in order to prepare an appeal.

The decision is a voluminous
one and holds that the proceeding
is not a suit against the State and
that the complainant is not torbidden
to maintain his action by
the eleventh amendment of the
Federal constitution. It holds
that the framers ot that amendment
to the constitution never
conceived that a sovereign Sta'e
could engage in the liquor business
and become a trader by
buying and selling an article
of commora traffic and common
with the citizens of the
country. The court questioned
therefore whether the State was
exercising a governmental prerogative
or performing a function

declared that the fund in controversy,
which the complainant
claims it should be paid from,
being in the hands of the commission
charged with the duty
of abolishing the dispensary, the
Slate has no interest in so much

payment ol all just debts of the

of the dispensary "have a
property in the funds in the
