CoMJMniA, July 10.-Jndgo Hudson to day rendered a decision affirming it decis ion made by Judge Pickling soino weeks since in regard to tho constitutionality of Section 6 of the Supply Act of 1S70 SO. Tho case ?nose before tho trial justice upon thc refusal of three gentlemen of this city to pay their poll tax, and they were sen tenced to pay a fir.o of ten dollars or bc imprisoned in jail thirty days. Thc grounds for tho appeal substantially were (1) that Section 5 of tho aforesaid Act. was repug nant to Section '20, Artiolo ll of the Con stitution. (2) Bccnuso tho ponalty for non payment of this is nlso repugnant to thc same section, inasmuch ns it provides that no person shall bo imprisoned for debt except in case of fraud. Judge Hudson says that if in thc sense of the Constitution n tax bc a debt, whethor levied upon property or tho poll, then clearly tho Legislatura has no right to pre scribo imprisonment nn n punishment for its non payment. But if it bo nota dobt iu that sonso, then it is in thc power of tho Legislature to prescribo this penalty, as it is conceded that in no other section or or tide in tho Constitution can bc found inhibitions restraining thc lawmaking power. The chief duty of cvnry citizen is to oboy tho laws and to contribute to the support of the State, That contribution is not voluntary, hut is imposed by levying tuxes upon property. This tnx is not a debt in tho ordinary nor logal sonso of thc word. It is not a mailor of contract. It arises neither ex contractu nor ex delicto. Neither by express province, by implied agreement, nor by wrong inflicted, lt is simply iv demand made of its citizens by tho Stato to bring forward each his sharo towards tho maintennnoo nnd support of thc government, which demand Hie citizen bas tin option nor choice in responding to, but, if recusant, can bo compelled to obey by nil tho sovereign powers of tho bind.
