt, rbr which the levy was made, waa contracted for the purchase of the land levied on and improvements thereon. Therefore, there has been no violation of the Homestead law, not as suming to decide its constitutionality, which expressly excepts this case. Sheriff Riggs was then discharged by direction of the Court. Our latest exchanges announce the death of Cen. John A. Rawlins, Secre tary of War. He was a young man, wh<>sc only claim to diutinctson. previous to the presidential election, was that ho was Ccn. Grant's Chief of staff during the war. Hut having been appointed Secretary of War last spring, he lute since that time, performed tho duties of the office creditably. He was a man of liberal views, firm in upholding his ideas of the right, and always refusing to make his office subservient, to purtizan schemes. By his death Gen. Sherman becomes Secretary of War ad interim.
