NO LICENSE TAX

So Opines the City
Attorney of O'.ccnville. T
n
' (I leonvillc News.
City Attorney MeCullough yes- }
terda\ delivered an opinion in
\vliit'll he liehl that a eiiy litis no
right to exact a license tax from
an original package business.
The f ill I text of the opinion fol
lows: B
Hon. James T. William-, Mayor, i
^ ami City Council. I
Sirs: My opinion has heon
i aske<l as to the right of the city
'council of (ireenville to exaet a
license tax from the agents of non
( resident citizens keeping here what
; arc commonly known as "Origi
nal Package'' stores.
It is my opinion that such tax
can not he exacted of such persons,
'and I will briefly give my reasons ?
; therefor.
'! Section 11 of Article S of the K(
constitution provides:
"The general assembly shall
not delegate to any municipal corporation
the power to issue licenses
to sell the same (alcoholic liquors.')
When n license tax is exacted ^
mv h ninnicipani \ u is in eon Kid- (<j?
oration of the license or permit ,,?l
granted to do tlio thing licensed.
wl
If the ninnieipality lias no right SPt
in the first instance to grant the ko!
i license or permit, it has on the an
tie*
other hand no right to exact the po)
fees or tax therefor. In other ox
words, a municipal corporation w'
has no power to exact a license \v
tax for carrying on a business it
has no authority to license.
There is still another reason in
support of my conclusion. The Hn
i supreme court of the United ! pre
( States has decided in numerous j
cases that an act of the legislature
of u State levying discriminating
taxes against non-residents of the
i State was void because repugnant
to the provisions of the Federal j
| constitution, which guarantee to **
citizens of each State all the privilege's
and immunities of the citiI
**
zens of the several States. In i
my opinion the legislature itself, t|?
much less a municipal corporation, ntc
would not have the right to exact I of
a license tax from a non-resident dn
citizen for engaging in the same wi
business it is engaged in exempt, wh
! of course, from the payment of bel
said tax. In so far ns the right 2S
of a non-resident citizen is eoncorned
when engaged in any bust ^()
ness protected by the inter state ^
commerce clause of the const it u
tion the rights of the State are no jf ,
higher than those ot any private tt ,
citizen. No act of her's can bin- wt,
der in the slightest degree competition
upon an equal basis. If ju,|
she h?d the right to imjiose $1 j,i 1
she would have the right to impose |ie|
1 $1,000 or even a larger sum and jts
thus accomplish indirectly what ftn,
she can not accomplish directly. j aw
Such a tax would impose a burden icr?
upon inter state commerce and
| might materially interfere there-I UUI
I with if not practically prohibit it. ' c,u
The power to regulate this is dele ;n<,
gated exclusively by the eonstitu- tr(1
tion of t!ic I'nited Staff's to our >acj
national emigre**. Any attempt- ;l|)4
ed interference therewith on the tai
part of a State would he in the ;lir,
very teeth of the Federal con^ti- 1
tution and entirely nugutor>. f
