Clemson Agricultural College of South Carolina has lest its fight in the United States supreme court to escape suit for payment of $S,000 to Dr. John Hopkins, for damages alleged to have been done to his land by the building of a dike on Seneca river in Oconee county, South Carolina. The South Carolina courts held that the college wa9 an agent of the state and could not be sued. Justice Lamar holds that this view was wrong and directs further proceedings, looking toward a hearing of the suit. This decision is a complete knockout for the contention that Clemson College is a 9tate institution. The effect of the decision is far-reaching. Besides affecting the 9tatus of the col- i lege, it makes unnecessary the quo | warrant} proceedings. contemplated , by a recent resolution of the general assembly, to determine whether a trustee of Clemson who holds another state office is violating the constitutional inhibition against one person holding at the same time two state offices of trust and profit. j A Leading California Druggist Pasadena, Gal., March 9, 1911.
