Richmond, Vn., Sept. 15.?Coveiiug every plnase of toe South Carolina dispensary case in an exhaustive opinion which deals with the broad question ot States' rights, the United Sta Circuit Court of Appeals hanue 1 down ati opinion today lully sustaining Circuit Judge JL'ritchar I in the appointment of receiver-! to wind tip the affairs of the ,! quor monopoly long maintained by the Palmetto Commonwealth. There was no dissent nig opinion, Chief Justice Melville W. Fuller and Judge K Imund NVaddill, Jr., sustaining the law as propounded by Judge Boyd. As counsel tor the Stale Mr. M. W. Stevenson, of Bennettsville, S. C., asked for a stay ol judgment in order to prepare an appeal. He wanted 60 days, though the court agreed tnat tlie documents could be prepared and liled within 40 days, tlia' much time be ine alio*ed. The decision is a voluminous one and holds that the proceeding is not a suit against the State and that the complainant is not torbidden to maintain his action by the eleventh amendment of the Federal constitution. It holds that the framers ot that amendment to the constitution never conceived that a sovereign Sta'e could engage in the liquor business and become a trader by buying and selling an article of commora traffic and common with the citizens of the country. The court questioned therefore whether the State was exercising a governmental prerogative or performing a function ; 1.. 1 -- -* ueursaui uy ur ^nipony inricu'in to ith autonomy as a State. It declared that the fund in controversy, which the complainant claims it should be paid from, being in the hands of the commission charged with the duty of abolishing the dispensary, the Slate has no interest in so much thereof as is necessary to pay the just debts.
