Section 11 of Article S of the K( constitution provides: "The general assembly shall not delegate to any municipal corporation the power to issue licenses to sell the same (alcoholic liquors.') In other ox words, a municipal corporation w' has no power to exact a license \v tax for carrying on a business it has no authority to license. There is still another reason in support of my conclusion. The Hn i supreme court of the United ! pre ( States has decided in numerous j cases that an act of the legislature of u State levying discriminating taxes against non-residents of the i State was void because repugnant to the provisions of the Federal j | constitution, which guarantee to ** citizens of each State all the privilege's and immunities of the citiI ** zens of the several States. In i my opinion the legislature itself, t|? much less a municipal corporation, ntc would not have the right to exact I of a license tax from a non-resident dn citizen for engaging in the same wi business it is engaged in exempt, wh ! of course, from the payment of bel said tax. In so far ns the right 2S of a non-resident citizen is eoncorned when engaged in any bust ^() ness protected by the inter state ^ commerce clause of the const it u tion the rights of the State are no jf , higher than those ot any private tt , citizen. No act of her's can bin- wt, der in the slightest degree competition upon an equal basis.
