Spartanburg Herald, 12th. An interesting case was heard here before Judge Aldricb on yesterday. A marriage solemnized between Miss Fannie V Littlejohn ami Rev. Stephen A Nettles on June 25, 1899, was declared to tie void, and never to have been of binding force. Tho action was Wrought by Miss Littlejohn who alleged that at that timo her mind was ho much impaired by reason of a serious physical ailment, that hIio was incapable of underHtanding, or of carrying out the marriage contract. Almost immediately after tho marriage she was nlnced nn der the treatment of a specialist in surgery and diseases peculiar to women And, as a result of his treatment her mind has been rcstore<l, and that since regaining possession of her faculties she does not wish to ratify or consummate the marriage. The testimony was in accordance with the allegations, and, while Miss Littlejohn testified that Mr. Nettles, treatment was very kind, she would not assume the duties and relationship of a wife. Under this stato of fads Judge Aldrich held that the alleged contract was in fact no contract and so decided. Messrs. Duncan and Sanders represented the pluintifT, and K O Purely, of Sumter, represanted the defendant.
