Ifydrtck presiding, tliis being his Hon- r or's iirst term in Lancaster. Solicitor 1 Honry is at his post. Mr. A. M. Deal, of Columbia, is acting in the place of 1 Court Stenographer McCaw. I , Jn Ills charge to tho grand jury the ( judge stated that ho would tako it for T granted that they had been lully in- 1 structed as to their duties at tho two previous terms of court this year. He ( _ however, desired to call thoir attention ' ? ^ . to one or two matters, the tlrst being 1 the obaraeter of tho oath taken by a grand juror. His Honor ropoatod the 1 oath and then emphasized its most im- ' ]?ortant features, beginning with the ' element of secrecy which is imperatively ' demanded of grand jurors in their coun- i sels, deliberations and investigations. ! Ho also stressed tho requirement that no one must bo presented through hatred or mnliee, for reward or hope of 1 reward, but that all presentments must 1 bo made according to tho evidence and without fear or favor. No man, he said, eould bo placed on trial in this court until the grand jury says ho must he tried. The courts are powerless to ' proceed with the trial, conviction and ' punishment of violators of the law without the sanction of the errand jury ?they must first act and say whether or not thore is a probable case against a party charged with tho commission of crime. Referring to the alleged miscarriages of justice, tho guilty being allowed to ' escape, the judge said responsibility therefor rested with the people themselves, and not with ti e judges and the I lawyers. If law and order are to he observed and enforced in this country tho people through the jury box must do their duty. Our system of govern- 1 mcnl is preeminently one of the people, I for the people and by the people. When, therefore, tliore is a failure in the administration of justice, the blame attaches to the people themselves. It has been well said that no people is better governed thanthoydeserve. His Honor deprecated the disposition on the part of some to discredit and abuse the courts. He said to destroy the confidence of the people in the temples of justice and the administration of the law is to sap tho very foundation of our civilization. Iteforring to tho prevalence of the spirit of mob violence, he, pointed with pride to the fact that the sheriff of his county, Spartanburg, had just successAilly resisted an attack on the jail by a mob. though wounded while thus in the discharge of his duty. Ho said if every county had a sheritT like John Nichols of Spartanburg there would ho no need of rushing prisoners off to places of safety. He said it was disgusting to liiin to see or hear of the law taking to its heels?of a shorifV or other officer running away with a prisoner to escape a mob. The judge announced for the benefit of the petit jury as well that he would send to jail any one who talked to a juror about a ease before him, and that he would send along with such person the juror who would knowingly and willingly allow any other party to discuss a case with him. Ho also urged tho importance of the observance of the hours of court by lawyers, jurors, witnesses and others whose presence is required. lie instructed the crier to keep a record of the names of all witnesses | called by him, saying that such witnesses would not ho allowed pay for their services if they failed to give a good excuse for not being in court. Tho bailiffs were also instructed to keep order in tho court room, as their duties extend bevond the mere rlrawlno ~ "mn of $1.50 a dny. The judge reminded the grand jurors of their duty in relation to the ox amination of the hooka, etc., of tho county , officials, which examination, he aaid, < must 1h) thorough end not merely perfunctory or superficial. John Perry, charged ' with assault and battery with intent to till, verdict, not guilty. George Trues- 0 lale pleaded guilty to burglary and lar- p onyandwas sentenced 5 years' hard n labor on public works or in penitentiary. Wayne Williams was tried during his (, ihsence for assault and battery with intent to kill?senlcd sentence. John ^ Stover pleaded guilty to burglary and larceny and was sentenced to 10 years r in penitentiary. Kd Hood entered a similar plea as to assnult and battery a with intent to kill and carrying con- 6 sealed weapon and was sentenced to h pay a fine of 850 or serve three months i an public works. He paid the fine, y Lewis Dorrah was tried on charge of j violating dispensary law and found ^ Sillily. The latter, upon trial, was found ^ guilty of larceny and received a .1 years' y sentence.
